The DWQ concurs -with the USACE and ackno- wledges that the riprap sill is for 250'. If the Cite of Jacksonville -wants to
construct the remainder of the sill at a later date they may be required to reapply as the certification -will have expired.

Reference the DCM memo from Barry Guthrie received by this office on September 25, 2012 regarding a modification
request of State Permit No. 151 -06 issued to the City of Jacksonville to restore approximately 910 feet of shoreline adjacent to
Phillips Park along Chaney Creek and expand -wetlands along a cut off of Chaney Creek at 150 Phillips Road, Jacksonville,
Onlso-w Coumv, NC. The originally authorized project includes shoreline stabilization -with a 910'x 5' oyster shell sill
constructed to an elevation of 2.5 feet above grade and placed 10 feet -water-ward of the Normal High Water (NHW) and filling
of various areas behind the sill to accommodate the planting of submerged aquatic vegetation (SAV's) and other -wetland plants.
On February 14, 2007, the Corps issued a GP291's for this project. The subject modification request includes partial demolition
of 264 ft of bulkhead and installation of 20 It of rip rap revetment, modified from oyster shell sill, and planting of -wetland
vegetation along 250 ft of revetment, plus other activities as described in the referenced memo.
The Corps of Engineers revie,, ed the subject modification request, including all the comments received on the original
proposal submitted by the federal agencies. Based on this revie,, , , e have no objections to this modification request prodded
the applicant obtains the required CAMA permit and the CWA Section 401 Water Quality Certification for this " ork.
It appears, based on the modification request, that the permittee is not requesting authorization or a permit rene" a1 to
complete the previously authorized , ork along the remaining portions of the shoreline. Please note that a DA permit may be
required for this , ork should the To,,Nm of Jacksonville later decides to stabilize the remaining portions of park shoreline.
