RE: Acknowledgement of Requirements and Intent to Comply
NPDES Permit NCS000395
Dear Ms. Powell:
In accordance with the Notice of Compliance (NOC-2021-PC-0504) issued for NPDES Permit
NCS000395, Mecklenburg County is hereby acknowledging the following requirements and its
intent to comply:
(1)Respond in writing within thirty (30) calendar days from the date of receipt of this notice
to acknowledge these requirements and the intent to comply.
Status: Fulfilled by submittal of this letter.
(2)Submit a Draft Stormwater Management Plan (SWMP) which details specific actions,
measurable goals, and implementation timelines for the stormwater management program
over the new 5-year permit term. The county’s current Storm Water Quality Management
Program Plan is an acceptable SWMP alternative. The County shall submit the Draft
SWMP to DEQ for review and comment within one hundred twenty (120) calendar days
from the date of receipt of this notice.
Status: The County plans to make only minor changes to its current SWMP dated March
2021. This revised version will be submitted to DEQ by September 1, 2021, which is
calculated as one hundred twenty (120) calendar days from the date of receipt of the
notice via email on May 5, 2021.
(3)Submit an NPDES MS4 permit renewal application within one hundred twenty (120)
calendar days from the date of receipt of this notice. A new 5-year NPDES MS4 permit
will be noticed for public comment along with the submitted Draft SWMP.
Status: The County will submit to DEQ an NPDES MS4 permit renewal application by
September 1, 2021, which is calculated as one hundred twenty (120) calendar days from
the date of receipt of the notice via email on May 5, 2021.

(4)Respond to any public comments on the Draft SWMP and submit a Final SWMP for
DEQ approval and concurrent final permit issuance. The final DEQ-approved SWMP
shall become an enforceable component of the new NPDES MS4 permit.
Status: The County will respond to any public comments on the Draft SWMP and submit
a Final SWMP for DEQ approval and concurrent final permit issuance.
(5)Notify DEQ immediately if it is determined that any of the eight current co-permittees
will not be included for coverage under the new permit, or if any new co-permittees will
be added.
Status: Please include all eight (8) current co-permittees under the new permit. We do
not request the addition of new co-permittees.
