Failure to submit all required items will necessitate additional processing and review time. For more information, visit the System-wide Collection System Permitting webslie: General—When submitting an application to the Pretreatment,Emergency Response,&Collection Systems(PERCS)Unit, please use the following instructions as a checklist in order to ensure all required items are submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the amount of requested additional information. The Applicant shall submit one original and one copy of the application and supporting documentation. A. Cover Letter Ei Submit a cover letter listing all items and attachments included in the permit application package B. No Application Fee Required ➢ No application fee is necessary. The permittee will be billed an annual fee upon issuance of the permit ➢ The appropriate annual fee for systemwide wastewater collection system permits may be found at: ➢ Annual Non-Discharge Fees C. System-Wide Wastewater Collection System (FORM: CSA 04-16) Application: El Submit the completed and appropriately executed System-wide Wastewater Collection System (FORM: CSA 04- 16) application. Any unauthorized content changes to this form shall result in the application package being returned. If necessary for clarity or due to space restrictions, attachments to the application may be made, as long as the attachments are numbered to correspond to the section and item to which they refer. ❑ If the Applicant Type in Section I.3 is a Privately-Owned Public Utility, provide the Certificate of Public Convenience and Necessity(CPCN)from the North Carolina Utilities Commission demonstrating the Applicant is authorized to hold the utility franchise for the area to be served by the wastewater collection system, or ❑ Provide a letter from the North Carolina Utilities Commission's Water and Sewer Division Public Staff stating an application for a franchise has been received and that the service area is contiguous to an existing franchised area or that franchise approval is expected. ❑ If the Applicant Type in Section I.3 is a corporation or company, provide documentation if it is registered for business with the North Carolina Secretary of State. D. General Information: ➢ The Authorized signing official listed in Section 1.4 should match with that of the Applicant certification page in accordance with I SA NCAC 02T .0106(b). JCTION II DESCRIPTION OF PROJECT AREA The Town of Liberty's population estimate as of 2019 according to American FactFinder is 2,658. The town is estimated to have grown by less than 1 percent since 2010 and actually remained flat or fell about 0.1 percent between the 2000 and 2010 Census. Liberty is approximately 61 percent people who are white and approximately 18 percent people who are African-American and 24 percent persons of Hispanic or Latino descent. The remainder of the population is composed of people who are of unspecified descent, American-Indian or multiple races. LAND AREA CONFIGURATIONS AND TOPOGRAPHY Topography The Town of Liberty contains generally hilly terrain with elevations ranging from approximately 725 to 780 feet above mean sea. level (MSL), according to the Randolph County Geographic Information System (GIS). The Town is centered near the highest elevation and slopes generally decrease toward the municipal boundary. The highest point, of approximately 780 feet above MSL,is found around Greensboro Street. Soils Based on Natural Resources Conservation Service (NRCS) mapping, the most common soil types in the Town are Georgeville urban land complex and Georgeville silty clay loam, as shown in Table 1. Fourteen (14)additional soil types are found in the vicinity of the Town, though none of these is found on more than five percent (5%)of the examined land area. The Georgeville Silt Loam and Georgeville silty clay loam are considered farmland of statewide importance. Forest Resources Some forest resources are present within the Town of Liberty, which are typical of the Piedmont region with a mixture of hardwoods and pines. Wetlands According to National Wetland Inventory (NWI) mapping, there are several identified wetlands throughout Liberty. These wetlands are primarily riparian along streams and rivers including the headwaters of the Rocky River. Floodplains The Town of Liberty is located near the top of several drainages. These drainages have mapped floodplains that begin near the Town limits and generally flow outward away from the Town. Historic Properties The Town of Liberty has a rich history and has numerous historic properties. A historic district was included on the National Registry in 2000 around the focused around the railroad which is central to the Town's history. Water Resources Several surface waters are located in and around the Town. It is located in the Cape Fear River basin and is primarily the headwaters for the Rocky River however the northernmost portion of Town drains to the Haw River. The main branch of the Rocky River begins south of Town while the North Prong passes by on the east side of Town.. SECTION III DESCRIPTION OF EXISTING FACILITIES A. General Status Liberty has a proud history when it comes to their water and sewer service. In the Iate 1920's, there was one of many large fires in the downtown district. As a result, the mayor at the time began installing the first ground well, water storage tank and water distribution lines in 1926. In the 1940's, completed sometime between 1946-1948, the original wastewater treatment plant was constructed. It was a trickle system that discharged into the North Rocky River Prong, which belongs to the Rocky River Watershed and eventually ends up in the Cape Fear River. In 1964, the wastewater collection system was expanded and the old trickle filter plant doubled in size.. In the late 1980's, the trickle filter system was abandoned and a sewer sprayfield and lagoon was installed. The current wastewater treatment plant consists of a 7 acre lagoon and over 80 acres of spray fields. The current treatment capacity is 550,000 gallons per day; however due to inflow and infiltration, the WWTP can at times take in as much as 3-4 million gallons per day. EXISTING CAPACITY Wastewater System The existing wastewater system has a capacity of 550,00 gpd utilizing a wastewater irrigation system. Existing flows vary widely due to Ul but typically average approximately 0.2 MOD leaving approximately 0.35 MGD of available capacity. Wet weather flows can exceed 3-4 MOD which have resulted in bypasses and overflows at the WWTP pump station. Water System Available supply from the Town's groundwater supply wells is 0.559 MGD. The service area demand is currently approximately 0.1741 MGD and utilizes approximately 31% of the available capacity. The system has a remaining capacity of approximately 0.3849 MGD and is not anticipated to need additional capacity in planning period unless substantial growth occurs such as the development of the Greensboro-Randolph Megasite. C. PRESENT CONDITION Wastewater System The current sanitation sewer collection system consists of 6-inch through 12-inch gravity lines, 7 sanitation sewer pumping stations and associated force mains. Major sewer installation around Liberty occurred in 1927, 1954 1963, and 1969. Between the years of 2000 thru 2008, the Town of Liberty made some major improvements to the current collection system. There was a three phase inflow and infiltration (I/I) project that replaced approximately 3,500 linear feet of sewer line,replaced approximately 25 manholes with new ones, and completed 2,000 linear feet of slip lining. This project was a big improvement to reduce the I/I from the system. Along with the project, the Town car marked one hundred thousand dollars ($100,000) for rehabilitation of manholes throughout town. This was another major project to reduce the in the system. The Collection System was included in the Water/Sewer Capacity Study and the GIS mapping. The mapping indicates all lines, manholes, lift stations, etc. that are associated with the collection system. Along with the phase of I/I improvements, all old and outdated generators were replaced with new ones. This makes all generators current in age. During 2009, the Town replaced 3,000 linear feet of 8" sewer line and manholes from Frazier Avenue to the Kinro pump station. This replaced the old terra cotta pipe that was installed back in the 1950's. This outfall line has experienced numerous backups and overflows due to misaligned joints and deterioration and also is a source of inflow and infiltration. The upgrade will be a major improvement to our efforts to replace or rehab the remaining older sewer lines in the collection system. During 2019-2020 Budget year, there were some major issues with the UltraCraft Lift Station. Due to these issues, the lift station was completely rehabilitated. All aspects of the lift station were upgraded including propellers, rails, and electrical panel upgrades. The future demands on the sanitation sewer collection will necessitate continual upgrading of the aging and antiquated sewer systems. The 10-year goal will be to continue replacement of the 1927 system and replacement of most of the 1954 system. The plan also provides for replacement of major maintenance equipment required during the 10-year period. Also, the town will be working on completing all manhole rehabilitation that is left in the system. The current wastewater treatment plant is at the 33-year operational mark and is in need of upgrading. With the inflow/infiltration (1/l) upgrading, it has reduced some of the flow at the WWTP. We highly desire to comply with state standards and totally reduce the overflow issues at the soonest possible opportunity. Upgrading the head works of the plant will greatly assist in our efforts as well as upgrading our influent pumps to handle the flows and take them to the lagoon. Our current upgrade plan includes an automated bar screen for less operation and maintenance as well as adding SCADA to the head works which will be instrumental in our 10 year capital improvement plan. During 2019-2020 budget year, one of the irrigation pumps and motor at the WWTP was pulled and rebuilt. These pumps and motors have been extremely reliable and have not had any maintenance done to them since they were installed in 1987. In the near future, we need to have the other irrigation pump and motor rebuilt. Water System The current water supply is provided by 9 deep wells with capacities ranging from 45 gallons per minutes (gpm) to 220 gallons per minute (gpm). The distribution system consists of 2-inch through 12-inch water lines with storage capacities provided by 3 elevated storage tanks with a total capacity of 950,000 gallons. All residents of the Town of Liberty are served by the existing water system. The system serves over 1,200 residential customers, and approximately 200 commercial, industrial, and institutional customers. Three water tanks provide a total of approximately 0.95 million gallons in elevated storage. Future demands will necessitate the increase of the back bone of the water distribution system by the addition of 12-inch pipes to provide for looping of the water system. Some minor looping of the system will require the connection of existing 6-inch and 8-inch water lines. It is also anticipated that our water system will require additional wells to furnish our town with the quality and quantity of clean water required. Standby generators will also be installed at the majority of the wells in order that the Town can be assured of a continuous water supply during emergency events. The Town will continue to upgrade its meters with new models that could be modified for automated reading devices. In fiscal year 2020/2021, the Town will continue replacing old water valves and hydrants with new ones. Our new software for our financials has a work order system integrated in. This new system should help us track work orders and help us track problematic areas in our system. This will allow for better customer service to the citizens of Liberty. The Town has entered into a 10 year maintenance/management contract for the Water Tanks which will include annual inspection, scheduled exterior and interior painting and scheduled washouts on all three tanks. D. PREVIOUSLY COMPLETED STUDIES AND ASSESSMENTS The Town previously completed a water and sewer system CIP in 2013 and this CIP serves to update that document. The priorities are similar between the prior CIP and this current document. The Town has also had mapping work done to assess the length and location of water and sewer lines and appurtenances in these systems. George E. Kurz, P.E. performed an I/I evaluation for the Town of Liberty in 2017. The analysis reviewed water and sewer billings and flow at the irrigation system and noted that I/I is approximately 40% of the influent flow to the WWTP, Based on this information I/I reduction remains a high priority for sewer system improvements. The Town was awarded a Golden LEAF grant to conduct flow monitoring and smoke testing of the entire collection system in order to identify and prioritize repairs that have been contributing to inflow and infiltration. These tests were completed in 2019 and gave the Town on overview of all the problematic areas in the collections system. The Town was then awarded another Golden LEAF grant to target certain sewer sections that were damaged due to recent storms. These areas are set to be replaced/repaired in 2020. The Town is also applying for various Asset management grants to help determine all our assets in our system. The Town was awarded a Community Development Block Grant (CDBG) for Infrastructure through the Division of Water Infrastructure in the amount of$2,000,000 in 2018. This grant will fund the rehabilitation and replacement of approximately 15,000 linear feet of sewer line in the vicinity between S. Carolina and S. Murphy, and W. Swannanoa and W. Kime including manholes, laterals and related appurtenances, These projects are well underway and will be completed over the next few years. E. SPECIFIC LIMITATIONS There are no known specific limitations to the Town of Liberty water and sewer systems. The community is located near the top of the watershed and has limited access to large waterways which has required the Town to depend on wells for water supply and wastewater irrigation for wastewater disposal as opposed to surface water alternatives. F. LONG TERM POTENTIAL ALTERNATIVES The Town anticipates continuing to utilize the existing water and sewer systems during the planning period without substantive changes. The current focus is on improving the condition of the existing facilities to help them to operate as efficiently as possible. By continuing to make improvements to the water distribution system to reduce water loss and to the collection system to remove VI it is anticipated that the current capacities will be sufficient to meet demands during a 20 year planning period. SECTION iv DESCRIPTION OF KNOWN DEFICIENCIES A. CAPITAL OUTLAY NEEDS (10 YEAR HORIZON) A total of 71 projects were identified to be included in the Capital Improvements Plan over the next 10 years. These projects are identified in no particular order and a prioritization matrix was performed after listing of the projects to identify the highest priority projects for the Town. Note that the majority of projects are budgeted as a single lump sum however some projects are anticipated to be ongoing work and have been budgeted as annual expenses. Project 3 Replace Backhoe to replace 1994 backhoe $110,000.00 Description: The Town has a backhoe that is nearing the end of its useful life and will need to be replaced in the near future. This equipment is frequently used for water system maintenance but can be used by other departments also. Project 4 Well 2 Install New Generator $45,000.00 Description: Install a standby generator at Well 2 such that the well can be utilized during power outages to maintain water supply for the town. Project 5 Well 8 Install New Generator $45,000.00 Description: Install a standby generator at Well 2 such that the well can be utilized during power outages to maintain water supply for the town. Project 6 Well 4 Improvements $150,000.00 Description: Well improvements at Well 4 include replacement of the well building,replacing piping and valves in the well, electrical equipment and installation of a new standby generator to allow the well to be used during power outages. Project 7 Well 1 Replace Plumbing& New Generator $75,000.00 Description: Well improvements at Well I include replacement of the piping and valves at the well and installation of a new standby generator to allow the well to be used during power outages. Project 8 Replace Utility Truck to replace 1998 Utility Truck $80,000.00 Description: This item includes replacement of the main utility truck which is approximately 20 years old. The truck is used for general maintenance activities and to tow other equipment to the project sites when needed. Project 9 Replace/Rehab Water Mains $100,000.00/year Description: The Town's water system is in fair to poor condition and has had substantial water loss primarily caused by leaking water lines. This item will serve as an annual budget to replace water lines as identified by the utility director as the highest priority lines. Project 10 Update SCADA for Wells and Tanks $25,000.00/year Description: Existing wells have older SCADA equipment or are lacking SCADA equipment entirely. This item is an annual budget item to upgrade the SCADA systems to bring them up to current standards. Project 11 Replace Dump Truck to Replace 1998 Dump Truck $125,000.00 Description: This item includes replacement of the Town's dump truck which is approximately 20 years old. The Town of Liberty and the Commission hereby stipulate the following: (a) The Town holds North Carolina non-discharge permit number WQCS00280, for management and operation of an existing wastewater collection system but is unable to consistently comply with sanitary sewer overflow (SSO) prohibitions stipulated in Condition 1.2. of the permit, due primarily to the introduction of large volumes of extraneous flow resulting from inflow and infiltration (I&I) throughout the collection system. The Town reported 82 SSOs during the time period January 2018 through September 2020, with some volume of untreated wastewater reaching unnamed tributaries to the Rocky River, which are classified WS-III (water supply) waters of the state within the Cape Fear River Basin, during the vast majority of those incidents. (b) The Town holds North Carolina non-discharge permit number WQ0003090, for the management and operation of an existing non-discharge wastewater treatment facility (WWTF) which employs wastewater irrigation for final disposal of the treated wastewater. Due to high flows that reach the WWTF resulting from I&I to the collection system, the WWTF periodically receives flows in excess of the volumes it can manage and contain, resulting in 14 bypasses of nontreated or undertreated wastewater from treatment units within treatment system during the time period January 2018 through September 2020. Portions of the volumes spilled have entered the North Prong Rocky River, which is currently classified a WS-III (water supply) water of the state within the Cape Fear River Basin. (c) A list of recent SSOs from the Town of Liberty collection system and unpermitted bypasses of wastewater from the Town of Liberty WWTF is included in Attachment A to this Special Order. EMC SOC WQ S I 9-011 Town of Liberty p. 2 (d) The unpermitted discharges of untreated and/or undertreated wastewater from the Town's treatment system to surface waters constitutes causing and contributing to the pollution of the waters of this State, named above, and the Town is within the jurisdiction of the Commission as set forth in G.S. Chapter 143, Article 21. (e) The Town has recently completed a study of its collection system that has identified and categorized sources of I&I, and established a priority list of actions (repair, rehabilitation and/or replacement of collection system infrastructure) the Town shall undertake to reduce volumes of I&I. (f) The Town has secured, through grants and funding, financing for planning, designing, and improving the wastewater collection system which, once complete and properly operated, will be sufficient to adequately convey all wastewater collected throughout the Town to the WWTF, and reduce to the greatest practical extent the I&I flow it currently receives. A listing of funding sources and projects for the Town's collection system improvements is included in Attachment B to this Special Order. (g) Since this Special Order is by Consent, neither party will file a petition for a contested case or for judicial review concerning its terms. 2. The Town, desiring to comply with the permits identified in paragraph l(a) and 1(b) above, hereby agrees to do the following: (a) Undertake the following activities in accordance with the indicated time schedule: (1) Provide the Winston-Salem Regional Office with quarterly progress reports regarding improvements being made to collection system infrastructure. Reports are due within 30 days following the end of each calendar quarter. The first report is due April 30, 2021 for the January through March (1") quarter and shall continue to be submitted throughout the life of this Special Order. (2) On or before January 1, 2021, the Town shall commence construction on the project funded by the $493,778 GLF, which was awarded in December 2019. This project targets repair of six of the worse defects identified through the Town's MI study and calls for rehabilitation of approximately 3,231 linear feet of sewer main repair or replacement of all manholes and laterals within these system areas. (3) On or before April 30, 2021, the Town shall begin execution of the $2,000,000 CDBG-funded project, which was awarded in March 2019. This project includes replacement and/or rehabilitation of 15,900 linear feet of 8" vitrified clay sewer lines, 72 brick-constructed manholes and related appurtenances, and 150 lateral line replacements, in the southwest quadrant of the Town. (4) On or before August 1, 2022, the Town shall begin execution of the Additional Supplemental Appropriations for Disaster Relief Act of 2019 (ASADRA) project loan of$3,000,000, which was approved in August 2020. This project includes the relocation of the Starmount lift station that is in a 100 year floodplain, the EMC SOC WQ S19-011 Town of Liberty P. 3 rehabilitation of the Kinro Road lift station, the rehabilitation of 8,000 linear feet of sewer line, and CCTV of 18,000 linear feet of sewer line. (5) On or before June 1, 2021, the Town shall complete the GLF grant-funded rehabilitation and repair project noted in 2 (b)(2)above. (6) On or before July 29, 2022, the Town shall complete the CDBG-funded project noted in 2 (b)(3) above. (7) On or before September 30, 2023, the Town shall complete the ASADRA- funded project noted in 2 (b)(4) above. (b) No later than fifteen (15) calendar days after any date identified for accomplishment of any activity listed in 2(b) above, the Town shall submit to the Director of DWR written notice of compliance or noncompliance therewith. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. 3. The Town, desiring to comply with the Permits identified in paragraph 1(a) above, hereby agrees to the following settlement of outstanding civil penalties, an upfront penalty, and stipulated penalties: (a) The Town has outstanding civil penalty assessments that total $49,250. As settlement of all alleged violations of non-discharge permit number WQCS00280 and non-discharge permit number WQ0003090 prior to entering into this Special Order by Consent, the Town agrees to pay an upfront penalty amount of$1,477.50, with the remaining amount of$47,772.5 CIO to be held in abeyance until the successful completion of this SOC. Failure within thirty (30) days of receipt of written demand to pay the penalties or challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection action, which the Attorney General is hereby authorized to initiate. The only issue in such EMC SOC WQ S 19-011 Town of Liberty P. 5 an action will be whether the thirty(30)days has elapsed. 5. In accordance with the provisions of G.S. 143-215.67(b) the Commission allows the Town to accept 0.0 MGD of additional wastewater (via permitted sewer extensions) to its waste treatment system while improvements to the collection system are being made. The nature of the additional flows is such that the waste characteristics do not exceed those generally associated with domestic waste or are pretreated to domestic strengths. Waste of greater than normal domestic strength may be accepted if it can be demonstrated to the satisfaction of the Director the additional waste will not adversely affect the treatment efficiency of the treatment system or result in the violation of any permit limitation. All new and proposed industrial waste tributary to the system must be controlled using all needed mechanisms including but not limited to adoption and implementation of industrial waste control and pretreatment ordinances. No wastewater can be accepted that will add toxic pollutants in quantities not generally associated with domestic wastewater characteristics unless the acceptance of the additional wastewater can be supported through appropriate analyses acceptable to the Director. 6. This Special Order by Consent and any terms or conditions contained herein, hereby supersede any and all previous Special Orders, Enforcement Compliance Schedule Letters, terms, conditions and limitations contained therein issued in connection with permits WQ0003090 and WQCS00280. 7. Any violation of the terms of this Special Order by Consent may terminate paragraph five (5) of this Order, and any authorized additional waste not previously connected to the system shall not thereafter be connected until the necessary sewer collection system improvements have been completed and placed in operation. 8. Noncompliance with the terms of this Special Order by Consent are subject to enforcement action in addition to the above stipulated penalties, including injunctive relief pursuant to G.S. 143-215.6.(C). 9. This Special Order may be modified at the Commission's discretion, provided the Commission is satisfied that the Town has made good faith efforts to secure funding, complete all construction, and achieve compliance within the dates specified. 10. Failure to pay the up-front penalty described in paragraph 3.(a)within thirty (30) days of the execution of this Special Order may terminate this Special Order and require the Town to comply with all terms and conditions contained in non-discharge permits WQ0003090 and WQCS00280. 11. This Special Order shall become effective in accordance with state law; however, the Town, upon signature of this Special Order by Consent, will be expected to comply with all schedule dates, terms, and conditions within this document. 12.
