Applicant is making two requests concerning the pounds per day limits for total suspended solids and the 90% effluent concentration for the acute toxicity testing. Both requests can be found on page 4 of the application under item 15. The current permit as well as the renewal application reflects that there are 4 outfalls. It should be noted, however, that this facility has only one point of discharge (currently identified as outfall 004) to a receiving stream. This office requests that the renewed permit reflect only one discharge location and that all parameters including flow be associated with it. Another option would be to decrease the frequency of flow monitoring for the other outfalls to weekly instead of continuous. Also, permit information in BIMS currently shows that this facility's permitted flow is 5,000,000 gpd, which obviously needs to be corrected. A review of compliance data from BIMS for the period beginning January 2004 through May 2006 revealed five limit violations for varying parameters. A copy of the violation report from BIMS and the most recent compliance inspection report dated December 8, 2005 is attached. No special conditions, limitations or monitoring are suggested at this time. In keeping with current basin -wide strategy; the Fayetteville Regional Office recommends that this permit be renewed with consideration given to the above requests.
