VAN DER VAART Secretary TRACY DAVIS Director Subject: Notice of Inspection — Not Compliant SW8 970415: Lowe's Home Improvement Jacksonville (Western Blvd), Onslow County SW8 980429: Lowe's Home Improvement Morehead City, Carteret County SW8 071207: Lowe's Home Improvement .Jacksonville (Yopp Rd), Onslow County Dear Mr. Staley: On May 24, 2016, the Wilmington Regional Office of the Division of Energy, .Miineral and Land Resources (DEMLR.) inspected the above stated Lowe's Homo Improvement facilities to determine the status of compliance with the State St.ormwater Management Permit Number SW8 970415, SW8 980429, and SW8 071207. DEMLR file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Please find copies of the three completed forms entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection reports, the following deficiencies must be resolved: I . General repairs and maintenance to the ponds should be conducted on a semiannual basis and records kept of maintenance including repair of the spillways, slopes, pond depth, and pipe systems. 2. Pond dimensions and depth should be evaluated. Findings of the evaluation will determine maintenance of sediment removal or repair of the ponds. Please be reminded that it is your responsibility as the permittee of record to submit a completed and signed Name/Ownership Change Form to the Division of Energy, Mineral and Land Resources 30-60 calendar days prior to making any of the below listed changes. An ownership change including the sale or conveyance of the permitted project area in whole or in part. This does not include the conveyance of subdivided residential lots to individuals which are made subject to a recorded declaration of covenants and restrictions which contain the statements required by the stormwater permit; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Foreclosure proceedings; d. Filing for Bankruptcy; e. Dissolution of the partnership or corporate entity. Per NCGS 57D-6-07, a dissolved LLC shall wind up, which may include continuing the business of the LLC for a period of time. The person charged with winding up the LLC shall collect the LLC's assets [which include the stormwater management permit], and distribute the assets as provided in NCGS 57D-6-08(2). The pool area leading to the structure has been filled with sediment- There is a significant pile of dirt where the division of the main pool and the north forebay that intrudes on the dimensions and depth of both areas. The second outlet pipe to__theoond from the roof drains is above grade by 1-2'. Shelf has deteriorated. Depth of pond needs to be evaluated. The bottom of the main pool is elevation 36� the outlet pipe should be at 43. General maintenance of the pond should be conducted according to permit conditions and operation and maintenance agreement. Monthly, or after every runoff producing rainfall event, whichever comes first: A. Inspect the trash rack; remove accumulated debris, repair/replace if it is not functioning. B. Inspect and clear the orifice of any obstructions. If a pump is used as the drawdown mechanism, pump operation will be checked. Repairs/cleaning will be done as necessary. II. Quarterly (Four times a year): A. Inspect the collection system (ie. catch basins, piping, grassed - swales) for proper functioning, Accumulated trash will be cleared from basin grates, basin bottoms, and piping will be checked for obstructions and cleared as required. B. Pond inlet pipes will be checked for undercutting. Riprap or other energy dissipation structures will be replaced, and broken pipes will be repaired. M. Semi-annually (twice a year): A. Accumulated sediment from the bottom of the outlet structure will be removed. B. The forebay depth will be checked at various points. Sediment removal is required when the depth is reduced to 75 % of the original forebay design depth of 10 7 ` C. Grassed swales, including the vegetated filter if applicable, will be reseeded twice a year as necessary. r V POND MAINTENANCE REQUIREMENTS PAGE 2 IV. - Annually (Once a year): A. The pond depth will be checked at various points. Sediment removal is required when the depth is reduced to .75 % of the original design depth or Y, whichever is greater. Design depth is :5. .measured vertically from the orifice down to the pond's bottom. Sediment must be removed to at least the original design depth. V. General: A. Mowing of the side slopes will be accomplished according to the season. Maximum grass height will be 6" . - B. Cattails are encouraged along the pond perimeter, however they will be removed when they cover more than 1/2 the surface area of the pond. The best time to cut them is at the end of the growing season, m November. Environmentally sensitive chemicals for use in killing cattails can also be used. Contact your nearest Agricultural Extension Agent. C_ The orifice/pump is designed to draw down the pond in 2--5 days. If drawdown is not accomplished in that time, the orifice will be replaced with a Iarger or smaller orifice. Slow drawdown may be attributed to a clogged system. The source of the clogging will be found and eliminated. D. All components of the detention pond system will be kept in good working order. Repair or replacement components will meet the original design specifications as per the approved stonmwater plan. If previously approved components are determined to be ineffective, the component must be redesigned and/or replaced. VI. In your letter you have asked for a response -and plan of action. The following is our response. Item # l : We will contact our tenant, Lowe's Companies, and inform them of your findings. By lease, they are obligated to maintain the property which includes the storm water system. We will ask them to make the requested repairs as quickly as possible and coordinate with your office to ensure your satisfaction. Item # 2 1 have discussed this issue with our engineer, Dale Isom, and he remembers submitting the required certification to your office. Due to this project now being 10 years old his file for this project has been done away with. He does have a very specific memory of dealing wiih Ms Linda Lewis in your office on this project and feels sure that if you will check with her that she can confirm that the required information was provided at the time the project was completed. We request you that talk with Ms Lewis to determine if your office does indeed have the missing documents. Item # 3 I have discussed this issue with our engineer he he is certain that all change sto the plans were submitted as required. Again we ask that you talk with Ms. Lewis to determine if you office has misplaced these documents. if the trash racks are not currently on the pond then they have most likely been removed due to vandalism. We will as our tenant and the original contractor to install the trash racks per the plans. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 970415, issued to you on September 3, 1997. The project has been found in violation of Stormwater Permit Number SW8 970415, issued pursuant to the requirements of 15A NCAC 21-1.1000. The violations found are: Failure to perform the required operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. Based on an inspection performed on June 15, 2007 it appears that the operation and maintenance agreement is not being followed in its entirety. The inspection revealed issues such as sediment in the fore bay and storage pond, lack of mowing, erosion on the pond slopes and excessive vegetation on the aquatic shelf. 2. Failure to submit a certification from an appropriate designer for the system installed. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed in accordance with this permit, the approved plans and specifications and other supporting documentation.
