This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. The following items included in the DRAFT permit have been retained in this FINAL permit: • Deletion of instream monitoring for fecal coliform and conductivity, based on updated NPDES policy for domestic dischargers. • Change effluent temperature monitoring from Weekly to Daily, while instream stations remain at Weekly. • Change TRC monitoring frequency from Daily to 2/Week. • Change monitoring frequency from 2/Month to Weekly for BOD, TSS, NH3, and fecal coliforia, per 213.0500 Surface Water Monitoring Requirements for a Class II facility. • Change flow monitoring requirement from weekly instantaneous to continuous recorder, based on NPDES policy for flows greater than 10,000 gpd. However, in this FINAL permit, the permittee is provided 1-year to complete the installation of the continuous recorder. • Addition of quarterly nutrient monitoring for total nitrogen and total phosphorus, based on the need to collect nutrient data from all domestic dischargers in order to develop a nutrient management strategy for High Rock Lake. • Change the permit expiration date from 5/31/99 to 5/31/2004. Review of your facility's effluent toxicity data indicates that there were 3 toxicity test failures reported between January 1998 and February 1999. If toxicity testing continues to be a problem, the permittee may wish to re-evaluate potential connection to a municipal sewer system. Although the permittee's 1994 POTW feasibility analysis concluded that connection to a municipal sewer system was not economically feasible, the Regional Office has indicated that sewer connection is now closer to the subject site. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 276 1 1-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Permit No. NCO061204 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT(ORTRLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the`North Carolina Ceriodaplmia Chronic Effluent Bioassay Procedure,"Revised November 1995,or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is _ 90.0%(defined as treatment two in the procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of February, May,August,and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form(MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DWQ Form AT-I (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Water Quality 4401 Reedy Creek Road Raleigh, North Carolina 27607 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests,as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name,permit number, pipe number,county,and the month/year of the report with the notation of"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should the permittee fail to monitor during a month in which toxicity monitoring is required,then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document,such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Comments for Scarlett Acres[NC0061204. 1) The feasibility analysis was submitted to WSRO on 5/20/94 (do you want a copy?). At that time our office agreed that connection to municipal sewer was not economically feasible. However, I know sewer is now closer. In fact, a nursing home within a mile of Scarlett Acres MHP installed a PSFM in 1996 to connect to municipal sewer. I have no problem with putting another condition in the new permit requiring them to revisit the connection possibilities within one year of issuance. / 2) In regards to continuous flow measurement, I would recommend �/ 91 J� 1 -"�• giving them one more year of instantaneous measurements in order to C/ allow time for installation of a continuous recording device. 3) Please note that the W WTP discharges below a 2 to 3 acre farm pond. The upstream samples are collected from the creek above the pond and the downstream samples are collected 3/4 mile below the outfall at Day Road. No correlation between the two sample points is possible due to distance between the up and down points, the affect of the pond and cattle. During dry weather flow in the stream is minimal at the outfall. On several occassions sludge deposits have been observed in the stream during low flows. The MHP serves 82 residences. • Facility discharges to an unnamed trib to Mi11 Creek>Muddy Creek>Yadkin RivenHigh Rock Lake. The discharge is to a zero-7Q10,but positive-3OQ2 stream. Mill Creek is not listed in 1998 303(d) list. Per 1998 Basin Plan,Muddy Creek is support threatened due to urban runoff and point source discharges,though improvements are apparent in both effluent toxicity and stream biota High Rock Lake has experienced algal blooms due to excessive nutrient loading,hence domestic dischargers located upstream are being required to monitor for nutrients in order to develop a nutrient management strategy. Permit Issues Per Special Condition E,Pertnittee was required to submit an EAA by June 1994 to the Division, with emphasis placed on POTW connection. WSRO-do you have this In tile? e Permittee currently has chronic tox test requirement(probably in lieu of NH3 toxicity limit) in addition to a summer NH3 limit of 12 mg/l(based on oxygen consumption?-not clear)- No changes planned to these limits. Results of recent tox tests indicate potential toxicity problem,with 317 failures. New WET enforcement policy with quarterly compliance is scheduled to take effect July 1999,with$1000 penalties. In light of this,plus additional monitoring frequencies for several parameters,and the need to add additional flow monitoring equipment(see below),permittee may want to reconsider POTW connection if possible. • Pcrmittec currently measures instantaneous flow by time clock on equalization pumps. Based on NPDES policy,they will need to measure continuous flow with a recorder. WSRO-do you anticipate any problems with this? • Recommend deletion of instream monitoring for fecal and conductivity. D.O.measurements indicate low DO at times,although measurements may be faulty. • Monitoring frequency for several parameters was increased to reflect current rags for a Class II facility_ DMR Data. • Data for last 14 months(1/98-2/99)was evaluated. Permit violations were noted for: Fecal Daily Max(3 events);Flow(1 event);tox test(3 failures out of 7)- • Monthly averages were:Flow(generally.010-.015 MGD);BOD(4-11 mg(1);NH3 (<I -9 mg(I); TSS(2-17 mg/l);FC(<I - 132/100 ml),tox test(3/7 failures). TRC max concentrations exceed 1000 ug/l for 9/14 months. • Data tends to indicate increase in downstream conductivity and Fecal on several occasions. No patterns observed between upstrear /downstream sampling for DO. Minimum downstream D.O.was C5 mg/l for 6/14'months;data looks questionable since low DO s were reported during winter also. Recommend removal of instteam monitoring for fecal and conductivity. Region Data. • W SRO(Mike Mickey)conducted a Compliance Sampling Inspection on March 24, 1999 and reported no major concerns,with good O&M. CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in: 1. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 90% (defined as treatment two in the North Carolina procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The first test will be performed after thirty days from the effective date of this permit during the months of February, May, August and November. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.
