APPROVAL OF MODIFIED DIFFUSE FLOW PLAN

On January 13, 2012, the Division of Water Quality (DWQ) issued a 401 Water Quality
Certification to conduct the following actions to construct the Alston Pond residential
subdivision:
• Permanently impact 0.34 acre of 404 Wetlands,
• Temporarily impact 0.013 acre of 404 Wetland,
• Permanently impact 297 linear feet of perennial stream
• Temporarily impact 23 linear feet of intermittent stream,
• Permanently impact 23,344 square feet of Zone 1 Neuse River buffer, and
• Permanently impact 23,405 square feet of Zone 2 Neuse River buffer.
Condition 6 of the 401 Water Quality Certification requires that all stormwater shall be
directed as diffuse flow at non - erosive velocities through the protected Neuse River buffers.
Concurrent with the approval of the water quality certification on January 13, 2012, the
DWQ approved an engineered diffuse flow plan.
On July 9, 2012, the DWQ received a modified diffuse flow plan (dated July 6, 2012) with a
request to reconfigure the diffuse flow plan at the outlet of BMP #2 (a wet detention pond).
On August 3, 2012, the DWQ received an updated to the modified diffuse flow plan via
email.
The DWQ approves the diffuse flow plan received on August 3, 2012 as satisfying Condition
6 of the General. Water Quality Certification. This approval is for the purpose and design

that you described in your application. If you change your project, you must notify us and
you may be required to send us a new diffuse flow plan. This approval requires you to
follow the conditions listed in the General Water Quality Certification for the project and the
following additional conditions listed below.
1. The modified diffuse flow plan approved by the DWQ consists of one level spreader -
vegetated filter strip and all associated stormwater conveyances, inlet and outlet
structures, and the grading and drainage patterns depicted on plan dated August
3, 2012. The approved SMP must be maintained in perpetuity. No changes to the
structural stormwater practices shall be made without written authorization from the
DWQ. The stormwater management structures shall have maintenance access and
at least a 10 -foot drainage easement on each side to allow for the ability to
maintain the structures, and to perform corrective actions. The stormwater
easements shall be recorded to provide protection of the structures from potential
alterations by future property owners.
2. Operation and Maintenance of BMP: Maintenance activities for the proposed level
spreader- vegetated filter strip shall be performed in accordance with the notarized
O &M agreements signed by Mr. Julian Rawl (Manager) on January 31, 2011. The O &
M agreement must transfer with the sale of the land or transfer of
ownership /responsibility for the BMP facility. DWQ must be notified promptly of every
transfer.
