Dear Ms. Ritchie:
FMC Lithium contacted the Division on April 24, 1997, and informed us that errors were
made on the recently issued subject NPDES permit.
Enclosed please find the modified effluent limitations/monitoring.requirements pages for
outfall 001. These pages should be inserted into your permit, replacing the old effluent pages, which
should be discarded. This permit modification is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U. S. Environmental Protection Agency dated December 6, 1983,
The following items are in response to FMC's April 24, 1997 letter. Please refer to the
appropriately numbered item in your comment letter.
1) The NC0005177 permit now covers discharges from outfall 004. Therefore, the stormwater
permit NCS000002 which previously covered stormwater discharges has been rescinded. By
copy of this letter I am notifying other units of this action.
2) FMC confirms the Division's understanding that flow from the R & D pond will only be
directed to outfall 004 when necessary to avert overflowing the pond.
3) The Aquatic Survey and Toxicology Unit confirms that for consistency with other permits
throughout the state, all WET tests shall be conducted at the dilution factor which
corresponds to the greatest possible flow from the facility. Due to the uniqueness of FMC's
permit, the Division inadvertently allowed dilution factors that varied with flow into the
permit. The Division intends to correct this problem with the next renewal of this permit.
4) As stated in the Division's issuance letter of March 31, 1997, the monitoring frequencies for
copper and zinc should have been reduced to quarterly and for chromium should have been
reduced to annually. This has been reflected in the new effluent sheets for outfall 001.
5) Effluent monitoring for chlorides was added to the permit to determine the level of chlorides

being discharged from outfall 001 where these constituents are of primary concern. Based
on the results of monitoring for this parameter it can be determined whether a reasonable
potential to impact water exists. Since there are no additional flows after outfall 001 and
prior to the downstream sampling point, sampling for chlorides at the downstream point can
be eliminated. This has been reflected in the new effluent sheets for outfall 001.
6) The Division notes that a Biocide Worksheet for Biosperse 250 will be completed and
submitted.
