This letter is in reference to your permit major modification request received April 1, 2021.
During the pre -review process, it was noted that the following items were missing from the
submitted application package:
1. The application submitted is not on the appropriate form. Please use Form WWIS 06-16. A copy is
enclosed for your convenience. [15A NCAC 02T .0105]
2. The requested modification is considered a major modification under G.S. 143-215.31)(d) and requires
payment of an application fee of $245. Payment of the application fee must be submitted with the
application package.
3. The Cover Letter must include a list of all items included in the application package, as well as a
statement and brief description of the requested permitting action. [15A NCAC 02T .0105]
4. The Applicant's Certification must be signed by a principal executive officer of at least the level of
vice-president or his authorized representative. Per 15A NCAC 02T .0106(c), an alternate person may
be designated as the signing official if a delegation letter is provided from a person who meets the
criteria in 15A NCAC 02T .0106(b).
5. Legal documentation demonstrating property ownership of all property to be used for wastewater
irrigation, including new irrigation fields must be provided. [15A NCAC 02T .0116(c)]
6. A soil evaluation of new irrigation sites is required per 15A NCAC 02T .0504(b). Please provide a
detailed soil evaluation including all soil boring logs, measured Ksat values, and recommendations
which has been signed, sealed, and dated by a North Carolina Licensed Soil Scientist. This evaluation
should meet the specifications of 15A NCAC 02T .0504(b) and the Soil Scientist Evaluation Policy.

7. Identification of the intended crop to be irrigated (i.e. Bermuda hay) with the appropriate Realistic
Yield Expectation (R.Y.E), based on the predominant soil type as determined by the Soil Scientist.

8. An agronomist evaluation is required for new irrigation sites. This evaluation must include an
agronomic management plan and recommendations concerning cover crops' ability to accept the
proposed application rates of liquid, solids, minerals, and other constituents of the wastewater. [15A
NCAC 02T .0504(i)]
9. A water balance based that has been signed, sealed and dated by a qualified professional that determines
the required effluent storage based on the most limiting factor. [15A NCAC 02T .0504(k)]
10. Per 15A NCAC 02T .0504(c), engineering plans, prepared, signed and sealed by a licensed engineer,
must be included. The engineering plans must include treatment, storage, application, and disposal
facilities and equipment except those previously permitted, unless those previously permitted are
directly tied into the new units or are necessary to understanding the complete process. At a minimum,
the plan should include:
a. Plans depicting the irrigation area with an overlay of the suitable irrigation areas depicted in the
Soil Evaluation;
b. Each nozzle/emitter and their wetted area influence, and each irrigation zone labeled as it will be
operated;
c. the flow routing, including the new irrigation pattern;
d. A statement for each field identifying which lagoon the wastewater has been sourced from. If all
irrigated wastewater is to be from one lagoon, please state such. Please note, if both lagoons are to
source irrigated wastewater for any field(s), then analysis for each lagoon will be necessary for
calculating PAN loading.
11. Per 15A NCAC 02T .0504(d), site map that has been signed, sealed, and dated by a North Carolina
licensed Professional Engineer or Professional Land Surveyor, and includes at a minimum:
a. A scaled map of the site with topographic contour intervals not exceeding 10 feet or 25 percent of
total site relief and showing all facility -related structures and fences within the wastewater
treatment, storage and irrigation areas.
b. Soil mapping units shown on all irrigation sites.
c. The location of all wells (including usage and construction details if available), streams (ephemeral,
intermittent, and perennial), springs, lakes, ponds, and other surface drainage features within 500
feet of all wastewater treatment, storage and irrigation sites.
d. Delineation of the compliance and review boundaries per 15A NCAC 02L .0107 and .0108, and
15A NCAC 02T .0506(c) if applicable.
e. Setbacks as required by 15A NCAC 02T .0506.
£ Site property boundaries within 500 feet of all wastewater treatment, storage and irrigation sites.
g. All habitable residences or places of public assembly within 500 feet of all treatment, storage and
irrigation sites.

12. An Operation and Maintenance Plan (O&M) plan encompassing all wastewater treatment, storage and
irrigation system. Per 15A NCAC 02T .0507, the O&M plan must include a description o£
a. Operation of the wastewater treatment, storage and irrigation systems in sufficient detail to show
what operations are necessary for the system to function and by whom the functions are to be
conducted.
b. Anticipated maintenance of the wastewater treatment, storage and irrigation systems.
c. Safety measures, including restriction of access to the site and equipment.
d. Spill prevention provisions such as response to upsets and bypasses, including how to control,
contain and remediate.
e. Contact information for plant personnel, emergency responders and regulatory agencies.
Accordingly, your permit major modification request is being returned as incomplete per the
requirements in 15A NCAC 02T .0107(b).
The success of the Water Quality Permitting Section's Non -Discharge Branch process depends
upon the receipt of complete and accurate applications and supporting documentation. Please amend the
application package to include the previously noted omitted items and resubmit with the appropriate permit
processing fee.
Please be advised that construction and/or operation of the subject facilities without a valid
permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions in
accordance with G.S. 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be
assessed for failure to secure a valid permit.
