OP-2004-0003 FINDINGS AND DECISION AND ASSESSMENT OF CIVIL PENALTIES Acting pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources and the Director, of the Division of Water Quality, I, Jeffrey O. Poupart, Supervisor of the Non -Discharge Compliance and Enforcement Unit of the Division of Water Quality (DWQ), make the following:: FLN.DINGS OF FACT: A. Mr. William Waters is the landowner of record for the tract known as the Bailewick Development, located on Windy Ridge Rd. in Charlotte, Mecklenburg County, North Carolina. B. Construction of the Bailewick project began in 198.8. Mecklenburg County issued the original permit for grading of the site that same year. The original permit expired and was reissued in 1997. This permit subsequently expired in 2000. The project is currently operating without an approved grading permit per Mr. Jeff McDermott of the City of Charlotte Land Development Division. C. Mr. Waters failed to obtain Storrnwater General Permit No_ NCG0I000 for the site in accordance with NCGS 143-215.1(a) and 15A NCAC 02H .0126. This permit is issued upon approval and issuance of the grading permit for the site by the delegated governmental authority, which in this case is the City of Charlotte Land Development Division. D. On November 24, 2004, Mssr. Alan Johnson and Barry Love with the Mooresville Regional Office (MRO) of DWQ conducted an inspection at the Bailewick Development project. Stream impacts (culverts and rip -rap) to approximately 400 linear feet of an unnamed tributary to Fourmile Creek were observed. Fourmile Creek is Class C waters of the State in the Catawba River Basin. E. A Notice of Violation/Recommendation for nt was issued by MR0 to Mr. Waters on January 28, 2004. F. On February 5, 2004, MR0 received Mr. Waters' response to the Notice of Violation/Recommendation for Enforcement wherein he stated that approval for the project was received in 1988. No documentation was provided. G. On February 12, 2004, IVIRO requested more information/documentation regarding the aforementioned approval. Also, Mr. Waters was notified that if information/documentation could not be provided then an "after -the -fact" Preconstruction Notification (PCN) form should be submitted for approval of the impacts. No PCN has been received as of April 12, 2004. H. On February 25, 2004, Mr. Alan Johnson (DWQ) and Ms. Amanda Jones with the U.S. Army Corps of Engineers (COE) met with Mr. Waters at the Bailewick site to discuss the impacts. At that meeting it was learned that in addition to the 400 linear feet of unapproved stream impacts, Mr. Waters planned to impact approximately 140 more linear feet of stream in order to construct a house The COE has no record indicating that approval had been given for any impact to the stream or that approval had been requested. The cost to the State of the enforcement procedures in this matter Based upon the above Findings of Fact, 1 make the following: CONCLUSIONS OF LAW: o al d $508.48.. A. Mr. Waters is a "person" within the meaning ot G 5 143-215.6A pursuant to G.S. 143-212(4). B. The unnamed tributary to Fourmile Creek constitutes waters of the State within the meaning of G.S. 143-212(6), C. Under G.S. 1.43-215.1(a), a permit is required to cause or permit. discharges regulated under G.S. 143-21.4.7, D. Mr. Waters violated 15A NCAC 02H .0126 pursuant to G.S. 143-2.15.1(a) by failing to obtain Stormwater General Permit NCG010000. E. Mr. Waters violated 15A NCAC 02H .0500 by failing to apply for and obtain a 401 Water Quality Certification for the impacts to the stream. F. Mr. Waters violated 15A NCAC 02B .0211 (2) (Preclusion of Best Usage) by impacting greater than 400 linear feet of stream by installing culvert and riprap resulting in the destruction of aquatic habitat. G. Mr. Waters may be assessed civil penalties in this matter pursuant to G.S. 143- 215.6A(a)(2), which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation per day may be assessed against a person who is required but fails to apply for or to secure a permit required by G.S. 143- 215.1, or who violates or fails to act in accordance with the terms, conditions, or requirements of such permit or any other permit or certification issued pursuant to authority conferred by this Part. Mr. Waters may be assessed civil penalties in this matter pursuant to G.S. 143- 215.6A(a)(1), which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation per day may be assessed against a person who violates any classification, standard, limitation, or management practice established pursuant to NCGS 143-215, 143-215.1, or 143-215.3. The State's enforcement cost in this matter may be assessed against the violator pursuant to NCGS 143-215.3(a)(9) and 143B-282(b)(8). The Supervisor of the Non -Discharge Compliance and Enforcement Unit, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality, has the authority to assess civil penalties in this matter. Based upon the above Findings of Fact and Conclusions of Law, I make the following: DECISION: 508.48 5 for failure to obtain Stormwater General Permit NCG01000 in violation of NCGS 143-215,1(a). for failure to obtain a Water Quality Certification prior to impacting waters of the state in violation of 15A NCAC 02H .0500. for removal of the natural stream habitat in violation of 15A NCAC 02B .0211 (2) (Preclusion of Best Usage). Bailewick Development, Charlotte, NC Violation ofNCGS 143-215.1, NCAC 15A 2H .0126, 15A NCAC 2H .0500, AND 1 ..A NCAC 2B .0211(2 Mecklenburg County, NC Enclosed is an enforcement recommendation package for the Bailewick Development project in Charlotte, NC. Mr. Alan Johnson of this Office conducted an initial site inspection on November 24, 2003. A Notice of Violation with a Recommendation For Enforcement was issued on. January 28, 2004 for the failure to obtain a 401 Water Quality Certification for approximately 400 linear feet of stream impact. As of this date no application has been received for approval of the noted impact. On March 31, 2004, upon request from DWQ, the City of Charlotte provided a portion of the original (1988) site plan for the Bailewick Development project. The original plan proposed 513 linear feet of impact (culverts) to the stream. Three hundred feet of the proposed impact had been completed, plus an additional 100 linear feet of stream impacts that were not included in the plan have also been completed. Aerial photos taken in 2002 showed the only impact completed at that time was approximately 50 linear feet (stream/road crossing) of the proposed 513 linear feet shown in the original plan. D. On November 24, 2004 Mssr. Alan Johnson and Barry Love with the Mooresville Regional Office of the Division of Water Quality (DWQ) conducted an inspection at the the Bailewick Development project. Stream impacts of approximately 400 linear feet were observed. E. A Notice of Violation./Recommendation For Enforcement was issued by the Mooresville Regional Office (MRO) on January 28, 2004. F. On February 5, 2004, DWQ's Mooresville Regional Office received Mr. Waters' response to the Notice of Violation/Recommendation For Enforcement wherein he stated that approval for the project was received in 1988. No documentation was provided. G. On February 12, 2004 the MRO requested more information/documentation regarding the aforementioned approval. Also Mr. Waters was notified that if information/ documentation could not be provided then an "after -the -fact" Preconstruction Notification (PCN) form should be submitted for approval of the impacts. No PCN has been received as of April 12, 2004. H. On February 25, 2004 Mr, Alan Johnson (DWQ) and Ms. Amanda Jones with the U.S. Army Corps of Engineers (COE) met with Mr. Waters at the Bailewick site to discuss the impacts. At that meeting it was learned that in addition to the 400 linear feet of unapproved stream impacts, Mr. Waters planned to impact approximately 140 more linear feet of stream in order to construct a house. The COE has no record indicating that approval had been given for any impact to the stream or that approval had been requested. The unnamed stream/tributary to Four Mile Creek is located within the boundaries of the tract known as the Badewick Development and is a Class C waters in the Catawba River Basin, K. The cost to the State of the enforcement procedures in this matter totaled $ 508.48 Based upon the above Finding of Fact, I make the following: CONCLUSIONS OF LAW A. Mr. Waters is a "person" within the meaning of G.S. I43-215.6A pursuant to G.S. 143- 212(4), B. The unnamed tributary to Four Mile Creek located at the site constitutes waters of the State within the meaning of G.S. 143-212(6). C. Under G.S. 143-215.1(a), a permit is required to cause or permit discharges regulated under G.S. 143-214.7. Mr. Waters violated North Carolina Administrative Code 15A 2H .0126 pursuant to G.S. 143-215.1(a) by the failure to obtain Stormwater General Perrnit NCG010000. Mr. Waters violated North Carolina Administrative Code 15A .02H .0500 by failing to apply for and obtain a 401 Water Quality Certification for the impacts to the stream. F. Mr. Waters violated North Carolina Administrative Code 15A .02B .0211 (2) (Preclusion of Best Usage) by installing in excess of 400 linear ft. of culvert and riprap in the stream resulting in the destruction of aquatic plant/animal habitats. G. Mr. Waters may be assessed civil penalties in this matter pursuant to NCGS 143- 215.6A(a)(2), which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation per day may be assessed against a person who is required but fails to apply for or to secure a permit required by G.S. 143-215.1, or who violates or fails to act in accordance with the terrns, conditions, or requirements of such permit or any other pen -nit or certification issued pursuant to authority conferred by this Part. H. Mr. Waters may be assessed civil penalties in this matter pursuant to NCGS 143- 215.6A(a)(1), which provides that a civil penalty of not more than twenty-five thousand dollars ($25,000) per violation per day may be assessed against a person who violates any classification, standard, limitation, or management practice established pursuant to NCGS 143-215, 143-215.1, or 143-215.3. 1. Approximately 400 linear feet of stream was impacted (removed from the natural biological system) due to the installation of culverts and riprap placed in the stream channel. The culverts effectively removed portions of the stream's ability to provide aquatic habitat and other biological functions, 2. The duration and gravity of the violations; The culverts are permanent. The placement of the culverts was to allow for the extension of yard area for homes to be constructed, andior to allow the actual construction of the home due to the placement of the lot in close proximity to the stream. There is no documentation that prior approval was sought or received from the Army Corps of Engineers or the Division of Water Quality. Further, the Notice of Violation (NOV) issued by the DWQ on January 28, 2004 requested that the owner apply for a 401 Water Quality Certification. As of April 6, 2004 no application has been received. The effect on ground or surface water quantity or quality or on air quality; The installation of the culverts (66-inch diameter) has removed the stream from the biological system. As such, the riffle pools, streambed substrate, and the respective biotic habitat available for aquatic life has been permanently destroyed. 4. The cost of rectifying the damage; The cost for rectifying the damage is difficult to provide. The main costs would result from the removal of the culverts and the restoration of the stream (400 linear feet) to its original state. The cost associated with the damage to the aquatic habitat is unlaiown. 5. The amount of money saved by noncompliance; Based on the length of stream that has been culverted (piped), at minimum, the money saved by Mr. Waters' failure to apply for and receive approval for the observed impact is approximately S80,000.00. This is based on the mitigation cost that would have been paid into the Ecosystem Enhancement Program for the impact. 6. Whether the violations were committed willfully or intentionally; Mr. Waters has been in the construction business since 1965. On May 3, 1988, Petitioner obtained authorization from Mecklenburg County, North Carolina, to impact the water feature in the Bailewick subdivision through an Erosion Control Plan dated as of March 14, 1988 ("1988 Erosion Control Plan"). A true and accurate copy of the 1988 Erosion Control Plan is attached as Exhibit A and incorporated herein by reference. 6. Petitioner received additional approval from the City of Charlotte to irrtpact the water feature on the Bailewick subdivision through a Grading and Erosion Control Plan dated as of January 22, 1997 ("1997 Grading and Erosion Control. Plan"). A true and accurate copy of the 1997 Grading and. Erosion Control Plan is attached. as Exhibit B and incorporated herein by reference. 7. On November 13, 19.86, the U.S, Army Corps of Engineers issued nationwide permits that were effective January 12, 1987. The rules were initially issued at 51 Fed. Reg. 41206 and were codified at 33 C.F.R. 330.5(a). A true and accurate copy, of the nationwide permit regulations is attached as Exhibit C and incorporated herein by reference.. 8. In 2004. Petitioner received from the City of Charlotte correspondence which confirms that grading permits do not expire so long as a site has continuous activity with some area being denuded. A true and accurate copy of the 2004 letter from the City of Charlotte is attached as Exhibit D and incorporated herein by reference, 9. In good faith and reasonable reliance on the nationwide permit regulations cited in Paragraph 7 above, and in good faith and reasonable reliance on the 1988, Erosion Control Plan and the 1997 Grading and Erosion Control Plan, Petitioner has made substantial expenditures or incurred substantial contractual obligations in connection with the development of the Bailewick subdivision, including without limitation the conduct of grading activities in and affecting the water body that is present at the Bailewick subdivision, and the installation of culverts and riprap in the water feature. 10. On January 29, 2004, Petitioner received a Notice of Violation and Recommendation for Enforcement Action from Respondent, a copy of which is attached hereto as Exhibit E and incorporated herein by reference. On February 12, 2004, Petitioner received additional correspondence from Respondent, a copy of which is attached hereto as Exhibit F and, incorporated herein by reference, 11. On or about June 7, 2004, Petitioner received Respondent's Assessment of Civil Penalties for Water Quality Violations, along with its Findings and Decision and Assessment of Civil Penalties, and other attachments. A copy is attached hereto as Exhibit G and incorporated herein by reference, 12. On June 23, 2004, Petitioner filed a Petition for Contested Case Hearing in response to Respondent's Assessment, of Civil Penalties tor Water Quality Violations and its Findings and Decision and Assessment of Civil Penalties. 13. .Petitioner's sole basis for contesting Respondent's Findings and Decision and Assessment of Civil Penalties is that Petitioner had "vested rights" to complete work in the water feature located on the Bailewick subdivision as a result of the Grading and Erosion Control Plan, and nationwide permits referenced above. As such, Petitioner's grounds for contesting Respondent's Assessment of Civil Penalties for Water Quality Violations and its Findings and Decision and Assessment of Civil Penalties is based solely on questions involving interpretation. of the Constitution.
