As discussed with you, Ronnie, the report does not include stem counts of the planted trees. This is due to the difficulty in locating the stems among the herbaceous vegetation. SEGi will submit a vegetation count by 31 May 2013, which will complete the first monitoring report. Project History and Current Status A. Permitting Shelter Creek Capital, LLC (herein referred to as the "Permittee ") has undertaken limestone mining activities at the Shelter Creek Quarry (SCQ), located south of NC Highway 53 and Angola Bay, west of Old Maple Hill Road, northeast of Burgaw, Pender County, North Carolina (Latitude 34.63206 and longitude - 77.74502). The Permittee is currently cultivating and maintaining an open pit limestone rock quarry, which involves mechanized land clearing, excavation and extraction of soil, marl and limestone from 173.5 acres of land. The Permittee plans to extract approximately 45,000,000 tons of marl and limestone. To facilitate the mining activity, the Penmittee has secured the North Carolina Division of Water Quality (DWQ) and the US Army Corps of Engineers (USACE) authorizations, in the form of an Individual Certification and the Department of the Army (DA) Individual Permit. These authorizations allow the discharge of fill material into 43.82 acres of jurisdictional wetlands at the quarry site. To date, 6.33 acres of wetlands have been impacted. B. Mitigation In order to offset the impact to wetlands, the Permittee has elected to utilize a combination of compensatory mitigation components, which consists of payment to the NCEEP and permittee responsible mitigation, in the form of restoration, creation, and enhancement. While payment for 5.5 acres of non -riparian wetland restoration credit has been accepted by the NCEEP and such payment has been confirmed by the agencies, the Permittee was approved for and has constructed a 158 -acre off -site creation/ enhancement/restoration wetland mitigation site off of Croomsbridge Road. II. Project Site The site is situated adjacent to the North East Cape Fear River. Southern Environmental Group performed a wetland delineation, which has been verified by the USACE. According to the grading plan, approximately 87.43 acres of wetlands exist within the parcel boundaries (Appendix 1). III. Mitigation Site Details In accordance with the issued State and DA permits, the permittee shall establish, enhance and/or restore a minimum of 41.78 acres of riparian and non -riparian wetlands, at the Croomsbridge Road Mitigation site. In total, the Permittee anticipates being able to produce 42.2 acres of wetland creation, enhancement and/or restoration. The following sections discuss the work that has taken place in each mitigation component: A. Riparian Creation (38.51 acres) The Permittee created a total of 38.51 acres of riparian wetlands at the Croomsbridge Road mitigation site. Target elevations of ordinary high water levels are shown on the grading plan (Appendix 1). After grading was completed, each section was seeded with a native riparian buffer seed mix, and final planted took place in November of 2011. A selection of hydrophytic trees including green ash (Fraxinus pennsylvanica), river birch (Betula nigra), American elm (Ulmus americana), cherrybark Croomsbridge Road Mitigation Monitoring Report (Page 1 41 5EG oak (Quercus pagoda), water nut hickory (Carya myristicaeformis), tulip poplar (Liriodendron tulipifera), and bald cypress (Taxodium distichum) were planted. B. Riparian Enhancement (3.46 acres) The two borrow pits on the mitigation site were modified in order to convert them from open water features into wetland systems which are comprised of a more diverse mix of hydrophytic herbaceous and woody vegetation. The pits have no outlets and retain excess water. The pits were first pumped down into adjacent wetlands and then connected to adjacent wetlands by a created wetland area. Target elevations of ordinary high water levels and the creation areas at each pit are shown on the grading plan (Appendix 1). The creation areas were seeded with a native riparian buffer seed mix and planted with select hydrophytic trees, which are listed in the Riparian Creation section of this report. C. Riparian Restoration (0.13 acre) After completion of each of the 3 stages of wetland creation and enhancement, historical fill roads through wetlands were removed and the road beds were returned to a grade equal to the existing wetlands immediately adjacent to the restoration areas. After grading was completed, the areas were seeded with a native riparian buffer seed mix, and planted with select hydrophytic trees, utilizing the species listed in the Riparian Creation section. N. Success Criteria The proposed success criteria for a viable wetland system will be based on the presence of three of the three criteria (vegetation/hydrology /soils), described in the 1987 USACE Wetland Delineation Manual', and the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain Region. The mitigation site will be deemed successful once it meets the three wetland parameters outlined in the manual and as fiuther described below: A. Vegetative Success The success of wetland vegetation planting for the created, restored, and enhanced wetland areas will be gauged by stem counts of planted species, within the mitigation areas. Species survival must meet or exceed 320 three year old trees, after three years and 260 five year old trees, after five years. All wetland mitigation areas must be dominated by more than 50% hydrophytic vegetation. B. Hydrology The minimum requirement to meet hydrology success criteria for all created and restored wetland areas will be saturation within the upper 12 inches of the soil for 12.5 % of the growing season. The minimum requirement to meet hydrology success criteria for the enhanced wetland areas will be saturation within the upper 12 inches of the soil for 6% of the growing season. Hydrologic monitoring wells were installed in accordance with the document entitled, "Technical Standard for Water Table Monitoring of Potential Wetlands Sites ", dated June 2005 (included as part of the USACE Individual Permit packet). Seven monitoring wells were installed at locations across ' US Army Corps of Engineers. Regulatory Guidance Letter, No. 02 -02. Monitoring Data Two 30' radius (0.065 -ac.) circular temporary vegetation monitoring plots were established at random locations in two areas of the wetland creation areas (Appendix 2). Stem counts of planted trees were not done during this monitoring event, as it became obvious of the difficulty in location of stems within the dense herbaceous cover. We are requesting a modification to the permit in order to change the date at which yearly monitoring reports are due, from December 31, to May 31. This will give us the opportunity to observe the planted trees after they have grown leaves for the year, and get correct counts and make correct identification of species. Quantitative assessment of herbaceous cover was assessed, as was species diversity. Hydrology and conditions of the soils at each location were also assessed. Data Plot #1: Lat. /Long.: N34.6461 W77.8861 There is an estimated coverage of approximately 70 percent of the ground surface by hydrophytic vegetation. The dominant herbaceous vegetation in this plot includes three or more species of beak rushes (Rhyncospora spp.), two species of panic grasses (Panicum spp.), caric sedge (Carex spp.), 2 species of St. Johns wort (Hypericum spp.), 2 species of primrose - willow (Ludwigia spp.) and yellow eyed grass (Xyris spp.). A hand auger was used to dig a soil pit in this plot to inspect the profile and hydrologic condition of the soil. The soil profile revealed 2 inches of IOYR 3/1 loamy sand. From about 2 inches and deeper, the dominant soil color was 90% 10YR 511 sand with 10% 10YR 5/6 mottles. There was 3 inches of water ponded in the sample area, prominent water stained leaves observed throughout. Data Plot #2: Lat. /Long.: N34.6443 W77.8843 There is an estimated coverage of approximately 95 percent of the ground surface by hydrophytic vegetation. The dominant herbaceous vegetation in this plot includes two species of beak rushes (Rhyncospora spp.), two species of panic grasses (Panicum spp.), boneset (Eupatorium perfoliatum), 2 species of St. Johns wort (Hypericum spp.), 2 species of primrose - willow (LudWgia spp.) and yellow eyed grass (Xyris spp.). One volunteer specimen of wax myrtle (Morelia cerifera) was observed within the plot area. A hand auger was used to dig a soil pit in this plot to inspect the profile and hydrologic condition of the soil. The soil profile revealed 1 inch of 10YR 2/1 loamy sand. From 1 inch and deeper, the dominant soil color was 90% IOYR 511 sand with 10% IOYR 5/6 mottles, with few oxidized rhizospheres. The water table in the plot area was at the surface, with some ponding and water stained leaves. VI. Summary The first annual monitoring event was performed on 28 December 2012. Two data plots were randomly selected to sample the vegetative composition of the mitigation site. No planted trees were counted. There is a good coverage by a healthy and very diverse variety of herbaceous hydrophytic vegetation in both plot areas. The two plots exhibit ample hydrology to support a diverse wetland vegetative composition. There is also evidence of colonization by native woody hydrophytic vegetation. Monitoring Well 6 is located near Data Plot 1, and reflects a hydrologic regime that is beginning to meet the criteria for wetlands. The well occupies slightly higher landscape position than the plot however. The 5 Croomsbridge }load Mitigation Monitoring Report [Page 161 5F.G observations made during monitoring illustrates that this area satisfies the hydrologic parameter for wetlands. Monitoring Well 4 is located adjacent to Data Plot 2, and has continued to show a water table that has been less than 12 inches below the soil surface for the majority of the time that it has been installed. The mitigation site as a whole is stable, has very good coverage by hydrophytic vegetation. We are requesting a modification to the permit in order to change the date at which yearly monitoring reports are due, from December 31, to May 31.
