Dear Dr Thorpe
The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project Review of your application revealed it lacking necessary information required for making
an informed permit decision The permit application was deficient in the following areas
• The application indicates that a work pad is being proposed to aid in the construction of this structure Based on
soil information for this the site the soils are very susceptible to compaction Based on conversations with your
staff it has been determined that a raised work trestle can be used in lieu of a work pad Please provide updated
drawings and impact summary for this project to include a work trestle in lieu of the proposed work pad
The permit drawings and plan sheets for Sites 1 and 2 show excavation of wetlands under the existing bridges
water ward of the proposed end bents to an elevation equivalent to the Water Surface (WS) elevation provided
in the application Therefore as proposed the excavation would alter the existing stream dimensions at both of
these sites These stream impacts were not accounted for in the application and furthermore are prohibited by
401 Water Quality Certification general conditions DWQ request that the proposed excavation elevations be
raised to an elevation that would avoid all stream impacts and avoid or minimize wetland impacts
• It is our understanding that the utility plans for this project are being modified Please provide an updated
utility plan and impact summary
Therefore pursuant to 15A NCAC 2H 0507(a)(5) we will have to place the permit application on hold until we are
supplied the necessary information You have 21 days to respond in writing with the requested information or
notification to this office that the information is forthcoming If at the end of the 21 days this office has not
received this information in writing we will assume you are withdrawing your application and it will be returned
Furthermore until the information is received by the NC Division of Water Quality we request (by copy of this
letter) that the US Army Corps of Engineers place the permit application on hold
