Since the proposed discharge is into waters classified as drinking water supply, this Division req ires the approval of the Division of Health Services before we can issue a permit. This is in accordance with North Carolina General Statute 143-215.1(a). In response to your application, the Division of Health Services has informed this Division that they cannot concur with the issuance of this permit modification. Therefore, please be advised that we are required to deny your requested ap lication for a NPDES Permit modification to increase the permitted discharge f m 0.04 to 0.08 mgd. If thin decision is unacceptable to you, you have the right to an adjudicator) hearing upon written request within thirty (30) days following receipt of .his letter. This request must be in the form of a written petition, conforming .o Chapter 150B of the North Carolina General Statues, and filed with the Office .f Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 2 604.
