APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN
Dear Mr. White:
On March 15, 2010, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to
impact 138 linear feet of Caraway Creek and 0.493 acres of riparian wetlands in order to construct
Diamonds Keep Subdivision. Condition 3 of the Water Quality Certification requires you to implement
the Stormwater Management Plan that was approved in conjunction with the Water Quality Certification.
On July 31, 2012, the DWQ received a revised stormwater management plan (dated July 24, 2012) for
Diamonds Keep Subdivision from your consultant, Mr. H. Mack Summey, P.E. The purpose of the
requested revision is to modify Wet Detention Ponds 1 and 2 to make them more economical while still
meeting state standards.
The DWQ approves the revised stormwater management plan as satisfying Condition 3 of the General
Water Quality Certification. This approval is for the purpose and design that you described in your
application. if you change your project, you must notify us and you may be required to send us a new
SMP. This approval requires to you follow the conditions listed in the General Water Quality
Certification for the project and the following additional conditions listed below:
1. The emergency spillways for Wet Detention Ponds 1 and 2 must be hardened with riprap,
concrete or other durable material.

2. The modified SMP approved by the DWQ consists of the Wet Detention Ponds 1 and 2 as well as
all associated stormwater conveyances, inlet and outlet strictures, and the grading and drainage
patterns depicted on the approved plan sheets (except for the modification in Item 1 above). The
plans and specifications for the remainder of Diamonds Keep Subdivision are incorporated by
reference this approval and are enforceable by the DWQ provided however that any modification
of the design for the stormwater management system that is accepted by the DWQ shall take
precedence over the original plans and specifications.
3. The footprint of all stormwater management devices as well as an additional ten (10) foot wide
area on all sides of the devices shall be located in either public rights -of -way, dedicated common
areas or recorded easement areas. The final plats for the project showing all such rights -of -way,
common areas and easement areas shall be in accordance with the approved plans.
4. Maintenance activities for the BMPs shall be performed in accordance with the notarized O &M
agreements. The O &M agreement must transfer with the sale of the land or transfer of
ownership /responsibility for the BMP facility. The DWQ must be notified promptly of every
transfer.
5. The applicant and/or authorized agent shall provide a completed Certificate of Completion form
to the DWQ within thirty (30) days of project completion (available at
