He provided me with a survey and said the encroachment of the front porch area was pre- existing (exempting this from the buffers). He also said portions of the foundation in the buffer were planters, and as such were non - impervious and allowed in the buffer (however, this is not exactly accurate). I then informed the City of Raleigh and Mr Parker that 1) the stream buffer as staked in the field is not very accurate since the buffer is staked as a straight line but the stream (and stream buffer) curves, and therefore portions of the foundation which appear to be constructed in the buffer are actually outside the buffer 2) according to Mr Parker, the front step portion of the foundation was pre- existing in the buffer and therefore exempt. It is my understanding that based on this info, someone went out to the house and more accurately staked out the stream buffer. I was then contacted by the City and informed that the front portion of this house may be new construction and was not pre- existing in the stream buffer. I went out today for a second look, and there is very little evidence to confirm any pre- existing impacts to the stream buffer (if they were there, they have been removed and replaced with what looks like new construction). In addition, the stakes delineating the buffer were present and there are clearly new impacts to the stream buffer, most notably the foundation planters. I would like to note that impacts such as this are allowable, however the NC DWQ needs to document impacts to the 50 ft stream buffer and provide authorization for these impacts. I honestly feel if we had been contacted prior to construction, we could have either provided guidance in reference to the buffers and possibly issued an authorization, if needed. For instance, the planters are not exempt — they are foundation /retaining walls with fill, and as such will need to be authorized. Technically this site is violation of the NC Neuse River Riparian buffer rules. However, the resolution to this violation is to obtain a buffer authorization. I would prefer to not cite this property as being in violation and would prefer to move forward with a buffer authorization which will — hopefully — satisfy all parties and move this project forward. I have included a link to our webpage which contains the application for buffer authorization: http: / /Portal.ncdenr.org/ web /wq /swp /ws/ 401 /riparianbuffers /authorizations variances Unfortunately, the link under 'Buffer Authorization Application' is currently down. I have also attached a word document of this form with this email. I have included Shelton Sullivan and Karen Higgins on this email. I am out of the office all next week and will be returning on Monday Nov 26`h. Shelton and /or Karen may be able to help you in the meantime, and I will do anything I can to provide assistance I apologize for any confusion regarding the stream buffer issues. I know you are working diligently with the City to resolve the problems and get back to work on your project, and I hope we can assist with this by providing the necessary authorization in as timely a manner as possible.
