Ivey Ferguson Bank Parcel Credit Release
Dear Mr. Rinker:
On October 1, 2010, the Division of Water Quality (DWQ) received a Bank Parcel Development
Package (BPDP) for the Ivey Ferguson Bank Parcel in Orange County, North Carolina. On April 5,
2012, at the request of Katie Merritt with DWQ, EBX -EM, LLC submitted a revised BPDP depicting a
name change to the bank sponsor from Mid - Atlantic Mitigation to EBX -EM, LLC. On September 6,
2012, DWQ received documentation showing that the site work had been completed and monitoring
plots had been established on the subject site. As allowed in the UBI, EBX -EM, LLC elected to
construct the project without obtaining a Performance Bond. On January 18, 2013, DWQ received a
conservation easement.
According to the UBI, the following Project Milestones have been met, and the corresponding credits
shall be released:
Milestones Credit
Task 1) BPDP Approved by DWQ, Conservation Easement recorded & 20%
Construction Completed as delivered in Task 2
Task 2) Mitigation Site Earthwork, Planting and Installation of 20%
Monitoring Devices Completed
By copy of this correspondence, DWQ confirms that you have satisfied the above requirements for the
above - referenced tract. Therefore, 40% of your nitrogen offset credits (0.4 x 23,129.23 = 9,251.69 lb-
N) and 40% of your phosphorus credits (0.4 x 1,489.70 = 595.88 lb -P) are now available for sale.
Please update your credit ledgers accordingly and submit to Ms. Merritt within 30 calendar days from
the date of this letter.

A total of 40% of the available nitrogen credits (9,251.69 lb-N) and 40% of the available phosphorous
credits (595.88 lb -P) have been released for this site.
Please note that nutrient offset credits generated at this site must be used for impacts in the Upper
New Hope Arm of Jordan Lake within the Cape Fear River Basin, and the appropriate delivery
factors must be applied. Please see Attachment B, attached to this letter for a list of delivery
factors for each 14 -digit Hydrologic Unit Code (HUC).
As always, please copy DWQ on all correspondence related to credit sales.
