Our Office recently received an application from your facility at 6848 Mount Herman Road for a
discharge permit under the Stormwater NPDES program. Your application was submitted in response
to a request from our Raleigh Regional Office in a May 4, 2011 letter. In reviewing the submitted
package the Division has determined that you have not provided the necessary information requested in
the May letter to allow us to move forward with your application.
As you are aware, PCB contamination has been documented at the adjacent Ward Transformer site,
unnamed tributaries to Little Brier Creek, Little Brier Creek, Crabtree Creek, and Crabtree Lake. The
Raleigh Regional Office has also been informed by EPA Region IV that the PCB contamination has
been documented at the subject Estes Express terminal facility.
Your facility is required to be permitted under a federal NPDES stormwater permit. The failure to be
properly permitted for stormwater discharges is subject to a civil penalty assessment of up to $25,000
per day. It is evident from your application for coverage under the North Carolina General Permit
NCG080000 that you wish to comply with federal permitting requirements.
The reported contamination of the site with PCBs and the risk of continued downstream mobility of this
serious pollutant, coupled with the potential for expected and normal on-site industrial activities and land
disturbances or maintenance (e.g. utility line maintenance, grading, landscaping, new construction, etc)
common to active industrial sites makes this site unique, and a candidate for coverage under an
individual stormwater discharge permit, rather than the General Permit. An individual permit can be
crafted to address the potential for PCB transport from your site, and to that end it may include
additional restrictions for maintenance or land disturbing activities, as well as regular monitoring for PCB
contamination in the stormwater runoff from your site.

submit the response to both the Wetlands and Stormwater Branch (at the letterhead address—attention
Bradley Bennett) and to the Raleigh Regional Office, Surface Water Protection Section (3800 Barrett
Dr., Raleigh NC 27609- attention Danny Smith).
1) Please communicate whether you have any knowledge at all as to whether your site is being,
or has been the subject of on-site activities related to the actual or suspected presence of
PCBs through EPA's Super Fund program.
2) If access has been granted to EPA or if cleanup efforts are ongoing such that the on-site
PCB contamination is being remediated through the Super Fund program, please provide
written information on this process and resubmit your original request for coverage under
General Permit NCG080000.
3) If cleanup efforts are not ongoing and access has not been provided, you are directed to
submit an Individual NPDES Stormwater Permit Application, so that appropriate conditions,
sampling, monitoring, and documentation may be included as additional requirements within
your permit to address the water quality risks unique to your facility.

On April 29, 2011 Ken Pickle and Myrl Nisely of the DWQ conducted a follow-up inspection of your site at
6848 Mt. Herman Rd. An earlier inspection had been made by Judy Garrett and Myrl Nisely on April 1,
2011. This latest inspection was made to review more closely the activities there related to the No Exposure
exemption from stormwater permitting that was issued to your facility in 2007. They found it necessary to
deny the validity of the certification any longer because of the existence of potential pollutants from fueling
and oil storage operations outside the maintenance building.
Within 30 days of receipt of this letter,we request that you submit to this office(address in the footnote) the
attiTheatiftetationlorthe,gengrakawytilter permit that applies to the transportation SIB.code,
1, NCG08000. In addition to that application,the Raleigh Regional Office(RRO)requests that you provide
an account of the status of the PCB cleanup efforts at the Morrisville facility. It is the intention of the RRO
to review the status of the cleanup efforts and make a recommendation to the Central Office as to whether an
Individual Stormwater Permit might be more appropriate for this facility given the onsite contamination.

Inspection Summary:
This inspection was a review of site conditions to determine if No Exposure requirements are being satisfied. The
existence of an uncovered fueling station and oil storage tanks outside the maintenance building raised enough doubt that
a return visit was made on April 29 by Ken Pickle and Myrl Nisely. That review concluded that the company should
submit an application (Notice of Intent to apply--NOI)for the transportation general permit, NCG080000. The facility
originally was under that permit until a No Exposure was issued in 2007.
Once the new NCG080000 is issued, the No Exposure permit will be rescinded.
