Herman Road Facility Wake County Dear Mr. Heidinger: Our Office recently received an application from your facility at 6848 Mount Herman Road for a discharge permit under the Stormwater NPDES program. Your application was submitted in response to a request from our Raleigh Regional Office in a May 4, 2011 letter. In reviewing the submitted package the Division has determined that you have not provided the necessary information requested in the May letter to allow us to move forward with your application. As you are aware, PCB contamination has been documented at the adjacent Ward Transformer site, unnamed tributaries to Little Brier Creek, Little Brier Creek, Crabtree Creek, and Crabtree Lake. The Raleigh Regional Office has also been informed by EPA Region IV that the PCB contamination has been documented at the subject Estes Express terminal facility. Your facility is required to be permitted under a federal NPDES stormwater permit. The failure to be properly permitted for stormwater discharges is subject to a civil penalty assessment of up to $25,000 per day. It is evident from your application for coverage under the North Carolina General Permit NCG080000 that you wish to comply with federal permitting requirements. The reported contamination of the site with PCBs and the risk of continued downstream mobility of this serious pollutant, coupled with the potential for expected and normal on-site industrial activities and land disturbances or maintenance (e.g. utility line maintenance, grading, landscaping, new construction, etc) common to active industrial sites makes this site unique, and a candidate for coverage under an individual stormwater discharge permit, rather than the General Permit. Herman Rd. An earlier inspection had been made by Judy Garrett and Myrl Nisely on April 1, 2011. This latest inspection was made to review more closely the activities there related to the No Exposure exemption from stormwater permitting that was issued to your facility in 2007. They found it necessary to deny the validity of the certification any longer because of the existence of potential pollutants from fueling and oil storage operations outside the maintenance building. The existence of an uncovered fueling station and oil storage tanks outside the maintenance building raised enough doubt that a return visit was made on April 29 by Ken Pickle and Myrl Nisely. That review concluded that the company should submit an application (Notice of Intent to apply--NOI)for the transportation general permit, NCG080000. The facility originally was under that permit until a No Exposure was issued in 2007. Once the new NCG080000 is issued, the No Exposure permit will be rescinded. • Page: 2
