Daniel Smith, Director Dear Mr.Smith: In response to the three (3) Notices of Violation described above, Lissara Partners, LLC is "Submitting a Request for Remission or Mitigation" under Option 2 set out in the Notices.We are not contesting whether the violations occurred or the accuracy of the factual statements. The appropriate Waiver and Justification forms that we were provided are also included.A document entitled "Request for Remission of Civil Penalties,Waiver of Right to an Administrative Hearing, and Stipulation of Facts" was not attached to any of our three Notices. I am assuming that the contents of that document are covered in the two (2)other forms. If I am mistaken, please send me that form. Our statement outlining the facts and arguments supporting our request for remission or mitigation is attached. We hope our efforts to bring our plant into compliance with be met with understanding of the vagaries of the sewerage treatment process and an appreciation for our on-site work to solve this elusive problem.
