After careful, site - specific review of the project, NCWRC does not foresee the need to enforce the February 15 —
September 30 moratorium on the 401 Certification for the current project design as it should minimally disturb water
column and shallow water habitats.

Maria,
DWQ requests your comments regarding the in -water work moratorium as currently referenced in the DWQ 401 permit
(DWQ312 -1020) being removed from the permit conditions.
Currently the language in the 401 permit states:
"The permittee is required to adhere to all appropriate in -water work moratoriums (including the use of pile driving or
vibration techniques) prescribed by the NC Wildlife Resources Commission, the US Fish and Wildlife Service, and the
National Marine Fisheries Service"
We propose to remove this language from the permit due to the limited scope of this project.
