Reviewed DMR against BIMS and can confirm this is an accurate violation. ORC Timothy Lynn Church stated in `Report
Comments': "A seasonal commercial discharger caused the wwtp to exceed the weekly BOD average for the first week of the
month. The monthly average was within limits. The Town continues to work with the user to mitigate this issue. The performance
of the wwtp has returned to normal during the month of January, 2021".
The monthly average was within permissible limits (Actual monthly avg: 23.2 mg/I / monthly avg limit: 30 mg/L). However, prior
12-month enforcement history shows BOD concentrations to be a repeated violation (see next page). Pattern reveals violations
seem to occur at the end of year (months of November and December) which correlates to Mr. Church's statement "a seasonal
commercial discharger".
This violation exceeds compliance limit by 20%, therefore I recommend proceeding with NOV.
