Marvin, North Carolina 28173 Subject: Compliance Evaluation Inspection Midtown T Collection System Permit No. WQCSD0101 Mecklenburg County Dear Mr. Lyssikatos: 1. Mr. Michael Meilinger and Mr. Tony Parker of the Mooresville Regional Office of the NC Division of Water Resources (DWR or the Division) conducted a compliance evaluation inspection (CEI) of the subject wastewater collection system (WWCS) on September 9, 2019. The assistance provided by Mr. Matt Caton during the inspection was greatly appreciated. A copy of the inspection report is attached for your records and inspection findings are summarized below. Site/System Review 2. The following system components were inspected: a. The system has one pump station located behind the restaurant. 3. As you are aware, owners of permitted collection systems must comply with their permit and all rules listed under NC Administrative Code 15A NCAC 02T .0400, et seq. The system status is outlined below: a. 15A NCAC 02T .0403(a)(1): Requires that the system be effectively maintained and operated at all times to prevent discharge to land or surface waters and any contravention of ground or surface water standards. Observations: The system has had no reportable spills. Compliance Status: Compliant Q-4 North Carolina Department of Environmental Quality I Division of Water Resources Mooresville Regional Office 1610 East Center Avenue, Suite 301 I Mooresville, North Carolina 28115 704.663.1699 c. 15A NCAC 02T .0403(a)(5): Requires that the permittee or its representative inspect high -priority sewers (HPS - as defined in 15A NCAC 02T .0402(2)) at least once every six months and document the inspections. Observations: The system has no High Priority line or aerial crossing. Compliance Status: NA d. 15A NCAC 02T .0403(a)(6): Requires that the permittee or its representative conduct a general observation of the entire wastewater collection system at least once per year. Observations: The onsite representative Matt, showed us records that the pump station is checked twice a day and documented. All other activities are documented in the logbook, such as grease trap cleanout and when Gopher Utilities services the pumps. Compliance Status: Compliant. e. 15A NCAC 02T .0403(a)(7): Requires that overflows and bypasses from the system be reported to the Division's Mooresville Regional Office in accordance with 15A NCAC 02B .0506(a), and that public notice must be provided as required by G.S. 143-215.1C. Observations: The system has not had any reportable spills. The NC regulations and statutes, which cover the reporting requirements for SSOs, are found in NC Administrative Code 15A NCAC 02B .0506(a) and NC General Statute 143- 215.1 C, respectively. You may access the NC regulations online at the NC Office of Administrative Hearings (OAH) website at: http://www.oah.state.nc.us/rules/ and the NC General Statutes online at the NC General Assembly's website at: http://www.ncga.state.nc.us/gascripts/Statutes/StatutesTOC.pl. You may wish to review them to ensure you are fully familiar with all requirements. When reporting SSOs to DWQ, you must call the Mooresville Regional Office (MRO) at 704-663-1699 during normal business hours. If outside normal business hours, you must report the spill to the NC Division of Emergency Management at 1-800-858-0368. Please note that all reportable SSOs must be reported within 24 hours of the occurrence, or first knowledge, of the SSO. Please also note that voice mail or faxed messages are not considered as the initial verbal report. You must talk to and report the spill to a live person. Compliance Status: Compliant f. 15A NCAC 02T .0403(a)(8): Requires that a grease control program be developed and implemented as follows: g. 1. For privately owned collection systems, the Grease Control Program shall include at least bi-annual distribution of grease education materials by the owner or representative. Observations: The pump station inspected only services the restaurant that has a grease control program in place. Compliance Status: Compliant 15A NCAC 02T .0403(a)(10): Requires that documentation be kept for all activities you undertake to comply with the requirements of 15A NCAC 02T .0403, subparagraphs (a)(1) through (a)(9), for a minimum of three years, with the exception of the map, which shall be maintained for the life of the system. Also any new additions, subdivisions or phased development needs to be incorporated as well. Observations: Records were available. Do you have any of the inspection forms like you sent filled out? These would show that the required daily inspections of the pump station are being done. If a telemetry(phone) system is installed, then weekly inspections are required. I don't know of funding for private systems. Can you give me some feedback on anything that needs to be changed to be in compliance. L&L Environmental does our grease trap inspections and pumping every two months . We recently had an inspection from city water sewer Mecklenburg county with no issues found. We are currently pricing out a phone system that calls us when an issue occurs. Also do I need to send a hard copy or is the email fine. Just curious, are you aware of any special grants that help pay for lift station issues, as you can see we spend a lot of money in the past few years to keep everything running properly. Compliance Status: Non -Compliant 15A NCAC 02T .0403(a)(9): Requires that right-of-ways (ROW) and easements be maintained in the full easement width for personnel and equipment accessibility. Observations: There are no right of ways to maintain. The: system consists of a pump station and force main serving a restaurant. Compliance Status: Compliant 15A NCAC 02T .0403(a)(10): Requires that documentation be kept for all activities you undertake to comply with the requirements of 15A NCAC 02T .0403, subparagraphs (a)(1) through (a)(9), for a minimum of three years, with the exception of the map, which shall be maintained for the life of the system. Observations: Records are not being keep per the requirements of 15A NCAC 02T .0403. All of the above records should be kept for a minimum of three years. Compliance Status: Non -Compliant 4. In accordance with NC General Statute 143-215.6A, these violations are subject to civil penalty assessments not to exceed $25,000 per day, per violation. Your written response and the actions that you take to address these violations listed herein will be considered in deciding whether or not such penalties are necessary to compel compliance. 5. Corrective actions that should be taken for the above violations are as follows: a. Inspect the pump station daily and maintain records of these inspections. b. Maintain documentation of Operation and Maintenance. c. Documentation of grease education of employees. d. Records should be kept for a minimum of 3 years. Please provide documentation of the above items within 30 days. If any items are not available currently, then please provide documentation over the next six months documenting that they are now being done. Also, please take special note of the comments in each section of the inspection report for areas'which may need to be improved upon or addressed. This station location is critical in that any overflow would result in a direct discharge into Lake Norman (Catawba River). This station consists of one (1) submersible grinder pump (simplex configuration) with an audible / visible high water alarm and an auto -dialer alert notification system. The Collection System Permit (WQ0014177) specifies that the permittee operate only duplex pump stations. The operation of a simplex pump station at this location is inconsistent with the permit requirements and has been noted in previous inspections as a violation of the subject permit. Following the last inspection, CSI Property Management issued a response letter dated 11/14/2003. The response letter stated that the pump station was operating dual pumps and was now compliant. This was verified to be factually incorrect. Operating a simplex lift station again constitutes one (1) violation of the subject permit. The station must be reconfigured for duplex operation or a permit modification should be requested to more accurately reflect the existing collection system. She suspects its coming from Midtown. ACTION TAKEN 5/11/01 12:00 Called and spoke w/ Andy (mgr) at Mid -Town. I explained that we had received a complaint regarding a discharge from their restaurant going, into the lake. He said that he had no idea what it could be. I asked that he go outside and check the water around the restaurant. He agreed and said he would call me back after he looked at it. Received call back from Brian Decker, kitchen mgr. He said that one of their kichen workers had accidently spilled a used cooking grease container near the dumpster area. The grease ran into the storm drain and into the drainage ditch, then into Lake Norman. He said they did not know what to do so they put Dawn dishwashing liquid on the area and hosed it off. I explained that this was not the correct thing to do and they should have attempted to contain the spill and soak up the grease sheen in the lake. I explained that they needed to begin clean up immediately and remove all affected soil and absorb grease up that had reached the lake. He said they would start immediately. A MCDEP file review showed that the Mid Town Sundries restaurant had previously had several grease discharges including the following: 6/9/99 degreaser discharge to lake from cleaning dock, 6/18/99 Grease spill to lake from clogged grease trap, 6/5/00 grease spill to lake from clogged grease trap. Upon my arrival at the site, Ecosolve was present and conducting cleanup of drainage ditch. A very slight sheen was present on the lake surface and Ecosolve workers were removing affected soil. I spoke with Craig Blanks of Mid -Town. I explained that the grease discharges had to stop and Mid -Town needed to work on a prevention plan. He agreed and said they would do whatever necessary. I suggested they may want to look into installing a gate valve in the storm drain to contain spills on site. He said they would look into it. I told him that the restaurant needed to be thinking about how to prevent future discharges and that they may have to respond in writing to the State DWQ. 5/16/01 Called requesting party and left message regarding the status of situation. 5/21/01 Received call from requesting party. Explained that I was asking Mid Town to address how to prevent this from occurring again. Also called and talked to Julia Auten, Mgr. regarding the spill. Sewer Collection System June 9, 2003 AIDIDITIONAL COMMENTS RELATIVE TO ITEMS OF COLLECTION SYSTEM PUMP STATION/SIPHON REVIEW : The facility consists of a submersible pump station with duplex pumps, high water visible and audible alarm, and auto dialer. At the time of inspection, the ORC was not on site and the inspector was unable to test some pump functions (i.e., lead, lag float operation, alternator function). Some grease build up and debris accumulated in the wet well was observed that could impair pump function. The 24- hour notification sign is not in a readily visible location. The check valve box did not have a lock on it. Records indicate that the station has not been inspected since February of 2003 and only monthly until then. This is a violation of 15A NCAC 2H .0227 (d)(4) which states, " Pump stations that are connected to a telemetry system are inspected at least once per week". The pump station must be inspected on a weekly basis and in accordance with an operation and maintenance schedule. The valve vault drains into the wet well via a piped connection which could serve as a bypass mechanism. At the time of inspection, the ORC was not on site and the inspector was unable to test some pump functions (ie., 1ead, lag float operation, alternator function). Some grease build up and debris accumulated in the wet well was observed that could impair pump function. The 24- hour notification sign is not in a ready visible location. The check valve box did not have a lock on it. Records indicate that the station has not been inspected since February of 2003 and only monthly until then. This is a violation of 15A NCAC 2H .0227 (d)(4) which states, " Pump stations that are connected to a telemetry system are inspected at least once per week". The pump station must be inspected on a weekly basis and in accordance with an operation and maintenance schedule. The valve vault dramas into the wet well via a piped connection which could serve as a bypass mechanism. SCOPE OF SERVICE Carolina Lift Stations shall provide all personnel, equipment, and apparatuses necessary to satisfactorily operate and maintain the sewer pump station serving Midtown Sundries-Harborside restaurant Service shall be available twenty-four (24) hours per day throughout the year. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. A copy of the approved plans and specifications shall be maintained on fileby the Permittee for a minimum of five years from the date of the completion of construction. 9. The Permittee shall provide for the pump station and force main the following items: a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in the pump station, b. An air relief valve located at all high points along the force main, c. A screened vent for the wet well, d. Fillets located in the wet well at the intersection of the flooring and sidewalls, e. Three feet of cover (minimum) over the force main or the use of ferrous material where three feet cannot be maintained, f. Sufficient devices which will protect the pump station from vandals, and g. Flood protection if the pump station is located below the 100-year flood elevation. 12. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division,,such as the construction of additional or replacement wastewater collection facilities. 13. NONCOMPLIANCE NOTIFICATION: The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704)663-1699 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.;. or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. 2 Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence.
