Dear Mr. Smith:
In accordance with the application for a discharge permit received on January 18, 1996, the Division is
forwarding herewith the subject NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated December 6,1983.
This facility discharges into a zero-flow stream. Removal of this discharge is strongly recommended if a
more environmentally sound alternative is available at an economically reasonable cost. An engineering report
evaluating alternatives to discharge must be submitted to the Division on or before January 1,2001. The report
should include cost estimates for construction of a treatment plant that will meet the effluent limits specified in
Part III, Section F. of this permit. Upon review of the engineering report, the Division retains the right to
reopen and modify this NPDES permit to require removal of the discharge or to revise the permit limitations
within a specified time schedule.
If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and
binding.
Please take notice this permit is not transferable. Part 11, E.4. addresses the requirements to be followed
in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

is hereby authorized to discharge wastewater from a facility located at
Magnolia Wastewater Treatment Plant
west of Magnolia
Duplin County
to receiving waters designated as an unnamed tributary to Millers Creek in the Cape Fear River Basin
in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I,
1I, 1I1, and IV hereof.
The permit shall become effective August 1, 1996.
This permit and the authorization to discharge shall expire at midnight on July 31, 2001.

Town of Magnolia
Wastewater Treatment Plant
is hereby authorized to:
1. Continue to operate an existing 0.09 MGD wastewater treatment facility consisting of an
influent pump station, bar screen, grit chamber, aerobic digester, extended aeration tank, dual
clarifiers, tertiary filters, sludge filters, sludge drying beds, chlorine contact chamber and post
aeration located at Magnolia Wastewater Treatment Plant, the end of McGovern Street, west
of Magnolia, Duplin County (See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached map into an
unnamed tributary to Millers Creek which is classified a Class C-Swamp waters in the Cape
Fear River Basin.

All stream samples shall be grab samples and shall be conducted weekly.
** The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15% of the respective influent value (85 %
removal).
*** The daily average dissolved oxygen effluent concentration shall not be less than 6.0 mg/l.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored weekly at the effluent by grab sample.
There shall be no discharge-of floating solids or visible foam in other than trace amounts.

F. Zero Flow Condition
The facility discharges into a stream with 7 0130Q2=0 cfs. Removal of discharge is
recommended if a more environmentally sou alternative is available at an economically
reasonable cost. An engineering report evalua ng alternatives to discharge is due on or before
January 1, 2001. As part of the report, the c, t of constructing a treatment plant that will meet
limits of S mg/l BOD, 2 mg/1 NH3, 6 mgA (rein.) DO, and 17 µg/l chlorine should be included, if
there are no feasible alternatives to surface�lischarge. Upon review of the engineering report, the
Division retains the right to reopen and odify this NPDES permit to require removal of the
discharge or to revise the permit limitatio within a specified time schedule.

Monitoring frequencies have been modified from 2/Month to Weekly based on 2B.0500 for CLass
II facility. The monthly NH3-N limit has been changed to 2 mg/1 (summer) and 4 mg/l (win)
based on DEM policy for minimum NH3-N values. The facility has had 2 flow violations in
the past 2 years. TRC values are elevated. Instream monitoring data indicate a wide
variability in D.O. values with depressed DO's both up and downstream(possibly due to
swamp like conditions).
The facility was required to perform an EAA during this past permit cycle,but no analysis has
been performed. Regional office should comment on possible alternatives to discharge and if
the EAA requirement is necessary with the next permit cycle.

tank, and sludge drying beds .

signs of significant wear, and the Town will soon begin
to replace airlines and some of the weirs and separating
walls within the main treatment unit .

PART IV - EVALUATION AND RECONDENDATIONS
The Town of Magnolia WWTP has an excellent compliance record in
terms of submitted self monitoring results. The plant is beginning
to show significant signs of corrosion, and the Town has hired an
engineer to perform a study to determine immediate needs of which
the first action taken will likely be replacing air lines
throughout the plant.
Flow records have shown signs of significant sources of I&I, and
the Town appears to be aggessive in its search for problem areas .
It is recommended that a draft permit be prepared and placed
at public notice. If no significant adverse public comment is
received, it is recommended NPDES Permit No. NC0020346 be
reissued to the Town of Magnolia in accordance with the basin-wide
permitting strategy.
