This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental Protection Agency dated May 9, 1994(or as subsequently amended). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the night to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The town is requesting an expansion of the facility to 0.25 MGD. They have experienced III problems since the late 90's. The town completed a rehabilitation project on a portion of their sewer system on 2001. This project helped reduce some of the Ill but did not eliminate the flow exceedances. During periods of heavy rain the town continues to exceed the flow limit. The town is currently under a sewer moratorium. They continue pursuing funding to rehabilitate the collection system. The expansion request is to accommodate population growth, industrial flow, future residential connections from unsewered areas and future commercial development on the 1-401SR 903 interchange. A flow of 0.250 MGD was justified to provide wastewater capacity for a 20 year planning period. The town will construct a new treatment system and a discharge force main to Stewarts Creek. They currently discharge to Millers Creek. Millers Creek is a zero flow stream, therefore no expansions are allowed on this creek. The facility will also have a non-discharge component with 10.9 acres for drip irrigation of up to 42,300 gpd. A Preliminary Engineering Report and Engineering Alternatives Analysis was approved by the Construction Grants and Loans Section on November 2004. Facility Description: The existing facility consists of bar screen, grit removal, equalization basin, extended aeration tank, dual clarifiers and chlorine disinfection. The proposed facility will include an influent pump station, dual train aeration basins, dual clarifiers, aerated sludge digestion UV disinfection, 33,000 linear feet effluent force main to Stewarts Creek, effluent pump station to storage pond, irrigation pump station and a drip irrigation system on 10.9 acres to land apply up to 42,300 gpd. The existing equalization basin will be used with the new treatment system. Stewarts Creek was previously included in the 303(d) list, but at this time the Division is recommending its removal from the 303(d) list. Our Unit's flow calculation showed about 180K+ initially. Then AE furnished us with their new info: a 400+-acre strip mall complex was to be an imminent development in the I-40 intersection. That's why the flow number was bumped up. McIntire was surely aware of that. In fact, Dave Goodrich attended a meeting with Bobby, Dan and AE at CG&L on 12-7-04' in which the final deal (the 250k flow and Stewarts Creek discharge) was hammered. You had two questions? First, would the proposed 250K gpd discharge to Stewart's Creek be allowed. Second, would the project require an EA? I think the 1998 sepculative limits letter is still valid. I will say that the Town or their consultant needs to contact Curtis weaver at USGS to obtain critical stream flow statistics (both 7Q10 and 30Q2 flows) . If both are zero, we can't permit a discharge. If the 7Q10 is zero but the 30Q2 is positive, we can proceed with 5 and 2 . We'll probably proceed with 5 and 2 even if both flows are positive because of the difficulty modeling swamp systems. We are hereby supplying limits that would currently be assigned to the Magnolia WWTP if the discharge were relocated to one of three sites (#2,#3, and#4)indicated on the attached map, which you submitted with the request. Because the Magnolia WWTP currently discharges to a zero flow stream at site#I,expansion is prohibited at this location per NCAC T15A: 02B .0206. Limited flow information exists for the remaining proposed discharge locations,all of which are classified as swamp waters. In some cases, low flow characteristics can be determined with significant statistical probability to have zero values when drainage areas fall below a certain threshold. Sites#2 and#4 are located in hydrologic area 1 (HA1)as defined in USGS Survey Water-Supply Paper 2403.(Low Flow Characteristics of Streants in North Carolina, 1993). According to drainage area thresholds empirically determined for that area,the summer 7Q10 flows at each of these sites is most likely zero, with a positive 30Q2 flow. Based on a significantly larger drainage area threshold for this area, as well as USGS gauging station flow data in the vicinity of this site, this portion_ of Stewarts Creek is probably not a zero flow stream. Normally the Division uses a Level B Model to determine appropriate limits for a discharge; however, this model does not accurately predict impacts on swamp waters. Because of the uncertainty associated with such a slow-moving, swampy system, the limits listed above for sites#2 and #4 would apply to site#3 at a flow of 0.250 MGD, in order to maintain BOD mass loading as close to the current value as possible. The level of residual chlorine in the effluent necessary to ensure against acute toxicity is given above. The process of chlorination in combination with dechlorination or an alternate form of disinfection, such as ultraviolet radiation (UV disinfection), should allow the facility to comply with the TRC limit. North Carolina General Statutes require implementation of the practicable waste treatment and disposal alternative with the least adverse impact on the environment. Non-discharge alternatives are considered to be environmentally preferable to discharge. In order to receive final permit limits,a formal application indicating the proposed WWTP design capacity'and justification for the facility's relocation of direct discharge will have to be submitted to the NPDES Unit. The application must include an Engineering Alternatives Analysis (EAA)detailing investigation of alternatives to surface water discharge(please refer to the enclosed EAA Guidance Document). It has come to the Division's attention that the Town of Magnolia is requesting funding from the Clean Water Management Trust Fund (CWMTF) for construction of a new wastewater land application system. The Division is also aware of the possibility of connection to the Town of Rose Hill. In addition to any other possible alternatives,these items must be addressed thoroughly as part of the submitted alternatives analysis,should the Town of Magnolia choose to pursue an NPDES permit for direct discharge. Please be advised that the response to a speculative request does=guarantee that the Division will issue an NPDES permit to discharge treated wastewater. It should be noted that a new facility involving the expenditure of public funds or use of public(state)lands and having a design capacity of 0.5 MGD or greater (or proposing an expansion of 0.5 MGD or greater),or exceeding one-third of the 7Q10 of the receiving stream(as in this case)will require the preparation of an environmental assessment(EA)by the applicant. DWQ will not accept a permit application for a project requiring an EA until the document has been approved by the Department of Environment and Natural Resources,and a Finding of No Significant Impact(FONSI) has been sent to the State Clearinghouse for review and comment. The EA should contain a clear justification for the proposed facility and an analysis of potential alternatives, which should include a thorough evaluation of non-discharge alternatives(this satisfies the EAA requirement). In addition,an EA should show how water reuse,conservation,and inflow/infiltration reductions have been considered. If the EA demonstrates that the project may result in a significant adverse effect on the quality of the environment, an Environmental Impact Statement(EIS)would be required. General 1. Please note that approval of the PER does not constitute approval of sole source procurement. Plans and specifications must comply with N.C. General Statute Chapter 133, Section 3, prior to their approval. 2. The owner and consulting engineer should be advised that after approval of the PER, there are several constriction project permits, approvals, certifications, etc. that must be obtained before the project plans and specifications can be approved, and before the project is advertised for bids. Therefore, it is strongly recommended that preliminary work to obtain the following items, if applicable, begin as soon as possible: a) Sedimentation and Erosion Control Permit from the Division of Land Quality, or a letter from them stating that no permit is required for this project; b) 401 Water Quality Certification and Army Corps of Engineers 404 Permit for all stream crossings, or a letter from the Army Corps of Engineers and from the Wetlands 401 Certification Unit stating that none is required for this project; c) A reasonable subsurface investigation must be made available to the contractor. if it is not included in the specifications, the specifications must advise where a copy of the report can be observed. Typically, Construction Grants and Loans expects a boring about every 500 feet and at each road crossing for line work, and at all major structures like pump stations, aeration basins, and clarifiers; d) NCDOT Encroachment Agreements and Railroad Encroachment Agreements. Copies of these agreements must be provided in the specifications, or it must be documented how all construction requirements, associated with the agreements, have been incorporated in the plans-, d) Section 10 Permit for aerial crossings of navigable waters, or a letter from the Corps stating that none is required for this project; f) All construction easements, permanent easements, and rights-of-way. These easements and rights-of-way must be shown on the plans. Page 1 of 4 1 r 3. Does the town of Magnolia intend to make connection to the sewer system mandatory? In order to maximize the public health and environmental benefits of the project, it is strongly recommended that connection to the sewer system be mandatory. II. 2.0 Proiect.Planning Area 1. Page 5: Please use the North Carolina Office of State Planning (OSPL) Duplin County incremental population growth rates for projecting the town of Magnolia's design-year population. Using this method, the OSPL Duplin County population growth rates were calculated as follows: OSPL Duplin County 2000-2010 2010-2020 2020-2030 Population growth rate: 14.3% 1 1.8% 9.9% Year 2000 2005 2010 2020 2025 2030 Magnolia population: 932 1,065 1,191 1,309 Population Interpolated: 999 1,250 2. Page 5: Provide narrative in the PER to discuss how the 4,373 gpd industrial reserve was determined. Future industrial flows that are justifiable based on a Letter of Intent are allowed. Also, an industrial reserve that is 10% of current flow, excluding 1/1, is allowable. 3. Pages 5-6: Flow projected from the currently un-sewered area is 17,280 gpd from 48 houses. Provide some narrative in the PER to discuss how the 17,280 gpd was calculated. 4. Provide information concerning the sludge treatment and disposal for the proposed new WWTP that addresses how sludge management will comply with the 40 CFR 503 Regulations, including the following: a) ' Sludge production calculations at the design flow and a discussion of the methods that will be used to comply with pathogen and vector attraction reduction. b) Discuss the adequacy of the ultimate sludge disposal sites) at the design flow for the 20-year planning period. c) Confirmation of an agreement(s) with owner(s) of permitted sludge sites, or a modifiable permit held by a contract hauler. 5. Confirm that the proposed project design will comply with NCAC 2H.0219 - Minimum Design Requirements, and NCAC 2H.0124 - Reliability Requirements. (A copy of .0219 & .0124 is attached for reference). Page 2 of 4 [II. 3.0 Alternatives Analysis 1. Page 10 and Appendix H, Figure G-4: The report indicates that the aeration basins will be followed by either dual clarifiers (conventional operation) or dual equalization basins (sequential operation). Please provide additional information concerning the need for and the effectiveness of using equalization basins to provide to the function normally provided by clarifiers. 2. Pages 7-13: The Wilmington Regional Office (WiRO) has commented on the PER and their comments are attached for reference. Based on the WiRO observations and the CG&L review, it appears that the alternative chosen, which is the construction of a 0.250 MGD tertiary package plant with 146,750 gpd drip irrigation and 90,000 gpd surface discharge to the existing zero-flow stream, may not be the most environmentally beneficial option, and it may not be the most cost-effective alternative. Speculative limits were requested and were provided for three alternate discharge sites in DWQ's April 20, 1998 letter. One of the three discharge sites is at_Stewart's Creek, and DWQ noted that Stewart's Creek is probably not a zero-flow stream at the discharge location where speculative limits were provided. Please contact the NPDES Unit of the Water Quality Section Division and confirm whether or not an NPDES Permit can be issued for a discharge to Stewart's Creek at NCSR 1104. If an NPDES Permit can be issued, the PER should include a present worth analysis of an alternative that consists of a 0.250 MGD WWTP with a surface discharge of 0.250 MGD at Stewart's Creek and a 147,000 gpd drip irrigation disposal. The additional cost of a pump station and force main to send the effluent to Stewart's Creek should be offset somewhat or completely by the elimination of the need for the 60-day reclaimed water storage pond. 3. Page 11, Appendix H: Please confirm whether or not items 67, 68, and 69 include the costs of both the 12-day upset pond and the 60-day storage pond (i.e. approximately 10,584,000 gallons). If so, the estimated $0.03 cost-per-gallon of storage seems low. 4. Page 11: The PER indicates the desire to bid the Re-Cip system as an alternate. At this time, the Re-Cip system is not shown to be the most cost-effective alternative, and therefore world not be eligible for grant/loan participation. Only if it can be shown that the Re-Cip system can consistently meet reclaimed water standards (see comment 5 below), it may be bid as an alternate. However, if that is the case and both systems are proposed for bidding, then a detailed set of plans and specifications for both the " selected alternative and for the Re-Cip must be prepared and submitted to CG&L for review, and they must be approved prior to the bidding process. 5. BioConcepts, Inc. provided information concerning the Re-Cip system performance to Constriction Grants & Loans in July 2003. This information does not support a determination that the Re-Cip system can consistently meet the reuse effluent quality requirements of NCAC 2H.0219, (k). The reuse effluent quality standards are as follows: Page 3 of 4 Reuse standards require the treatment process to produce a tertiary quality effluent in accordance with the following limitations: • Monthly average TSS < 5 mg/I with a daily maximum 5 10 mg/I + Monthly Mean Iwecal-Coliform.S-14/100 m1 with a daily-maximum <_ 25/100 ml • Monthly Average B01)5 S 10 mg/I with a daily maximum 5 15 mg/I * Monthly Average NH3 <4 mg/l with a daily maximum <_ G mg/I • Instantaneous Daily Maximum Turbidity_< 10 NTU's Before the Re-Cip system can be determined adequate to consistently meet the reuse effluent quality requirements, additional supporting information must be submitted that will support this determination. If available, conclusive evidence based on a year of sampling data, which preferably includes 2 samples per week or daily samples from one or more Re-Cip systems that are currently treating domestic waste in a climate similar to the town of Magnolia should be submitted. At a minimum, the most recent Re-Cip related performance data should be incorporated into a revised PER. 6. Page 12: In order to determine which alternative is the most cost-effective in the 20- year period of time, please include detailed present worth analyses for all alternatives discussed in the PER. The present worth analysis should include the following items: a) Capital costs including the costs associated with patent fees. b) Contingency. c) Costs for engineering. d) Start-up services, if applicable. e) Operation & Maintenance manual. f) Land and easements, etc. Itemize these costs and include them in the present worth analysis. g) Annual operation and maintenance costs and present worth of those costs. h) Present worth of replacement costs. i) Present worth of salvage value. 7. Pages 1 1-12: Show what EPA discount rate was used in the PER to calculate the "present value", and how the total present worth factor is derived. 8. In determining the present worth of an alternative's salvage value, a useful life of 15 years for equipment, 40 years for collector sewers, 20 years for pump stations and.force mains, 50 years for structures, and 20 years for all other facilities should be used for the salvage value present worth calculations. 9. The present worth of operation and maintenance costs should be calculated based on a constant annual cost without any annual cost increases. IV. 6.0 Environmental Impacts of the Pro used Pro'eet 1. E-SRG-T-02-0130 Duplin County The writer has reviewed the subject report , prepared by Hobbs Upchurch & Assoc . , for the Town of Magnolia . A records review was conducted, but a site review was not performed. Division records indicate that the Town needs the ability to treat more than the current 90 , 000 gpd permitted discharge volume . Division monitoring reports covering nine months of operation over the period of February 2003 to January 2004 (10/03 , 11/03 & 12/03 missing) were evaluated. The DMR data showed that. 2/03 was the lowest flow month with average monthly, maximum monthly, and minimum monthly influent flows of . 077 MGD, . 123 MGD, and . 043 MGD, respectively. The maximum flow month was 8/03 with . 114 MGD average, . 161 MGD maximum and . 050 MGD minimum. Influent flow records for 2/03 and 8/03 and rainfall data from the National Weather Service-Wilmington are enclosed for your convenience. Magnolia is located approximately 50 miles north of Wilmington. The collection system is experiencing substantial inflow and infiltration. In the lowest flow month, 48 hours were needed after the 2/16/03 inclement weather event for flows to return to normal . There were no obvious flow/rainfall trends occurring in 8/03 . Scattered thunderstorms normally prevail in the summer, and it is likely that Wilmington rainfall volumes may not have similarity to rainfall at Magnolia during the summer. Additional actions to correct inflow/infiltration are recommended. Town of Magnolia June 14 , 2004 Page Two The option chosen, construction of a . 250 MGD tertiary treatment plant with 146, 750 MGD spray irrigation reuse and 90, 000 GPD NPDES discharge to the existing zero-flow stream, may not be the most environmentally friendly option. It also may not be the most cost effective option for increasing the design flow of the Town of Magnolia wastewater treatment plant . The consultant has not evaluated extending the effluent line (approx. 5 miles west) to Stewarts Creek. The Town of Warsaw is permitted to discharge 1 . 0 MGD into Stewart' s Creek at an (upstream) point that has less stream flow volume, by comparison. The consultants requested NPDES permitting speculative limits for the Town of Magnolia in 1998 . The Division' s reply is enclosed for your convenience . Discharge point ##3 is located where NCSR 1104 passes over Stewarts Creek and likely has a positive 7Q10 flow. A recent aerial photograph of Stewarts Creek at NCSR 1104 is enclosed. It is understood that irrigation reuse is mandated for achieving qualification for a 3 000 000 high-unit cost rant . The proposed q $ g g P P dual train activated sludge extended aeration tertiary filtration plant would provide better quality effluent , but there is an alternative discharge point that should be considered. Although, the Town does maintain the 90, 000 gpd NPDES permit, the outfall is located at a source of a zero flow stream (the driest part of the zero flow stream) . The Clean Water Management grant should be initiated to increase the Town' s permitted wastewater flow while removing the current discharge . The writer would recommend that the Stewarts Creek discharge option coupled with a nondischarge proposal be explored primarily to remove the existing NPDES discharge while qualifying for the construction grant . The first step toward exploring the alternate discharge- point would be for the consultant to verify with USGS that Stewart ' s Creek at NCSR 1104 does not exhibit a zero 7Q10 flow. The writer does not have experience with the proposed recip treatment option. It has been determined to exceed the cost of the activated sludge plant and the recip treatment system would capture more rainfall input .
