The undersigned further understands that all evidence presented in support of remission of this civil penalty must be submitted to the Director of the Division of Water Quality within 30 days of receipt of the notice of assessment. It is our position that our particular situation meets the criteria outlined as possible justification for this request. The Town of Ansonville cannot afford to pay these penalties and continue the planned improvement to our wastewater treatment plant's disinfection system. The Town has been working with Vance McGougan with Hobbs, Upchurch, and Associates since June of 2001 on the design and installation of a hypochlorite solution system and a dechlorination system for the disinfection of our plant's effluent. The Town realizes that this is a long time for the implementation of what seems to be a small project. A mixture of the Town's economic condition and the engineer's lack of expedience in this project has been the main cause of the delay. The Town contracted the engineering firm to design and oversee the project in the summer of 2001. Since this time the firm has been in no hurry to see the process through, even though the Town has made every effort to encourage their progress. This would not be a problem if the Town could afford to contract a different engineer to finish the process, but this would mean paying off the other contract. The Town just does not have the financial capability to do this. The Town has already made cutbacks to our budget in high demand areas, due in part to the state withholding much needed revenues from us. The painting of our WWTP has been put on hold until funds become available, along with all other projects other than the disinfection system. The Town is attempting to operate at the most efficient and compliant methods available. It is the Town's request that the state reduces or removes the amount of the listed penalties to insure that the Town can afford the needed improvement to our disinfection system. The Town looks forward to hearing from you regarding this request. We also appreciate your time in this matter.
