A.LC. Inc. Dba Mason's Marina c/o Ernest Arlart Page 2 9. - PROJECT DESCRIPTION: The project site is located at 7519 Mount Pleasant Drive, adjacent to Pages Creek, in New Hanover County. To locate the property from Market Street (NC Highwayl7), turn onto Middle Sound Loop Road and travel east approximately 2.0 miles past the travel circle located at Ogden Elementary School. Turn left on Mason Landing Road and travel approximately 0.2 miles just until it reaches Canady Road. Turn left onto Canady Road and then take the immediate right at Mount Pleasant Drive. Travel down the gravel driveway until you reach the property of interest. The site is approximately 0.49 acres of highground area, which ranges from approximately 4' to 12' above normal high water (NHW). There is approximately 240' of shoreline on the site that overlooks Pages Creek, which is currently stabilized by vegetation and an approximately 70 linear foot timber bulkhead located along the northern portion of the site. The applicants currently maintain a two -story single - family residence on the property and also a commercial marina DBA Mason's Marina at the project site, which has been in operation since about the early 1960's. The surrounding properties in this area of the Middle Sound community are primarily residential. Existing structures currently located on the project site are access piers, platforms, floating docks, mooring pilings, a dilapidated concrete boat -ramp, fish house /office space and associated gravel parking areas. The existing marina appears to currently accommodate up to approximately 28 vessels, which a number of these vessels appear to be used by commercial fisherman. The floating docks at the marina have been maintained over the last approximately six years through Certification of Exemptions from requiring CAMA Permits from the N.C. Division of Coastal Management (DCM) and local building permits from the New Hanover County Inspections Department. There are also approximately six (6) private docking facilities which currently share the basin/access channel with Mason's Marina, which are associated with the residential properties to the southeast of the marina property. The applicant received CAMA General Permit No. 8659 -D on 04/2/1992 for the existing concrete boat -ramp. Dimensions of the boat -ramp are approximately 43' in length by 15' in width, which widens to approximately 20' in width towards the highground area of the gravel driveway. The existing timber bulkhead was authorized through CAMA Permit No. 53170 on 01/21/2009. DCM was unable to locate previous State Permits for the existing marina facility and associated excavation for the basin and access channel (See Sheets 1 through 3 of 11 and Project Narrative). Existing high ground vegetation on this tract consists of grasses, ornamental landscaping and hardwoods including Oak. Waterward of the highground towards Pages Creek the vegetation on the tract transitions to an area of high marsh consisting of mixed coastal wetlands and "404 type" vegetation, which include: Wax Myrtle (Myrica cerifera), Salt Meadow Grass (Spa?Wna patens). The high marsh then transitions to an area of low marsh, approximately 30' in width, consisting primarily of Smooth Cordgrass (Spartina altern iora). Surrounding the low marsh areas are several oyster reefs visible in the mud flat at low water. The City of Wilmington -New Hanover County Land Use 2006 Update Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of Pages Creek are classified SA by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are Conditionally Approved- CLOSED to the harvest of shellfish by the N.C. Division of Environmental Health. PROPOSED PROJECT: The applicant requests authorization to replace an existing damaged concrete boat -ramp and perform maintenance excavation within an existing commercial marina in Pages Creek. The existing concrete boat -ramp would be entirely removed by the use of an excavator. Once the boat -ramp is removed, the area would then be graded and then a layer of 4" 44 pre -washed stone would be placed in an area of approximately 55' in length by approximately 25' in width. The application states that a new concrete slab (slab # 1), measuring approximately 25' in length by 20' in width would be poured on highground, and once dry would then pushed into place in this area below the NHW and the normal low water (NLW) boundaries. Once this slab is in place another slab (slab #2) of concrete, measuring approximately 30' in length by 20' in width would be poured in place above the NHW boundary to tie into slab # 1. The application states that some of the broken up rip-rap from the old concrete boat -ramp would be utilized along the northern side of the new boat -ramp for stabilization in an area approximately 22' in length by 2' in width. Dba Mason's Marina clo Ernest Arlart Page 3 The remaining broken up concrete material not suitable for the use of stabilization would be removed and disposed of at an appropriate site such as a landfill. The applicant also proposes to perform maintenance excavation within the northern end of the marina facility's basin/access channel, with dimensions of approximately 350' in length by 25' in width to a final project depth of 4.0' @ NLW. The material would be excavated mechanically by bucket - to-barge method, which would result in the removal of approximately 650 cubic yards (cy) of material. The excavated material would then be hauled onto the existing highground portion of the property via the new boat -ramp at the location of the existing gravel parking area. The application states that the material would be located greater than 30' from the NHW boundary and stabilized with sediment fencing during the de- watering process. Once the material is dry, it would then be placed along the low areas of the highground along the marina property (See Sheets 4 through 11 of 11 and Project Narrative). 10. ANTICIPATED IMPACTS: The proposed boat -ramp and rip -rap would incorporate approximately 530 sq. ft. of Estuarine Waters and Public Trust, and approximately 600 sq. ft. of Estuarine Shoreline and highground, essentially within the same footprint as the existing damaged boat -ramp. The proposed maintenance dredging would disturb approximately 8,750 sq. ft. of shallow bottom area, which would result in the removal of approximately 650 cy of material from the existing access channel/basin. Based on historical aerial photography the channel has been in continual use since it was excavated. The application states that the dredging limits would maintain a 10' offset from the location of the existing Coastal Wetlands substrate. The disposal of the spoil material would impact approximately 6,750 sq. ft. of highground, which would be located on -site within the existing gravel parking area. Minor increases in turbidity should be expected during the dredging event; however no long term adverse impacts are anticipated. AW OW e-e -3 a rs .hla f Q e 7 5 Application for Major Development Permit Project Narrative Historical: Mason's Marina, on Page's Creek in New Hanover County, was established shortly after Mr. Preston Mason, the great uncle of the present owner, Betty Shepard Arlan, sold his previous marina, also on Page's Creek, to Mr. Chester Canady, on February 26, 1960. Many local fishermen had convinced him to open another marina, to provide access to the water for many of the residents of the Middle Sound area. Mr. Mason accommodated their request and dredged the boat basin that became Mason's Marina. This was done between 1949 and 1966; see drawings 10 & 11, NHC Aerial Photographs, pages 20 & 21. The marina has remained in the immediate family ever since it's inception and has been in continuous operation under that name. The present owners, Mr. & Mrs. Ernest James and Betty Shepard Arlan have owned the business since 1990. Since New Hanover County Zoning Ordinance was first passed on October 15, 1969, Mason's Marina was in operation prior to the surrounding area being zoned residential, R -20S. CAMA issued a "Dredge and Fill General Permit ", to repair the existing Boat Launch ramp, on April 2, 1992. Permit Number 8659 -D. Proposed Project: The 2013 application is to cover both boat launch ramp repair and potential need of maintenance excavation: This project has three phases: site preparation; ramp construction; and maintenance excavation. The first two phases will occur as soon as possible and the third as needed. Phase 1, Site Preparation: The existing boat launch ramp has been in continuous use since the early 1960's. In 1992, the present structure was poured; under CAMA permit 8659 -D, replacing the original ramp. Since then, erosion of the sand beneath the ramp has resulted in cracking of the concrete and deterioration of the structure. We will remove the existing concrete ramp, using an excavator, grade the surface and lay a 4 " layer of #4 pre -washed stone. Some of the broken concrete fragments will be laid to the upstream side of the ramp, between the bulkhead and the floating dock, to protect the new structure from future erosion. (Drawing 4, p14, rip rap) The remaining concrete will be removed from the water. Phase 2, Ramp Construction: To create a uniform base with a slope of between 15 and 20 degrees, we will use an excavator to place and level #4 pre - washed stone over an area of approximately 20' wide by 55' long, 25' of its length will be below normal high water. This will leave approximately 5' 6" and 6' of water at the end of the ramp at low water. We will pour a 20' by 25' concrete slab, above normal high water, and push it in place using a four wheel drive loader. This slab, slab #1 in drawings, will be T' thick and RECEIVED DCM WILMINGTON, NC 9 FEB 1 3 '1013 contain #5 rebar on 12" centers. We will leave 24" of the rebar exposed on the upslope end, to be used to tie this slab into slab #2, the pour in place slab. At a time of low water, we will pour slab #2, 20' wide by 30' long and r thick, with #5 rebar on 12" centers, in place and tied to slab #1. Rip rap will be placed along the Northern edge of the ramp to protect it from erosion and undercutting by the current. (See phase 1 and drawing 4, p14.) Phase 3, Maintenance Excavation: As shoaling occurs, we propose to engage in maintenance excavation of sand from the boat basin and canal along its margin. Prior excavation was completed sometime between 1958 and 1960 by Mr. Preston Mason. We will use the "bucket and barge" method to remove shoaling and deposit the material on our property to fill in and level low spots. Our estimate is that between 245 and 650 cubic yards of material would be removed and spread. Dewatering material will be contained by silt fencing and located at least 30' from NHW. (See drawing 1, p11.)
