Description of existing facilities: The facility consists of a swine buying station and trailer wash. The facility
purchases swine from local independent farmers not growing swine for Murphy Brown or Prestage. The
facility purchases swine from surrounding counties and once there are enough animals to fill a transfer
trailer, the animals are sent to slaughter facilities in NC, SC, and Va. The facility has two facultative
lagoons and two solid set irrigation fields/zones (F1 & F2).
Proposed flow: 6,851 gallons/day (0.00685 MGD) or (2,500,615 gallons/year)

Explain anything observed during the site visit that needs to be addressed"by the permit, or that may be important
for the permit writer to know (i.e., equipment condition, function, maintenance, a change in facility ownership,
etc.) See comments starting on page 6. This is a major permit modification and not a slight
modification/addendum.
3. Are the site conditions (e.g., soils, topography, depth to water table, etc) maintained appropriately and adequately
assimilating the waste? N Yes or N No
If no, please explain: There is no information in the permit modification document that addresses soils or
groundwater. The consultant is assuming that all soils at the site and the soils for the proposed new fields is
versions of the Sampson County Soil Survey that is/was typically used by the local NRCS office to write
waste plans for swine farms which this facilitv initially started life as. The Division "nrandfathered" the
current fields into the non -discharge permit when the Division made a distinction between swine facilities
associated with a specific farm verses commercial facilities that manage swine from many farms. Soils
associated with the 2.80 ac field (consultants' infO are probably Autryville or close to it based on my hand
auger boring. The soils in the 14.70-acre field are not Autryville. Based on the two hand auger borings in
this field, the Blanton description in the Web Soil Survey for the upper 1/3 of the field is probably accurate
and the Lynn Haven soils for the other 2/3s is probably accurate:

If no, please explain: The facultative lagoon system has been in operation for approximately 30 years. No
solids have been removed to date and solids from the buying station are minimized by housekeeping
practices by placing swept solids into solid waste containers for composting or disposal. Some manure is
washed into the two lagoons but is minimal. The solids from the trailer wash are removed with a solids
separator and stored in a concrete bunker to dewater then placed in a roll off container for composting.
Historical documents in the. file indicate that solids removed from the trailer wash and storage pens were to
be transported to McGill Environmental for composting (W00006816).
6. Are the existing application rates (e.g., hydraulic, nutrient) still acceptable? ® Yes or ❑ No
If no, please explain: Based on historic flow values (see chart); the most recent 10 month average is
about 5300 gallons/day. The facility has two water supply wells that provide water to the buying
station/holding area and to the trailer wash. A flow meter into the facility meters water usage that is.
reported as wastewater. The facility has isolated water being used for sinks, toilets, shower, etc. that
goes to an onsite septic system. One issue of concern, based on observations made on 9 April and
discussion with Hayden Parks, is that Smithfield Hog Production is using 50% of the floor space at the
Parks facility to hold Smithfield Hog Production animals from Smithfield farms. This is probably
causing an uptick in wastewater generation from historical past operations and may be why the facility
is trying to permit two new fields. It was brought to the attention of Hayden Parks that the new fields_
would have to be permitted under the current 2T Non -Discharge rules and that the PAN rate and
hydraulic loading rate would need,to be addressed.

groundwater monitoring. wells at the site. The historical nutrient loading has been well below the 275 lbs. of
PAN for Bermuda and 50 lbs. of PAN for small grain overseed (3251bs. total). Past annual application
rates for the Bermuda hay have been around .1001bs:/acre. Based on the current RYE for Autryville soil in
the NC State Nutrient Management website being 270 lbs. of PAN (verses the 275 lbs. in the current
permit)- and applying additional PAN to the winter small grain of rye or oats of about 301bs/acre; the
facility has been using about 50% of the PAN allowed.

the 400' setback from the home across the road and is depicted on the revised site irrigation map. The -
proposed new fields have setbacks that are not -consistent with the 2T rules for buffers.to property lines and
right-of-ways.

V. ADDITIONAL REGIONAL -STAFF REVIEW ITEMS
The application dated 19 March 2021 is requesting a "slight modification" consisting of adding two new irrigation
fields to the current permit The two fields currently in use were permitted in 1999 and were permitted under accepted
NRCS standards for swine farm permitting/nutrient management when the facility was first constructed between
March 1993 and March 1998 In historical documents in the file; the two existing spray -fields were evaluated by
Vince Lewis (soil scientist with Soil & Water Conservationin the Wilmington Regional office — retired 2014) on 17
September 1997 and he concurred with the identification of Autryville soil in current fields 1 & 2. When the first
Non -Discharge permit was issued on 11 January 1999 the information for the ex' istin fg acili was grandfathered.
Deficiencies with the current permit application are as follows:
1) Neither field in the current application have been evaluated by a soil scientist for predominant soil type and
seasonal high groundwater table determination.
2) The soils type requested for both fields is AutMille The small 2.80 acre field probably has Autryville as the
predominant soil but the larger 14.70 acre field is not predominantly AutMille Based on site borings and review of
the -Web Soil Survey; the upper 1/3 of the field is consistent with Blanton sand the lower 2/3s appear consistent with .
Lynn Haven sands.
3 The provided map dated 17 March 2021 in the application that illustrates the proposed new spray irrigation fields
does not have the correct 2T buffers relative to property lines and rights -of -way. The buffer to the property lines is
shown as 50' when the correct buffer is 150'. The buffer to the public right-of-way along Hayes Chapel road is shown_
as 25'. The correct buffer along Hayes Chapel road would be 50' for approx.. 2/3s of the field and 150' for the upper
1/3. The property across Haves Chapel road is owned by LL Parks and Nash Johnson Farms respectively and the
appropriate buffers need to be applied accordingly.
4). With the appropriate buffers and after evaluation by a soil scientist; the larger field of 14.70 acres will probably be
reduced to about 7 or 8 acres.
5.) The 2.80 acre field will be reduced to approx.. 1.6 to 1.70 acres due to the need to buffer the surface water
diversion channel 25'. This surface water diversion channel leads to a drop inlet near the storage building adjacent to
it. Hayden Parks was not aware of where this drop inlet discharges stormwater.

By way of this letter, I would like to ask that the Division review the information found in
the enclosed addendum and include it in the permit as a slight modification. The
Division allows modifications through addendums for animal facilities; however, I realize
this facility was a CAFO originally and then granted this permit after the fact which can
be a tough transition but we have lived with this scenario since 1999. These
modifications will provide more flexibility for managing the facility and incorporate the
NRCS standards that better correspond to this facility. If you have any further questions

The waste from your animal facility must be land applied at a specified
rate to prevent pollution of surface and/or groundwater. The plant
nutrients in the animal waste should be used to reduce the amount of
commercial fertilizer required for the crops in the fields where waste
is to be applied. This waste utilization plan uses nitrogen as the
limiting nutrient. Waste should be analyzed before each application
cycle. Annual soil tests are strongly encouraged so that all plant
nutrients can be balanced for realistic yields of the crop to be grown.
Several factors are important in implementing your waste utilization
plan in order to maximize the fertilizer value of the waste and to
ensure that it is applied in an environmentally safe manner. Always
apply waste based on the needs of the crop to be grown and the nutrient
content of the waste. Do not apply more nitrogen than the crop can
utilize. Soil types are important as they have different infiltration
rates, leaching potentials, cation exchange capacities, and available
water holding capacities. Normally waste shall not be applied to land
eroding at greater than 5 tons per acre per year. With special pre-
cautions, waste may be applied to land eroding at up to 10 tons per
acre per year. Do not apply waste on saturated soils, when it is
raining, or when the surface is frozen. Either of these conditions
may result in runoff to surface waters which is not allowed under DWQ
regulations. Wind conditions should also be considered to avoid drift
and downwind odor problems. To maximize the value of the nutrients
for crop production and to reduce the potential for pollution, the
waste should be applied to a growing crop or applied to bare ground
not more than 30 days prior to planting. Injecting the waste or
disking will conserve nutrients and reduce odor problems.
This plan is based on waste application through irrigation for this
is the manner in which you have chosen to apply your waste. If you
choose to inject the waste in the future, you need to revise this
plan. Nutrient levels for injecting waste and irrigating waste are
not the same.
The estimated acres needed to apply the animal waste is based on
typical nutrient content for this type of facility. Acreage require-
ments should be based on the waste analysis report from your waste
management facility. Attached you will find information on proper
sampling techniques, preparation, and transfer of waste samples to
the lab for analysis.
This waste utilization plan, if carried out, meets the requirements
for compliance with 15A NCAC 2H.0217 adopted by the Environmental
Management Commission.

Acres shown in each of the preceding tables are considered to be the
usable acres excluding required buffers, filter strips along ditches,
odd areas unable to be irrigated, and perimeter areas not receiving
full application rates due to equipment limitations. Actual total
acres in the fields listed may, and most likely will be, more than
the acres shown in the tables.
NOTE: The Waste Utilization Plan must contain provisions for periodic
land application of sludge at agronomic rates. The sludge will be
nutrient rich and will require precautionary measures to prevent
over application of nutrients or other elements. Your production
facility will produce approximately pounds of plant
available nitrogen (PAN) per year in the sludge that will need to be
removed on a periodic basis. This figure is PAN when broadcasting
the sludge equipment, may be needed when you remove this sludge.
See attached map showing the fields to be used for the utilization of
waste water.
APPLICATION OF WASTE BY IRRIGATION
The irrigation application rate should not exceed the intake rate of
the soil at the time of irrigation such that runoff or ponding occurs.
This rate is limited by initial soil moisture content, soil structure,
soil texture, water droplet size, and organic solids. The application
amount should not exceed the available water holding capacity of the
soil at the time of irrigation nor should the plant available nitrogen
applied exceed the nitrogen needs of the crop.
Your facility is designed for 180 days of temporary storage
and the temporary storage must be removed on the average of once every
6 months. In no instance should the volume of waste being stored in
your structure be within feet of the top of the dike.

If surface irrigation is the method of land application for this plan, it
it is the responsibility of the producer and irrigation desig signer to
ensure that an irrigation system is installed to properly irrigate the
acres shown in Tables 1 and 2. Failure to apply the recommended rates
and amounts of Nitrogen shown in the tables may make this plan invalid
Call your Agriment Services representative for assistance in determining
the amount of waste per acre and the proper application rate
prior to beginning the application of your waste.

1. Animal waste shall not reach surface waters of the state by runoff,
drift, manmade conveyances, direct application, or direct discharge
during operation or land application. Any discharge of waste which
reaches surface water is prohibited. Illegal discharges are subject
to assessment of civil penalties of $10,000 per day by the Division
of Water Quality for every day the discharge continues.
2. The Local NRCS office must have documentation in the design folder that
the producer either owns or has long term access to adequate land
to properly dispose of waste. If the producer does not own adequate
land to properly dispose of waste, he shall provide NRCS with a copy
of a written agreement with a landowner who is within a reasonable
proximity, allowing him/her the use of the land for waste application
for the fife expectancy of the production facility. It is the
responsibility of the owner of the facility to secure an updated Waste
Utilization Plan when there is a change in the operation, increase in
the number of animals, method of utilization, or available land.
3. Animal waste shall be applied to meet, but not exceed, the Nitrogen
needs for realistic crop yields based on soil type, available moisture,
historical data, climate conditions, and level of management, unless
there are regulations that restrict the rate of application for other
nutrients..
4. Animal waste may be applied to land that has a Resource Management
System (RMS) or an Alternative Conservation System (ACS). If an ACS
is used the soil loss shall be no greater than 10 tons per acre per
year and appropriate filter strips will be used where runoff leaves
the field. These filter strips will be in addition to "Buffers"
required by DEM. (See FOTG Standard 393-Filter Strips and Standard
390 Interim Riparian Forest Buffers).
5. Odors can be reduced by injecting the waste or disking after waste
application. Waste should not be applied when the wind is blowing.
6. When animal waste is to be applied on acres subject to flooding, it
will be soil incorporated on conventionally tilled cropland. When
applied to conservation tilled crops or grassland, the waste may be
broadcast provided the application does not occur during a season
prone to flooding. (See "Weather and Climate in North Carolina" in
the MRCS Technical Reference - Environment file for guidance.
7. Liquid waste shall be applied at rates not to exceed the soil infil-
tration rate such that runoff does not occur off -site or to surface
waters and in a method which does not cause drift from the site during
application. No ponding should occur in order to control conditions
conducive to odor or flies and to provide uniformity of application.
8. Animal waste shall not be applied to saturated soils, during rainfall
event, or when the surface is frozen.
9. Animal waste shall be applied on actively growing crops in such a
manner that the crop is not covered with waste to a depth that would
inhibit growth. The potential for salt damage from animal waste should
also be considered.

10. Waste nutrients shall not be applied in fall or winter for spring
planted crops on soils with a high potential for leaching. Waste
nutrient loading rates on these soils should be held to a minimum
and a suitable winter cover crop planted to take up released
nutrients. Waste shall not be applied more than 30 days prior to
planting of a crop on bare soil.
11. Animal waste shall not be applied closer than 25 feet to surface
water. This distance may be reduced for waters that are not perennial
provided adequate vegetative filter strips are present. (See standard
393 - Filter Strips)
12. Animal waste shall not be applied closer than 100 feet to wells.
13. Animal waste shall not be applied closer than 200 feet of dwellings
other than those owned by the landowner.
14. Waste shall be applied in a manner not to reach other property and
public right -of ways.
15. Animal waste shall not be discharged into surface waters, drainage ways,
or wetlands by discharge or by over -spraying. Animal waste may be
applied to prior converted wetlands provided they have been
approved as a land application site by a technical specialist".
Animal waste should not be applied on grassed waterways that discharge
into water courses, except when applied at agronomic rates and the
application causes no runoff or drift from the site.
16. Domestic and industrial waste from wash down facilities, showers,
toilets, sinks, etc., shall not be discharged into the animal waste
management system.
17. Lagoons and other uncovered waste containment structures must maintain
a maximum operating level to provide adequate storage for a 25-year,
24-hour storm event in addition to one (1) foot mandatory freeboard.
18. A protective cover of appropriate vegetation will be established on
all disturbed areas (lagoon embankments, berms, pipe runs, etc.).
If needed, special vegetation shall be provided for these areas and
and shall be fenced, as necessary to protect the vegetation.
Vegetation such as trees, shrubs, and other woody species, etc. are
limited to areas where considered appropriate. Lagoon areas should be
kept mowed and accessible. Lagoon berms and structures should be
inspected regularly for evidence of erosion, leakage or discharge.
19. If animal production at the facility is to be suspended or terminated,
the owner is responsible for obtaining and implementing a "closure
plan" which will eliminate the possibility of an illegal discharge,
pollution and erosion.
20. Waste handling structures, piping, pumps, reels, etc., should be
inspected on a regular basis to prevent breakdowns, leaks, and spills.
A regular maintenance checklist should be kept on site.

21. Animal waste can be used in a rotation that includes vegetables and
other crops for direct human consumption. However, if animal waste
is used on crops for direct human consumption it should only be applied
pre plant with no further applications of animal waste during the crop
season.
22. Highly visible markers shall be installed to mark the top and bottom
elevations of the temporary storage (pumping volume) of all waste
treatment lagoons. Pumping shall be managed to maintain the liquid
level between the markers. A marker will be required to mark the
maximum storage volume for waste storage ponds.
23. Waste shall be tested within sixty days of utilization and soil shall
be tested at least annually at crop sites where waste products are
applied. Nitrogen shall be the rate - determining element. Zinc
and copper levels in the soils shall be monitored and alternative crop
sites shalt be used when these metals approach excessive levels. pH
and waste analysis records shall be kept for five years. Poultry dry
waste application records shall be maintained for three years. Waste
application records for all other waste shall be maintained for fire
years.
24. Dead animals will be disposed of in a manner that meets North
Carolina State regulations or other States' regulations.

I (we) understand and will follow and implement the specifications
and the operation and maintenance procedures established in the
approved animal waste utilization plan for the farm named above.
I (we) know that an expansion to the existing design capacity of
the waste treatment and storage system or construction of new
facilities will require a new certification to be submitted to the
Division of Water Quality (DWQ) before the new animals
are stocked. I (we) also understand that there be no discharge
of animal waste from this system to surface waters of the state
from a storm event less severe than the 25 year, 24 hour storm.
The approved plan will be filed on -site at the farm office and at
the office of the local Soil and Water Conservation District and
will be available for review by DWQ upon request.
I (we) understand that I must own or have access to equipment,
primarily irrigation equipment, to land apply the animal waste
described in this waste utilization plan. This equipment must be
available at the appropriate pumping time such that no discharge
occurs from the lagoon in a 25-year 1-day storm event. I also
certify that the waste will be applied on the land according to
this plan at the appropriate times and at rate that no runoff
Occurs.

operation of the subject wastewater treatment and irrigation facilities,
This permit shall be effective from the date of issuance through September 30, 2023, shall void
Permit No. WQ0015030 issued August 29, 2013, and shall be subject to the conditions and limitations
therein. The Permittee shall submit a renewal application no later than April 3, 2023.
Please pay attention to the monitoring requirements listed Attachments A and B for they may differ
from the previous permit issuance. Failure to establish an adequate system for collecting and maintaining
the required operational information shall result in future compliance problems,

operation of a 6,851 gallon per day (GPD) wastewater treatment and irrigation facility consisting of the:
continued operation of: two anaerobic lagoons totaling 5,314,375 gallons; a 16.51 acre solid set irrigation
system with two fields; and all associated piping, valves, controls, and appurtenances; and the
temporary abandonment of: approximately 0.51 acres of Field F l ; approximately 1.62 acres of Field 172;
and all associated piping, valves, controls, and appurtenances
to serve the LL Parks Livestock — Delway Truck Wash, with no discharge of wastes to surface waters,
pursuant to the application received October 3, 2018, and in conformity with the Division -approved plans
and specifications considered a part of this permit.
This permit shall be effective from the date of issuance through September 30, 2023, shall void Permit No.
WQ0015030 issued August 29, 2013, and shall be subject to the following conditions and limitations:

of Fields F1. and .F'2. This notification shall include a statement from a signature authority of their intent
to reopen the temporarily abandoned portions of Fields F1 and F2, as well as property
ownership/setback waiver documentation that shows that the fields meet setbacks listed in 1I.1 O.a of
this permit. This notification shall be mailed to the Division of Water Resources, Non -Discharge

11. PERF ORIMANCE STANDARDS
I . The Permittee shall maintain and operate the subject non -discharge facilities so there is no discharge to
surface waters, nor any contravention of groundwater or surface water standards. In the event the
facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper
operation and maintenance, or failure of the irrigation areas to assimilate the effluent, the Permittee
shall take immediate corrective actions, including Division required actions, such as the construction
of additional or replacement wastewater treatment or disposal facilities. [15A NCAC 02T
.0108(b)(I)(A)]
2. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface
water resulting from the operation of this facility. [ 15A .NCAC 02T .0.108(b)(1)(.A)]
3. Effluent quality shall not exceed the limitations specified in Attachment .A. [15A NCAC 02T
.0108(b)(1)(A)]
4. Application rates, whether hydraulic, nutrient, or other pollutant, shall not exceed those specified in
Attachment B. [ 15A NCAC 02'1'.0108(b)(1)(A)]
5. Wastewater irrigation fields permitted on or after December 30, 1983 have a compliance boundary that
is either 250 feet from the wastewater irrigation area, or 50 feet within the property boundary,
whichever is closest to the wastewater area. Any exceedance of groundwater standards at or beyond
the compliance boundary shall require corrective action. Division -approved relocation of the
compliance boundary shall be noted in Attachment B. Multiple contiguous properties under common
ownership and permitted for use as a disposal system shall be treated as a single property with regard

6. The review boundary is midway between the compliance boundary and the wastewater irrigation area,
Any exceedance of groundwater standards at or beyond the review boundary shall require preventative
action. [ 15A NCAC 02L .0106(d)(1), 021...0108]
7. The Permittee shall apply for a permit modification to establish a new compliance boundary prior to
any sale or transfer of property affecting a compliance boundary (i.e., parcel subdivision). [15ANCAC
02L .0107(c)]
8. No wells, excluding Division -approved monitoring wells, shall be constructed within the compliance
boundary except as provided for in 15A NCAC 02L .0107(g). [ 15A NCAC 02L .0107]

9. Except as provided for in .l 5A NCAC 02L .0107(g), the Perinittee shall ensure any landowner who is
not the Permittee and owns land within the compliance boundary shall execute and file with the
Sampson County Register of Deeds an easement running with the land containing the following items:
a. A notice of the permit and- number or other description as allowed in 15A NCAC 02L .0107(f)(1);
b. Prohibits construction and operation of water supply wells within the compliance boundary; and
c. Reserves the right of the Permittee or the State to enter the property within the compliance boundary
for purposes related to the permit.
The Director may terminate the easement when its purpose has been fulfilled or is no longer needed.

III. OPERATION AND MAINTENANCE REQUIREMENTS
1. The Permittee shall operate and maintain the subject facilities as a non -discharge system. [15A NCAC
02T .0500]
2. The Permittee shall maintain an Operation and Maintenance Plan, which shall include operational
functions, maintenance schedules, safety measures, and a spill response plan. [15A NCAC 02T
.0507(a)]
3. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC)
classification of the subject non -discharge facilities, the Permittee shall designate and employ a certified
operator in responsible charge (ORC), and one or more certified operators as back-up ORCs. The ORC
or their back-up shall operate and visit the facilities as required by the WPCSOCC. [15A NCAC 02T
.0117]
4. The Permittee shall maintain vegetative cover on the irrigation sites, such that crop health is optimal,
allows even effluent distribution, and allows inspection of the irrigation system. [15A NCAC 02T
.0507(b)]
5. The Permittee shall take measures to prevent effluent ponding in or runoff from the irrigation sites
listed in Attachment B. [15A NCAC 02T ,0507(c)]
6. The Penmittee shall not irrigate treated effluent during inclement weather, or when the soil is in a
condition that will cause ponding or runoff. [15A NCAC 02T ,0505(x)]
7. Irrigation equipment shall be tested and calibrated once per permit cycle. [15A NCAC 02T .0507(d)]
8. Only treated effluent from the LL Parks Livestock — Delway Truck Wash shall be irrigated on the sites
listed in Attachment B. [15A NCAC 02T .0501]
9. The Pen-nittee shall not allow vehicles or heavy machinery on the irrigation area, except during
equipment installation or maintenance activities. [15A NCAC 02T .0507(e)]
10. The Permittee shall prohibit public access to the wastewater treatment, storage, and irrigation facilities.

11. The Permittee shall dispose or utilize generated residuals in a Division -approved manner. [15A NCAC
02T .0508, 02T .1100].
12. The Permittee shall not divert or bypass untreated or partially treated wastewater from the subject
facilities. [15A NCAC 02T .05050)]
13, Freeboard in the two anaerobic treatment lagoons shall not be less than two feet at any time. [15A
NCAC 02T .0505(d)]
14. Gauges to monitor waste levels in the two anaerobic treatment lagoons shall be provided. These gauges
shall have readily visible permanent markings, at inch or tenth of a foot increments, indicating the
following elevations: maximum liquid level at the top of the temporary liquid storage volume;
minimum liquid level at the bottom of the temporary liquid storage volume; and the lowest point on
top of the dam. [ 15A NCAC 02T .0507(f)]
15. A protective vegetative cover shall be established and maintained on all berms, pipe runs, erosion
control areas, surface water diversions, and earthen embankments (i.e., outside toe of embankment to
maximum allowable temporary storage elevation on the inside of the embankment). Trees, shrubs, and
other woody vegetation shall not be allowed to grow on the earthen dikes or embankments. Earthen
embankments shall be kept mowed or otherwise controlled and accessible. [15A NCAC 02T .0507(g)]
16. Metering equipment shall be tested and calibrated annually. [ 15A NCAC 02T .0507(d)]
17, Soil pH on all land application fields must be maintained in the optimum range for crop production.

18. The Waste Utilization Plan (WUP) is hereby incorporated by reference into this Permit. Any
modifications to the WUP shall require modification of this permit. [15A NCAC 02T .0108(b)(1)(A)]
19. Only those cleaning agents, soap and disinfectants that are EPA approved, will not harm the cover crop,
and will not contravene the groundwater standards listed in 15A NCAC 02L may be utilized in the
subject facility. Instruction labels are to be followed when using cleaning agents, soaps and
disinfectants. [15A NCAC 02T .0108(b)(1)(A)]
IV. MONITORING AND REPORTING REQUIREMENTS
1, The Permittee shall conduct and report any Division required monitoring necessary to evaluate this
facility's impact on groundwater and surface water. [15A NCAC 02T .0108(c)]
2. A Division -certified laboratory shall conduct all analyses for the required effluent, groundwater, and
surface water parameters. [ 15A NCAC 02H .08001
3, Flow through the treatment facility shall be continuously monitored, and daily flow values shall be
reported on Form NDMR. Facilities with a permitted flow less than 10,000 GPD may estimate their
flow from water usage records provided the water source is metered. [15A NCAC 02T .0105(k), 02T
.0108(c)]
4. The Permittee shall monitor the treated effluent at the frequencies and locations for the parameters
specified in Attachment A. [15A NCAC 02T ,0108(c)]

5. The Permittee shall maintain records tracking the amount of effluent irrigated. These records shall
include the following information for each irrigation site listed in Attachment B:
a. Date of irrigation;
b. Volume of effluent irrigated;
c. Site irrigated;
d. Length of time site is irrigated;
e. Continuous weekly, monthly, and year-to-date hydraulic (inches/acre) loadings;
f. Continuous monthly and year-to-date loadings for any non -hydraulic parameter specifically
limited in Attachment B;
g. Weather conditions; and
h. Maintenance of cover crops.

6. Freeboard (i.e., waste level to the lowest embankment elevation) in the two anaerobic treatment lagoons
shall be measured to the nearest inch or tenth of a foot, and recorded weekly. Weekly freeboard records
shall be maintained for five years, and shall be made available to the Division upon request. [15A
NCAC 02T .0108(c)]
Three copies of all monitoring data (as specified in Conditions IV.3. and IVA.) on Form NDMR for
each PPI and three copies of all operation and disposal records (as specified in Conditions fV.5. and
1V.6.) on Form NDAR-1 for every site in Attachment B shall be submitted on or before the last day of
the following month. If no activities occurred during the monitoring month, monitoring reports are still
required documenting the absence of the activity. All information shall be submitted to the following

8. The Permittee shall maintain a record of all residuals removed from this facility. This record shall be
maintained for five years, and shall be made available to the Division upon request. This record shall
include:
a. Name of the residuals hauler;
b. Non -Discharge permit number authorizing the residuals disposal, or a letter from a municipality
agreeing to accept the residuals;
c. Date the residuals were hauled; and
d. Volume of residuals removed.

9, A maintenance log shall be kept at this facility. This log shall be maintained for five years, and shall
be made available to the Division upon request. This log shall include:
a. Date of flow measurement device calibration;
b. Date of irrigation equipment calibration;
c. Visual observations of the plant and plant site; and
d. Record of preventative maintenance (e.g., changing of equipment, adjustments, testing, inspections
and cleanings, etc.).

10. An annual representative soils analysis (i.e., Standard Soil Fertility.Analysis) shall be conducted on
each irrigation site listed in Attachment B. These results shall be maintained at the facility for five
years, and shall be made available to the Division upon request. Each Standard Soil Fertility Analysis
shall include the following parameters;

The Permittee shall report to the Fayetteville Regional Office, telephone number (910) 433-3300,
within 24 hours of first knowledge of the following;
a. Treatment of wastes abnonnal in quantity or characteristic, including the known passage of a
hazardous substance.
b. Any process unit failure (e.g., mechanical, electrical, etc.) rendering the facility incapable of
adequate wastewater treatment.
c. Any facility failure resulting in a discharge to surface waters.
d. Any time self -monitoring indicates the .facility has gone out of compliance with its permit
limitations.
e. Ponding in or runoff from the irrigation sites.
Emergencies requiring reporting outside normal business hours shall call the Division's .Emergency
Response personnel at. telephone number (800) 662-7956, (800) 858-0368, or (91.9) 733-3300. All
noncompliance notifications shall file a written report to the Fayetteville Regional Office within five
days of first knowledge of the occurrence, and this report shall outline the actions proposed or taken to
ensure the problem does not recur. [ 15A NCAC 02T .0108(b)(1)(A)]
V. LNSPECTIONS
1. The Permittee shall perform inspections and maintenance to ensure proper operation of the wastewater
treatment and irrigation facilities. [ 15A NCAC 02T .0507(i)]
2. The Pennittee shall inspect the wastewater treatment and irrigation facilities to prevent malfunctions,
facility deterioration, and operator errors that may result in discharges of wastes to the environment,
threats to human health, or public nuisances. The Permittee shall maintain an inspection log that
includes the date and time of inspection, observations made, and maintenance, repairs, or corrective
actions taken. The Permittee shall maintain this inspection log for a period of five years from the date
of the inspection, and this log shall be made available to the Division upon request. [ 15A NCAC 02T
.0507(h), 027' .0507(i)]
3. Division authorized representatives may, upon presentation of credentials, enter and inspect any
Property, premises, or place related to the wastewater treatment and irrigation facilities permitted herein
at any reasonable time for determining compliance with this permit. Division authorized
representatives may inspect or copy records maintained under the terms and conditions of this permit,
and may collect groundwater, surface water, or leachate samples. [G.S. 143-215.3(a)(2)]

VI. GENERAL CONDITIONS
1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to a
Division enforcement action. [G.S. 143-215.6A, 143-215.6.B, 1.43-21.5.6C]
2. Unless specifically requested and approved in this permit, there are no variances to administrative codes
or general statutes governing the construction or operation of the facilities pennitted herein. [15A
NCAC 02T .0105(n)]
3. This permit is effective only with respect to the nature and volume of wastes described in the permit
application, and Division -approved plans and specifications, [G.S. 1,13-215.1(d)]
4. The issuance of this permit does not exempt the Permittee from complying with all statutes, rules,
regulations, or ordinances that other jurisdictional government agencies (e.g., local, state, and federal)
may require. [15A NCAC 02T .0105(c)(6)]
5. If the permitted facilities change ownership, or the Permittee changes their name, the Permittee shall
submit a permit modification request on Division -approved forms. The Permittee shall comply with
all terns and conditions of this permit until the permit is transferred to the successor -owner. [G.S. 143-
215.1(d3)]
6. The Permittee shall retain a set of Division -approved plans and specifications for the life of the facilities
permitted herein. [15A NCAC 02T .0105(o)]
7. The Permittee shall maintain this permit until the proper closure of all facilities permitted herein, or
until the facilities permitted herein are permitted by another authority. [15A NCAC 02T .01050)]
8. This permit is subject to revocation or modification upon 60-day notice from the Division Director, in
whole or part for;
a, violation of any terms or conditions of this permit or Administrative Code Title 15A Subchapter
02T;
b. obtaining a permit by misrepresentation or failure to disclose all relevant facts;
c, the Permittee's refusal to allow authorized Department employees upon presentation of credentials:
i. to enter the Permittee's premises where a system is located or where any records are required
to be kept;
ii. to have access to any permit required documents and records;
iii. to inspect any monitoring equipment or method as required in this permit; or
iv. to sample any pollutants;
d. the Permittee's failure to pay the annual fee for administering and compliance monitoring; or
e. a Division determination that the conditions of this permit are in conflict with North Carolina
Administrative Code or General Statutes.

9. Unless the Division Director grants a variance, expansion of the facilities permitted herein shall not
occur if any of the following apply;
a. The Permittee or any parent, subsidiary, or other affiliate of the .Permittee has been convicted of
environmental crimes under G.S. 143-215.6B, or under Federal law that would otherwise be
prosecuted under G.S. 143-215.613, and all appeals of this conviction have been abandoned or
exhausted.
b. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has previously abandoned
a wastewater treatment facility without properly closing the facility.
c. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid a civil
penalty, and all appeals of this penalty have been abandoned or exhausted.
d. The Permittee or any parent, subsidiary, or other affiliate of the Pennittee is currently not compliant
with any compliance schedule in a permit, settlement agreement, or order.
e. The Permittee or any parent, subsidiary, or other affiliate of the Permittee has not paid an annual
fee.

10. Failure to pay the annual fee shall subject .this permit to revocation. [15A NCAC 02T .0110(4)]
11. This permit shall not be renewed if the Permittee or any affiliation has not paid the required annual fee,
