general land use in the vicinity of the project is a mix of rural and forested land with some agriculture

Tar Pamlico Buffer Authorization Approval (DWQ #06 0658) for the residential infrastructure associated with the project
and on September 4 2007 Crescent Resources received a Tar Pamlico Buffer Authorization Approval for the residential
piers and boat ramp (DWQ EXP N 06 06580) Compensatory mitigation was required for the original Hidden Lake
Subdivision please see attached NCEEP Receipt for stream wetland and riparian buffer mitigation

Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
The boat ramp will be designed to follow the natural contours of the land and to be as indistinguishable as possible
Grasspave2 is proposed for the boat ramp above the natural water level /Ordinary High Water Mark (OHWM) and
into the riparian buffer The Grasspave2 porous pavement system will be utilized in order to minimize buffer impacts
and maximize infiltration and vegetation growth A concrete ramp is proposed below the natural water level
(OHWM) The lake water will be drawn down by 1 foot temporarily for the construction of the Grasspave2 system
The developer has restricted the lake to canoes kayaks and small electric boats
Previous Riparian Buffer Authorization in 2007 authorized the construction of individual piers for lake front property
owners All piers are to be constructed from the water either manually in shallow areas or from a barge in deeper
parts of the lake Currently it has been determined that floating piers are also an option for lake front property
owners As with the previously authorized fixed piers the floating piers would be constructed from the water and
would not cause any impacts to jurisdictional waters

We have reviewed the Draft Internal Policy Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs document prepared by the NC Division of Water Quality on April 10 2004 version 2 1 The draft
states that many private developments are unlikely to cause cumulative impacts including projects such as urban in fill
most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations
Hidden Lake is a residential development that has already been constructed this request is solely for a boat ramp As
such these minimal impacts would not result in additional development or impact downstream water quality We
anticipate that if a qualitative or quantitative impact analysis is required the DWQ will advise

Authorization Certificate per the Tar - Pamlico River Buffer Protection Rules (15A NCAC 2B 0259)
with Additional Conditions — SECOND REVISION
Dear Mr Garrett
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0 2947 acres of wetland, 250 linear feet of perennial stream, 5 linear feet of
previously impacted temporary isolated stream, 01372 acres of open water and 26,592 square feet of
Zone 1 Tar Pamlico River basin protected riparian buffers and 24,205 square feet of Zone 2 Tar Pamlico
River basin protected riparian buffers to construct the proposed residential subdivision and commercial
site as described within your application dated April 17, 2006, and received by the N C Division of
Water Quality (DWQ) on April 17, 2006 with additional information received by the DWQ on May 9,
2006 After reviewing your application we have decided that the unpacts are covered by General Water
Quality Certification Number(s) 3494 and 3404 (GC3494 and GC3404) The Certification(s) allows you
to use Nationwide Permit(s) 3 and 14 (NW 3 and NW 14) when issued by the US Army Corps of
Engineers (USACE) This Certification replaces the Certification issued to you on June 5, 2006
This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian
buffers per 15A NCAC 2B 0259 In addition, you should obtain or otherwise comply with any other
required federal state or local permits before you go ahead with your project including (but not limited
to) Erosion and Sediment Control and Non - discharge regulations Also, this approval to proceed with
youir proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit. The Isolated Wetlands Permit will expire upon the
expiration date of IWGP100000 (September 30, 2008) or unless otherwise rescinded by the Director
of the Division of Water Quality
This approval is for the purpose and design that you described in your application Myou change your
project you must notify us and you may be required to send us a new application If the property is sold
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream compensatory mitigation may be required as described in 15A

1 Impacts Approved
The following impacts are hereby approved as long as all of the other specific and general
conditions of this Certification (or Isolated Wetland Permit) are met No other impacts are
approved including incidental impacts
Sediment and Erosion Control
2 Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards
a. The erosion and sedunent control measures for the project must be designed installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual
b The design, installation operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual The devices
shall be maintained on all construction sites borrow sites, and waste pile (spoil) protects,
including contractor -owned or leased borrow pits associated with the protect.
c Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all tunes
3 No waste, spoil solids or fill of any kind shall occur in wetlands waters or riparian areas beyond the
footprint of the impacts depicted in the 4041401 Permit Application All construction activities,
including the design installation, operation, and maintenance of sediment and erosion control Best
Management Practices shall be performed so that no violations of state water quality standards,
statutes or rules occur
4 Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable If placement of sediment and erosion control devices in wetlands and waters is
unavoidable they shall be removed and the natural grade restored within six months of the date that the
Division of Land Resources has released the protect,
5 Protective Fencing The outside buffer wetland or water boundary and along the construction corridor
within these boundaries approved under this authorization shall be clearly marked with orange warning
fencing (or similar high visibility material) for the areas that have been approved to mfrmge within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with IS NCAC 2H,

modified as appropriate to suit to this project
7 Culvert Installation
Culverts required for this project shall be installed in such a manner that the original stream profiles
are not altered Existing stream dimensions (including the cross section dimensions pattern and
longitudinal profile) must be maintained above and below locations of each culvert Culverts shall be
designed and installed to allow for aquatic life movement as well as to prevent head cutting of the
streams If any of the existing pipes are or become perched the appropriate stream grade shall be re
established or if the pipes installed in a perched manner the pipes shall be removed and re installed
correctly
Culvert(s) shall not be installed in such a manner that will cause aggradabon or erosion of the stream
up or down stream of the culvert(s) Existing stream dimensions (including the cross section
dimensions pattern and longitudinal profile) shall be maintained above and below locations of each
culvert
Placement of culverts and other structures in waters streams, and wetlands must be placed below the
elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches and 20
percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow
passage of water and aquatic life Design and placement of culverts and other structures including
temporary erosion control measures shall not be conducted in a manner that may result in dis-
equilibnum of wetlands or streambeds or banks adjacent to or upstream and down stream of the above
structures The applicant is required to provide evidence that the equilibrium shall be maintained if
requested in writing by DWQ
The establishment of native woody vegetation and other soft stream bank stabilization techniques
must be used where practicable mstead of np rap or other bank hardening methods If rip-rap is
necessary it shall not be placed in the stream bed, unless specifically approved by the Division of
Water Quality
Installation of culverts in wetlands must ensure continuity of water movement and be designed
to adequately accommodate high water or flood conditions
Upon completion of the project the Applicant shall complete and return the enclosed `Certificate of
Completion" form to notify NCDWQ when all work included in the §401 Certification has been
completed The responsible party shall complete the attached form and return it to the 401 /Wetlands
Unit of the NC Division of Water Quality upon completion of the project Please send photographs
upstream and downstream of each culvert site to document correct installation along with the
Certificate of Completion form
8 Diffuse Flow (No Review)
All constructed stormwater conveyance outlets shall be directed and mamtamed as diffuse flow at
non erosive velocities through the protected stream buffers such that it will not re- concentrate before
dischargmg into a stream as identified within 15A NCAC 2B 0233 (5) If this is not possible it may
be necessary to provide stormwater facilities that are considered to remove nitrogen This may require
additional approval from this Office

9 Compensatory Mitigation Using the Ecosystem Enhancement Program (EEP)
Mitigation must be provided for the proposed impacts as specified in the table below We
understand that you wish to make a payment to the Wetlands Restoration Fund administered
by the NC Ecosystem Enhancement Program (EEP) and donation of perpetual conservation
easements to meet this mitigation requirement This has been determined by the DWQ to be a
suitable method to meet the mitigation requirement. Until the EEP receives and clears -your check
(made Payable to DENR — Ecosystem Enhancement Program Office), and the EEP and DWO
anorove the conservation easement donation, no impacts saecMW in this Authorization

reissued or revoked prior to March 18 2007 It is incumbent upon you to remain informed of changes to the NWPs We will issue a public

relevant nationwide permit is modified or revoked you will have twelve (12) months from the date of the modification or revocation of the

Please review the 404 you issued and let me know which NWP you are issuing for the
open water, wetland and stream impacts associated with road construction for the
subdivision We applied for a NWP 14, but I could not find a reference to the specific
permit authorized except in the mitigation impact table However, the road impacts did
not have a permit number listed in the table on page 2 of the attachment DWQ issued
GC 3404, which corresponds to NWP 14

(15A NCAC 2B 0259) with Additional Conditions
Dear Mr Garrett.
You have our authorization, in accordance with 15A NCAC 02B 0259 and any conditions listed below
to unpact approximately 4,320 ft of Zone 1 and 2 880 f of Zone 2 of the protected riparian buffers for
the purpose of constructing the requested 44 individual lot piers and the boat ramp (201 Hidden Lake
Drive) at the subject property as described within your application dated August 28, 2007 In addition,
you should obtain or otherwise comply with any other required federal state or local permits before you
go ahead with your project including (but not limited to) Erosion and Sediment Control and Non
discharge regulations
This authorization is for the purpose and design that you described in your application If you change
your project, you must notify us and you may be required to send us a new application If the property is
sold, the new owner must be given a copy of this authorization letter and is thereby responsible for
complying with all conditions This authorization requires you to follow the conditions listed below

a The erosion and sediment control measures for the Project must be designed installed
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual
b The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor owned or leased borrow pits associated with the project
c For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained m accordance with the most recent version of the North Carolina
Surface Mining Manual
d The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act
3 No Waste Spoil Solids, or Fill of Any Kind
No waste spoil solids, or fill of any kind shall occur in wetlands waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre - Construction Notification All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices shall be performed so that no violations of state water quality
standards statutes, or rules occur
4 No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable If placement of sediment and erosion control devices in wetlands and waters
is unavoidable, they shall be removed and the natural grade restored within six months of the date
that the Division of Land Resources has released the project
5 Diffuse Flow
An additional condition is that all stormwater shall be directed as dfuse now at non - erosive
velocities through the protected stream buffers and will not re- concentrate before discharging into
the waterbody as identified within 15A NCAC 2B 0259(5)
6 Grasspave Operation and Maintenance Agreement
The signed and notonzed Operation and Maintenance Agreement (O &M) for the boat ramp
access Grasspave BMP dated August 31 2007 must be stnctly implemented and maintained in
perpetuity No changes to the BMP shall be made without written authorization from the Division
of Water Quality This O &M Agreement must transfer with the sale of the land, or there must be
a transfer of responsibility for the BMP and DWQ must be notified of the transfer
7 Protective Fencing
The outside buffer wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning fencing
(or smular high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities to ensure compliance with i SA
NCAC 2B 0259
8 Certificate of Completion
Upon completion of all work approved within this authorization and any subsequent
modifications, the applicant is required to return the attached certificate of completion to the 401

This letter completes the review of the "No Practical Alternatives" determination under I SA NCAC 2B
