Dear Ms. Jackson:
Based upon DEQ's records, Weaverville is permitted as a Phase II MS4 due to U.S. Census
designation as an Urbanized Area. Under the federal NPDES Stormwater Phase II Final Rule,
MS4 permit coverage is required if the town owns/operates an MS4 [Ref. 40 CFR 122.32].
Therefore, DEQ is unable to grant the requested waiver from MS4 permitting.
