A review of that permit by the Division's Aquatic Toxicology Unit has indicated that an error was made regarding the language associated with whole effluent toxicity testing. As such, a correction is being made to the aforementioned permit. Please find enclosed amended permit pages. These pages should be inserted into your permit and the old ones discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. These permit clarifications are issued pursuant to the requirements of North Carolina General Statutes 143.215.1 and the Memorandum of Agreement between North Carolina and the U. S. CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration 50%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple-concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase 11 Chronic Whole Effluent Toxicity Test Procedure" (Revised- February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase 11 Chronic Whole Effluent Toxicity Test Procedure" (Revised-February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge lklonitoring Form (N[R-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements .and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. It was originally permitted in 1980 at a flow of 1.0 MGD discharging into Haw Branch. The outfall was relocated to North Deep Creek in 1992. A permit application for expansion to 2.5 MGD was processed in 1997. A wasteioad allocation completed by Andy McDaniel in January of 1997 for expansion to 2.5 MGD recommended effluent limitations more stringent than secondary in order to protect the State's 5.0 mg/L dissolved oxygen (DO) standard. An authorization to construct (020338ACD) for that expansion was issued on June 19, 1997. The engineer's certification for that project was subsequently received July 16, 1998, In 1994, Yadkinville requested speculative limitations to go from 1.0 MGD to 1.15 MGD. In 1995, the Town requested speculative limitations for flows of 1.2. 4.0, and 5.0 MGD. The 1997 wasteioad allocation for the 2.5 MGD flow utilized the level B modeling framework established in 1995 for the three speculative limit requests. Reasonable potential analyses were conducted for fluoride, cadmium, chromium, lead, nickel, cyanide, selenium, mercury, and arsenic (see attached). The existing monitoring frequency for silver, zinc, and copper remains unchanged_ Although the state has not adopted standards for these parameters, should standards ever be developed, effluent limitations will likely be necessary as all parameters had maximum predicted concentrations in excess of allowable concentrations as determined by mass balance calculations. PROPOSED CHANGES: • alonitoring Frequencies: The monitoring frequency for BOD,. TSS, DO, NH3-N, pH, TRC, fecal coliform, oil and grease, and conductivity has been modified to daily to reflect the most current 2B .0500 regulations. • &fluent Pages: All effluent limitations pages for flows less than 2.5 MGD have been eliminated as the engineers certification has been received for the ATC issued in 1997 for the expansion to 2.5 N1GD. • Stream Classification: The stream classification has been modified from class C to class 1VS-IV (effective .August 1, 1998). • Summer/6Ninter.. Summer and winter limitations for BODS and Nf 13-1N have been included on the same effluent page. • Instream 1I16nitoring: Due to Yadkinville's participation in the Yadkin-Pee Dee River Basin Association, instream monitoring requirements have been provisionally waived and stated as such on the effluent limitations page. TOXICITY TESTING: Type of Toxicity Test: Chronic P/F Existing Limit: 001-. Chronic P/F @ 50% Recommended Limit: 001: Chronic P/F @ 50% Monitoring Schedule: January, April, July, and October This facility has passed all chronic toxicity tests during the previous four years with the exception of on failure in 1994. COMPLIANCE SUMMARY: This facility had a single monthly average permit violation for TSS in 1998 and several pH violations in 1997. A review of the facility's data shows a decrease in effluent BOD, TSS, ammonia and fecal with the startup of the new system in mid-1998. Compliance with new limits at 2.5 MGD should not be a concern with the new facility online. INSTREAM MONITORING: Instream monitoring is required for temperature, dissolved oxygen, fecal coliform, and conductivity. All instream monitoring requirements have been provisionally waived due to the facility's participation in the Association. The digester is aerated periodically on a 24 hour basis. Once the sludge has thickened to At least 2 %solids and held for at a minimum of 40 days, it is transferred to a 0.231 MGD digester to be decanted and aerated to further increase the solids content. By this letter, the DENR is waiving the instream monitoring requirements as specified within your individual NPDES permit beginning June 1, 1998. As specified in the Memorandum of Agreement (MOA) signed by this agency and you (or your representative), the agreement identifies the stations, parametric coverage and frequency of analysis required in order that the instream monitoring requirements be waived for your facility.
