Skvarla, III Governor Director Secretary February 4, 2013 Mr. Thomas Rinker EBX -EM, LLC 909 Capability Drive, Suite 3100 Raleigh, NC 27606 DWQ Project # 09 -0858 v3 Orange County Re: Cape Fear Riparian Buffer and Nutrient Mitigation Umbrella Banking Instrument (UBI) Ivey Ferguson Bank Parcel AMENDED Credit Release Dear Mr. Rinker: On October 1, 2010, the Division of Water Quality (DWQ) received a Bank Parcel Development Package (BPDP) for the Ivey Ferguson Bank Parcel in Orange County, North Carolina. On April 5, 2012, at the request of Katie Merritt with DWQ, EBX -EM, LLC submitted a revised BPDP depicting a name change to the bank sponsor from Mid - Atlantic Mitigation to EBX -EM, LLC. On September 6, 2012, DWQ received documentation showing that the site work had been completed and monitoring plots had been established on the subject site. As allowed in the UBI, EBX -EM, LLC elected to construct the project without obtaining a Performance Bond. On January 18, 2013, DWQ received a conservation easement. On January 24, 2013, DWQ submitted a credit release letter releasing 40% of the site's available "generated" nitrogen and phosphorous offset credits. This credit release letter has been amended to also show the amount of "delivered" nitrogen and phosphorous offset credits that are available now for sale. Please replace the letter dated January 24, 2013 with this one, and update your credit balances accordingly to show both generated and delivered nutrient offset credits. According to the UBI, the following Project Milestones have been met, and the corresponding generated and delivered credits shall be released: Milestones Credit Task 1) BPDP Approved by DWQ, Conservation Easement recorded & 20% Construction Completed as delivered in Task 2 Task 2) Mitigation Site Earthwork, Planting and Installation of 20% Monitoring Devices Completed By copy of this correspondence, DWQ confirms that you have satisfied the above requirements for the above - referenced tract. Generated credits are credits that have not been applied to the appropriate delivery factor. The delivery factors applied to this bank due to its location in the 14 -digit HUC 03030002060070 are 40% for nitrogen and 19% for phosphorous. Therefore, the total amounts of delivered nutrient offset credits for this 10.18 acre site are 9,251.69 lb -N and 283.04 lb -P. By copy of this correspondence, 40% of your delivered nitrogen offset credits (0.4 x 9,251.69 = 3,700.68 lb -N) and 40% of your delivered phosphorus credits (0.4 x 283.04 = 113.221b -P) are now available for sale. A total of 40% of the generated nitrogen credits (9,251.69 lb -N) and 40% of the generated phosphorous credits (595.88 lb -P) have been released for this site. A total of 40% of the delivered nitrogen credits (3,533.28 lb -N) and 40% of the delivered phosphorous credits (11.25 lb-P) have been released for this site. Only the delivered nutrient offset credits can be sold from this bank. Please note that nutrient offset credits delivered at this site must be used for impacts in the Upper New Hope Arm of Jordan Lake within the Cape Fear River Basin. As a tool, DWQ has created a document to assist the general public with locating delivery factors by 14 -digit Hydrologic Unit Code (HUC). This document is attached to this letter and is referenced as "Attachment B" in future correspondences. As always, please copy DWQ on all correspondence related to credit sales.
