Please find attached a modified permit package for Nationwide Permit 27 at the previously approved Pancho
Mitigation Bank in Wayne County, NC. Restoration Systems had originally obtained a permit for this project (DWQ
Project # 10 -0099) to restore streams and wetlands within an approximately 65 -acre site in the Neuse River Basin.
The mitigation plan includes fill within the upstream, wooded reaches of Kennedy Mill Branch and the Main
Tributary to Kennedy Mill Branch to raise the bed elevation of these streams in order to complete priority 1 stream
restoration in agricultural portions of the Site. Fill within these reaches will be tapered back to the existing grade
at the upstream extent of the Site. In the original permit application existing reaches were expected to be partially
filled within 549 linear feet of Kennedy Mill Branch and 254 linear feet the Main Tributary. However, based on
additional field measurements conducted after approval of the initial permit package, it was determined that
partial fill within existing reaches will need to extended beyond initial estimates. Modified fill numbers for partial
fill within existing reaches are as follows.

Additional impacts within the Site resulting from fill of abandoned stream channels and ditches, and construction

3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Surrounding area land use is primarily agricultural, with some low- density residential housing. Onsite land use is
characterized by hardwood forest, agricultural land (row crop production), and pasture (livestock). Riparian zones and
wetland areas are primarily composed of herbaceous vegetation with sparse hardwood canopy species along the
streams. Riparian vegetation adjacent to restoration /enhancement reaches of the Bank is sparse and disturbed due to
livestock grazing, bush hogging, and regular maintenance activities.

Currently 2.2 acres of jurisdictional wetland exist within the Bank including 1.7 acres of cleared jurisdictional wetland and
0.5 acre of forested jurisdictional wetland.

Coastal Plain stream, 3) enhance (level 1) 1969 linear feet of stream, 4) enhance (level 11) 1837 linear feet of stream, 5)
restore 29.0 acres of jurisdictional wetland, 6) enhance 1.5 acres of cleared jurisdictional wetland, 7) preserve 0.5 acres
of forested jurisdictional wetland, 8) establish a minimum 50 -1oot wooded riparian buffer adjacent to wetlands and
streams, and 9) establish a permanent conservation easement.

Primary activities designed to restore the Bank include 1) belt -width preparation and grading, 2) channel excavation, 3)
Installation of channel plugs, 4) backfilling of the abandoned channels, 5) partially filling upstream reaches of Kennedy
Mill Branch and the Main Tributary in order to start priority 1 stream restoration in agricultural fields, 6) installation of in-
stream habitat, 7) installation of marsh treatment areas to intercept stormwater flows prior to entering the Bank, 8)
removing spoil, 9) filling drainage ditches, 10) removing invasive species, and 11) planting with native, forest species.
Equipment expected to be used for Bank construction include track hoe, track truck, pump around, and bull dozer.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Current land use practices including the maintenance and removal of riparian vegetation; ditching of adjacent riparian
wetlands; and relocation, dredging, and channelization of onsite streams have resulted in degraded water quality and unstable
banks (stream entrenchment, erosion, and bank collapse). The project was designed to restore stream and wetland function
at the Site, thereby providing functional uplift by removing nonpoint sources of pollution associated with agricultural activities,
reducing sedimentation, providing shallow marsh treatment areas to intercept surface waters, promoting floodwater
attenuation, reestablishing stream stability and the capacity to transport watershed flows and sediment loads, improving
aquatic habitat and providing wildlife habitat. Sediment and erosion control practices will be implemented throughout.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
With the exception of channel work and filling of abandoned channels and ditches, equipment will not be used within wetlands
and all planting within wetlands will be done by hand. Disturbance to wetland areas by equipment used for channel work
(including filling of abandoned channels and ditches) will be minimized by keeping equipment footprints and movements within
wetland areas to a minimum. All channel work within stream enhancement (level 1) reaches will be completed in a manner to
cause as little disturbance to the existing vegetation as feasible and desirable hardwood trees greater than 4 inches in
diameter at breast height will be avoided to the maximum extent possible.

this property inspected to determine the extent of Department of the Army (DA) jurisdiction. To be considered final, a

under the Regulatory Program Administrative Appeal Process ( Reference 33 CPR Part 331). If you wish, you may
request an approved JD (which may be appealed), by contacting the Corps district for further instruction. Also, you may
provide new information for further consideration by the Corps to reevaluate the JD.

There are Navigable Waters of the United States within the above described property subject to the permit requirements of
Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or
our published regulations, this determination may be relied upon for a period not to exceed five years from the date of this
notification.

Section 404 of the Clean Water Act (CWA)(33 USC § 1344). Unless there is a change in the law or our published

present workload, the Corps may not be able to accomplish this wetland delineation in a timely manner. For a more timely
