Manuel, Assistant Supervisor Water Quality Regional Operations Section Raleigh Regional Office Division of Water Resources, NCDEQ 2800 Barrett Drive Raleigh, NC 276 Re: Notice of Violation & Intent to Assess Civil Penalty Tracking Number: NOV-2021-LV-0271 NPDES Permit No. NC0025402 Dear Ms. Manuel, The Town of Enfield is in receipt of the above referenced Notice of Violation citing NPDES Permit excursion for Flow during the month of February 2021. The Town is providing the following information concerning the exceedance of the NPDES Permit Flow limit of 1.0 MGD as a monthly average. During the month of February a total of 8.30 inches of rainfall was measured and recorded at the wastewater treatment plant. In addition during the previous month of January, a total of 4.5 inches of rainfall was measured. These two extremely wet months resulted in an excessive amount of extraneous water entering the wastewater treatment plant. The normal monthly flow average for the wastewater treatment plant is less than 0.200 MGD. As noted, the monthly average flow for the month of February was 1.36 MGD. The February monthly flow average is more than six times greater than the normal monthly flow average. The Town has been awarded $1,199,080 grant funding from Department of Environmental Quality. The Town has allocated $441.252.00 of the grant funds to make repairs to the collection system piping conveying the sewer to the wastewater treatment plant. The Town anticipates the first stage of these repairs to be completed by November 2021 and the second stage to be completed in the first quarter of 2022. The Town of Enfield requests a reprieve of assessment of civil penalties and any further enforcement action. The Town of Enfield is a small community of approximately 2,400 residents. As a small rural community we have very limited financial resources. The Town takes its responsibility as permittee very seriously and is making provisions to repair the collection system. Payment of a penalty will create a burden to the Town in it's effort to make improvements to the collection system. We greatly appreciate your consideration in this matter.
