Dear Mr. Spitzer:
On April 26-30, 2021, staff from the North Carolina Department of Environmental Quality (DEQ)
conducted a compliance audit of the subject National Pollutant Discharge Elimination System (NPDES)
Municipal Separate Storm Sewer System (MS4) Permit, which included individual audits of Mecklenburg
County as the primary permittee and eight co-permittees; Charlotte-Mecklenburg Schools, Central
Piedmont Community College and the Towns of Cornelius, Davidson, Huntersville, Matthews, Mint Hill,
Pineville. The Mecklenburg County and Town of Pineville combined audit did not identify any
deficiencies with the specific components of the MS4 permit that were reviewed, as documented in the
attached DEQ MS4 Permit Compliance Audit Report, which includes by reference the audit report for
Mecklenburg County.
In accordance with Part VI of the permit and DEQ policy, a new 5-year MS4 permit will be issued in
response to the audit. As such, the Town of Pineville is required to either obtain an individual NPDES
MS4 permit or complete the following actions in cooperation with the primary NCS000395 permittee,
Mecklenburg County:
(1) Town of Pineville shall respond in writing within thirty (30) calendar days from the date of
receipt of this notice to acknowledge these requirements and the intent to comply.
(2) Mecklenburg County shall submit a Draft Stormwater Management Plan (SWMP) which details
specific actions, measurable goals, and implementation timelines for the stormwater
management program over the new 5-year permit term. The county’s current Storm Water
Quality Management Program Plan is an acceptable SWMP alternative. The County shall
submit the Draft SWMP to DEQ for review and comment within one hundred twenty (120)
calendar days from the date of receipt of this notice.
(3) Mecklenburg County shall submit an NPDES MS4 permit renewal application within one
hundred twenty (120) calendar days from the date of receipt of this notice. A new 5-year
NPDES MS4 permit will be noticed for public comment along with the submitted Draft SWMP.
(4) Mecklenburg County shall submit to any public comments on the Draft SWMP and submit a
Final SWMP for DEQ approval and concurrent final permit issuance. The final DEQ-approved
SWMP shall become an enforceable component of the new NPDES MS4 permit.
(5) Town of Pineville shall notify DEQ in writing immediately if it intends to withdraw from co-
permittee status and obtain its own individual NPDES MS4 permit, in which case items 2-4
above would become applicable to the Town of Cornelius instead of Mecklenburg County.
