Hyde County Dear Mr.Carawan: The Division of Water Quality(the Division)hereby issues the attached NPDES permit for the subject facility.This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. The Division understands that you have not discharged since 2005,but that you intend'to rebuild your facility destroyed by hurricane. Please be advised that you must contact the Washington Regional Office (WaRO)prior to startup so that the Division may inspect your new facility prior to any discharge. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing,upon written request submitted within thirty(30) days after receiving this letter.Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the office of Administrative Hearings, 6714 Mail Service Center,Raleigh,North Carolina 27699-6714.Unless such a demand is made,this permit shall be final and binding. Dry Cleanup Procedures Permit NC0000744 A. (3) Total Suspended Solids and Oil & Grease Reporting Requirement Outfalls 001 and 002 shall both be independently sampled and monitored annually for oil &grease and Total Suspended Solids (TSS). The value reported on the discharge monitoring report for Outfall 001 shall be the sum of mass loading from both Outfalls 001 and 002. 1. i.e. Value reported on Discharge Monitoring Report for Outfall 001. 2. ,Oil &Grease = pounds/day for Outfall 001 + pounds/days for Outfall 002 3. TSS = pounds/day for Outfall 001.+ pounds/day for Outfall 002 A. (4) Best Management Practices (BMPs) BMPs must be employed to ensure that excessive pollutants are not discharged to the surface water of the state. These practices should include as a minimum the following: 1. No discharge of fish or crab parts, floating solids, foam visible in other than trace amount, 2. The permittee shall direct employees and provide resources to follow, at a minimum, the following practices such that wastewater volume and wastewater constituents are reduced: a. All hoses used to provide on-demand water shall be equipped with automatic shut-off nozzles. b. Personnel shall be instructed to eliminate flows through idle equipment. c. All process and washdown equipment shall be fitted with high pressure/low volume nozzles. d. Dry cleanup shall be preformed prior to washdown of the facility A. (5) Dry Cleanup Requirements, Dry Cleanup shall emphasize the following techniques where practical; Batter drippings shall be collected in pans under the breading tables. a. Spilled batters shall be squeegeed off the floor prior to wet cleanup. b. Leftover batter shall be collected in a container and disposed of properly. Discharge to surface waters of batter residuals shall not be allowed. c. Trays shall be placed under machines and conveyor belts to catch particles of breading or other food products. d. Employees shall be instructed to remove, by hand or other method, leftover breading from sifters and other machines prior to these solids entering the drainage system. e. Flooring shall be brushed with a stiff broom prior to wet cleanup. A. (6) Temperature Condition The temperature of the effluent shall not cause the temperature of the receiving stream to increase by more than 0.8 °C above the natural water temperature during the months of June,July, and August nor more than 2.2°C during any other month and in no case to exceed a maximum of 32°C. A (7) Biocide Condition There shall be no chromium, zinc or copper added to the treatment system except as pre-approved additives to biocidai compounds. The Permittee shall obtain approval from the Division of Water Quality's Aquatic Toxicology Unit (ATU) prior to the addition of any biocidal compound to the water discharged from outfall(s) 001. Approval for use of new compounds (not previously approved) must be submitted to the ATU at least 90 days in advance of any planned use of those compounds. Charlie's Inc. for the existing limits we have on our previous permit. The application is filled out to the best of my knowledge because all of our records were destroyed during hurricane Isabel. We have still yet to open our plant back up in Engelhard but we would still like to renew the permit in case we decide to reopen in the future.
