Box 437 Ansonville, North Carolina 28007 NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES August 9, 2002 Subject: Request for a Payment Schedule for Civil Penalty Assessment Town of Ansonville - WWTP Case Numbers LV 02-165 and LV 02-250 NPDES Permit Number NC0081825 Anson County Dear Mr. Wilson: In a letter dated August 7, 2002, you requested a schedule for making partial payments toward the civil penalties assessed in the above listed cases. The cases, originally assessed at $1,575.21 and $1,825.21 respectively, have been settled for a total amount of $2,750.42. The Department is agreeable to entering into an agreement with the Town of Ansonville through which twelve (12) regular payments will be made beginning September 1, 2002 and continuing through August 1, 2003. You agree that beginning September 1, 2002 and continuing through July 1, 2003, to pay $229.20 each month. By August 1, 2003, you agree to pay the balance in the amount of $229.22. The payments should be made by check, payable to the Department of Environment and Natural Resources. Mail the payments so they are received by the first business day of each month, as indicated on the enclosed attachment. Please include the enforcement case numbers with each payment. Failure to make the monthly payments in accordance with the above schedule will cause the entire unpaid balance of the civil penalty to be due and subject to collection through a civil action in the superior court. On August 8, 2002, the Division received a request from Mr. Daniel Wilson for a payment schedule. In order to resolve this matter, DWQ and the Town of Ansonville agree to enter into a payment schedule to settle the above -described civil penalties. The Town of Ansonville agrees to pay the settled civil assessment of $2,750.42 as per the terms below as full settlement of the multiple violations described in the above listed enforcement cases and understands that any default in payment or failure to submit payment by the day of the month in which payment is due will result in the immediate referral of the cases to the Attorney General's Office for collection through the courts. The Town of Ansonville also acknowledges that DWQ is within its authority and reserves the right to take enforcement action against the facility for future violations should they occur.
