Christopher: We had Michael Brame go back on site and he determined the end of the stream in question and average
width of the stream at the road crossing. His map is attached. Please note that the boundary of the property in this
exhibit is from GIS and ours is from an actual survey. We revised our plans and extended the stream buffer. I have
attached the revised sheet of the PCN to change the average stream width to 5'. This results in an impact that is less
than 0.02 acres. We revised the exhibits related to the rip rap and have provided a blow up of the area across from lot
50. Please review this information and feel free to call me if you have any questions.

Good Afternoon, Chuck:
Thank you for your PCN and attached information, dated 3/4/2021, and for the Agent Authorization form you shared
today for the above referenced project. I have reviewed the information and need clarification before proceeding with
verifying the use of Nationwide Permit 29 (https://saw-reg.usace.army.mil/NWP2021/NWP29.pdf). Please submit the
requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny
verification of the use of the Nationwide Permit or consider your application withdrawn and close the file:
1) The property boundary utilized by the wetland consultant appears to differ from that shown on the surveyed
plans. Stream SC is reported to be 83 linear feet and extends to the property line used in that effort. A review of
LiDAR data suggests the feature may be longer and potentially impacted behind lots 74 and 75. Please confirm
the stream offsite does/would not be impacted by the project as proposed.

2) Pursuant to Nationwide Permit (NWP) 29 regional condition 7, stream loss in excess of 0.02 acre require
mitigation to offset the loss of Waters of the US. The PCN reports 145 linear feet of 10-foot wide stream channel
would be impacted by the proposed road crossing. You must provide proof of mitigation credit availability, In -
lieu fee program acceptance, or if neither are available submit a Permittee Responsible Mitigation Plan for our
review before use of this permit can be verified.
3) Please provide a profile illustration to demonstrate riprap placement below the proposed stream crossing would
be compliant with NWP 29 regional condition 8 (Riprap placement). The exhibit would be attached to your
permit verification for reference by construction contractors.
4) Additional detail is required for construction proposed for the road adjacent to Stream SA (across from lot 50 on
the exhibits provided). Two wetlands and the stream appear to be located within the project disturbance area.
Due to the proximity of these resources to proposed construction, line weights are too large to complete our
review. Would permanent impacts be required? Would temporary impacts be required? What measures are
proposed to protect areas beyond the disturbance? Please provide an exhibit detailing activities in this area.
