In order to receive final permit limits, a formal application will have to be submitted to the Division's Permit and Engineering Unit. Flow estimates for North Deep Creek at the discharge site have been updated since your request for 1.15 MGD speculative limits in 1994. The updated flow estimates are based on data collected at a USGS low flow partial record (LFPR) station located just upstream of the discharge. The previous flow calculations did not incorporate the LFPR station data. The following updated estimates should be considered a better representation of the flow at the Yadkinville discharge site: Drainage area (mi2) = 35.9 Average flow (cfs) = 35.9 Summer 7Q10 (cfs) = 3.9 Winter 7Q10 (cfs) = 10.0 30Q2 (cfs) = 12.3 The tentative limits for conventional constituents are: Summer Winter Waste flow (MGD) 3.0 3.0 BOD5 (mg/L) 30.0 30.0 NH3-N (mg/L) 2.0 5.2 D. U.) 6-9 6-9 Under current Division of Environmental Management (DEM) procedure, chlorine limits are now recommended for all new or expanding dischargers proposing the use of chlorine for disinfection. An acceptable level of chlorine in your effluent is 28 ug/L to ensure protection against acute toxicity. The instream waste concentration at 3.0 MGD is 54%, and 58% at 3.5 MGD. A chronic toxicity testing requirement will remain a condition of the NPDES permit. A complete evaluation of limits and monitoring requirements for metals and other toxicants will be addressed with the formal NPDES application. Note that effective September 1, 1994 the classification for North Deep Creek from SR 1605 to Deep Creek has been changed from "C" to "WS-IV". This change in classification may have an effect on metals and other toxicant limits. For example, the instream standard for nickel is 88 ug/L in "C" waters and 25 ug/L in water supply waters. DEM is planning a basinwide water quality management initiative. Our schedule for implementation in the Yadkin River basin is set for 1999. The plan will attempt to address all sources of point and nonpoint pollutants where deemed necessary to protect or restore water quality standards. In addressing interaction of sources, wasteload allocations may be affected. Those facilities that already have committed to high levels of treatment technology are least likely to be affected. Please be advised that response to this request does not guarantee that the Division will issue an NPDES permit to discharge treated wastewater into these receiving waters. It should be noted that new and expanding facilities, involving an expenditure of public funds or use of public (state) lands, will be required to prepare an environmental assessment (EA) when waste flows: 1) exceed or equal 0.5 MGD, or 2) exceed one-third of the 7Q10 flow of the receiving stream. DEM will not accept a permit application for a project requiring an EA until the document has been approved by the Department of Environment, Health and Natural Resources and a Finding of No Significant Impact (FONSI) has been sent to the state Clearinghouse for review and comment. The EA should contain a clear justification for the proposed facility and an analysis of potential alternatives which should include a thorough evaluation of non -discharge alternatives. Non -discharge alternatives or alternatives to expansion, such as spray irrigation, water conservation, inflow and infiltration reduction or connection to a regional treatment and disposal system, are considered to be environmentally preferable to a surface water discharge. In accordance with the North Carolina General Statutes, the practicable waste treatment and disposal alternative with the least adverse impact on the environment is required to be implemented. If the EA demonstrates that the project may result in a significant adverse affect on the quality of the environment, an Environmental Impact Statement would be required.
