Director Division of Water Quality May 31, 2007 DWQ Project # 2006-1949 Franklin County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Joe Procopio Imperial Homes 3200 Wellington Court Raleigh, NC 27615 Subject Property: Holden Farm Subdivision (Formerly Brookefield Subdivision, Lot 45- Youngsville, NC UT to Brandy Creek [28-29-3-(1), B, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Procopio: On December 14, 2006, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit received your Major Variance dated December 18, 2006 which was approved by the Water Quality Committee on January 10, 2007 regarding your request for a Major Variance from the Tar-Pamlico Buffer Rules (15A NCAC 2B .0259) for the subject property. On May 4, 2007 DWQ received your rain garden and buffer restoration plan dated May 3, 2007. Additional information. will be required before we can proceed with issuing your variance request. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0259 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: 1. Please provide a planting plan for the bioretention cell that accurately locates and represents the plan material on the drawling. Representation of the plant material should be to scale and depicted at the mature width or spread. 2. Please specify an appropriate P-index (10-20) for the bioretention fill media in your soil specification. 3. Please consider replacing the perennial plants you have specified for the bioretention cells with plants that do not require wetland conditions. A list of plants that the DWQ considers to be appropriate for bioretention areas can be found in Chapter 12 the new draft Stormwater BMP Manual (available on the DWQ Stormwater Unit web page). Please bear in mind that the Operation and Maintenance Agreement requires replacement of plants that do not survive in the bioretention cell. Please respond in writing within three weeks of the date of this letter by sending a copy of this information to me and to Mike Horan of the DWQ Raleigh Regional Office.
