LATON ENVIRONMENTAL DIVISION TEL: (919) 716-6963 FAX: (919) 716-6766 Dlaton@ncdoj.gov As you will recall, the e-mail communication of April 10, 2012 from City of Locust Administrator James Inman to Robert Krebs, and related correspondence was forwarded to me for review and comment. I offer the following interpretation of the controlling statutes and rules, and an analysis of case law for your consideration.' In short, I advise DENR that requiring two signatures on an application for new flows to the force main owned by Locust and Stanfield is correct. Therefore, if the City of Locust wishes to proceed with submission of an application for increased flows, DENR may require the application to be signed by authorized representatives of Locust and Stanfield. The "Intra-Governmental Agreement Between The Town of Stanfield and the City of Locust" (the Agreement) executed on or about March 19, 1997 provided, inter alia, for the funding and construction of a force main for sewage, ownership by each municipality of a fifty percent interest in the force main, and sharing in all costs of construction and maintenance. The City of Locust ("Locust") has expressed its understanding that as one of two fifty -percent owners Locust may submit a new flows application without the Town of Stanfield's ("Stanfield") assent. Stanfield's Town Administrator, Robert Harvey, disputes Locust's position and counters that the Agreement creating 50/50 ownership for the force main also requires a dual signature application from both municipalities.2 This letter of advice is the opinion of the writer. This letter has not been reviewed or approved in accordance with the Attorney General's procedure for issuing a formal opinion. 2 Stanfield's interpretation is expressed in an e-mail of April 9, 2012 from Robert Harvey to Rob Krebs & Barbara Sifford. l Parker Letter December 14, 2012 Page 2 As Locust has acknowledged, the ownership and possessory rights in the force main were created for Locust and Stanfield, each with a fifty percent undivided interest. Although both municipalities own an interest in the force main, the property itself cannot be divided. There is no portion of this system that clearly belongs to Locust only. Similarly, there is no portion clearly belonging only to Stanfield. While the municipalities' interests in the property may be divisible, the property itself is not. Since Locust and Stanfield are co -tenants, or at least in a relationship analogous to co -tenancy, neither can act on the commonly held property to bind the other if such action is not authorized in advance or subsequently ratified by the other. See Hinson v. Shugart, 224 N.C. 207, 210, 29 S.E.2d 694, 696 (1944). More specifically, the controlling North Carolina Administrative Code provision requires that an applicant for new flows actually be the receiving collection system's (i.e. the force main's) owner or that the applicant attach a "letter of agreement from the [force main's]owner" if the owner did not submit the application himself. 15A NCAC 2T.0304(h) (2012). This pertinent regulation provides that "the owner" (emphasis added) must take certain actions and make certifications in the application process. The regulatory language "the owner", as opposed to "an owner" suggests strongly that 15A NCAC 2T.0304 envisions "the owner" as a single entity. Furthermore, as a matter of statutory interpretation, N.C. Gen. Stat. §12-3 provides that a singular number can be applied to the plural noun and the plural number to the singular noun, unless doing so is contrary to the context of the statute being applied. In other words, "owner" includes two municipalities with identical property interests in a collection system. There is no qualifying provision in either the NCAC or the Application that requires DENR to accept an application from an owner of e.g. "an undivided interest in the force main." The most rational readingof the germane documents is to require an application with dual signatures representing that both Locust and Stanfield consent. Requiring an authorized signature from Locust and Stanfield is further strengthened by the absence of any language within the Agreement granting authority to one municipality to act as the other's agent. In conclusion, DENR would be acting within the plain meaning of the regulatory language and reasonably exercising its authority to interpret the regulations it is mandated to administer by requiring Locust and Stanfield to sign the application for new flows to the collection system. The 15A NCAC 18A 1937 are the rules associated with ground absorption sewage disposal and treatment. They should be able to answer his questions. Barbara, Sometimes the answers are simple when looking at the rules that regulate us. Take the following two; 1.State Public Health Law § 130A-65. Liens for sewer service charges in sanitary districts not operating water distribution system; collection of charges; disconnection of sewer lines. In sanitary districts which maintain and operate a sewage system but do not maintain and operate a water distribution system, the charges made for sewer service or for use of sewer service facilities shall be a lien upon the property served. If the charges are not paid within 15 days after they become due and payable, suit may be brought in the name of the sanitary district in the county in which the property served is located, or the property, subject to the 1ien,_may be sold by the sanitary district under the same rules, rights of redemption and savings as are prescribed by law for the sale of land for unpaid ad valorem taxes. A sanitary district is i authorized to adopt rules for the use of sewage works and the collection of charges. A sanitary district is authorized in accordance with its rules to enter upon the premises of any person using the sewage works and failing to pay the charges, and to disconnect the sewer line of that person from the district sewer line or disposal plant. A person who connects or reconnects with district sewer line or disposal plant without a permit from the sanitary district shall be guilty of a Class 1 misdemeanor. (1965, c. 920, s. 1; 1983, c. 891, s. 2; 1993, c. 539, s. 949; 1994, Ex. Sess., c. 24, s. 14(c).) 2.Title 15A 15A NCAC 18A.1937 Permits: (a) Any person owning or controlling a residence, place of business, or place of public assembly containing water -using fixtures connected to a water supply source shall discharge all wastewater directly to an approved wastewater system permitted for that specific use. Question;Should a municipality exerting their authority given by State law properly notify the water service provider that the residence, business,etc. is no longer connected to an approved wastewater system be required to disconnect the water service as required by their water distribution peiinit (compliance with Title 15A NCAC 18A.1937 Permits) ? Thanks, Bob Harvey 2 safety and health issues. When we disconnect the pump the raw sewage will pump onto the ground out the vents if the water is not disconnected to the house. I few savvy customers have figured this out and are keeping the water billed paid to the county as they know the Town would be put into position of having raw sewage dumping onto the ground. We are in a catch22 when the county will not assist. We also have this problem when Duke power disconnects the electricity to the house and the tenant's continue using the water and the pump does not have power. This creates a spill out the vents once the tank fills.Again the only solution is to disconnect the water to turn the sewer flow off. The Town council feels that Stanfield as an incorporated town in the state of North Carolina and currently allowingthe county to serve with a water distribution system within our corporate limits, that we have and must disconnect individual water customers when the need arises. We feel that we have a duty to collect for the sewage service and should we exercise our right to disconnect sewer the water must be turned of due to Health and Safety issues not to mention the power issues with grinder pumps. Bottom line it appears the the Health,Safety and environmental issues and excerpts from 15A and the permits issued for our sewer collection system and the federal Clean Air and Water act give us our authority to protect the environment citizens health & Safety issues not to mention compliance with all the laws/regs. The only reasonable way we can see to disconnect sewer service for any reason is to cut the flow (water) off. We are preparing an Town Ordinance and any help DENR could give in this matter would be appreciated. We are not seeking any legal opinions rather the tenants based in your understanding of the environmental issues and concurrence that the flow must stop should the sewage collection system to the house be inoperable for any reason. Sullins, Director Division of Water Quality This letter is to inform you of the Division of Water Quality's new policy concerning sewer collection issues. In the attached Press Release you will note the use of the word "will" in regards to issuing Notices of Violation (NOVs) for Sanitary Sewer Overflows (SSOs). The intent of that statement was to make sanitary sewer system owners and operators aware that each SSO will be evaluated on a case -by - case basis to determine if a NOV is warranted. The statement was not intended to indicate that inall cases an. NOV will be issued without a review of case specific factors. You may have also noted a second statement using the word "will" regarding the issuance of civil penalties. Civil penalties are only issued based on case -specific factors that include, but are not limited to the following: volume, volume reaching surface waters, duration, gravity, impacts to public health, fish kills or recreational area closures. Again, the statement is not intended to indicate that in all cases a civil penalty assessment will be issued without review. of case specific factors. In addition, the Division is requiring a Flow Tracking/Acceptance for Sewer Extension Permit Applications Form (FTSE-10/07). A revised form is enclosed. Effective January 15, 2008, this form must be completed by the owner of the receiving WWTP and submitted with all applications for sewer line extensions. Additional forms may be required if entities other than the owner of the WWTP own pump stations along the route of the proposed wastewater flow. These entities would certify and submit the additional forms. Applications received after the implementation date that fail to include this information will be returned immediately as incomplete. Section I, (d) of the FTSE-10/07 requires an estimate of the obligated flow not yet tributary to the WWTP. Reviewing flow allocations made over the last two years, WWTP owners must reconcile their flow records, to the best of their ability, so it is known how much flow has been obligated, but not yet made tributary to the WWTP. Submit FTSE-10/07 to the Mooresville Regional Office with Section I, (a) — (e) completed by January 15, 2008. Please note that items (a) — (h) in Section I, will be completed for future sewer extension applications. The Permittee shall assess cleaning needs, and develop and implement a program for appropriately cleaning, whether by hydraulic or mechanical methods, all sewer lines. At least 10 percent of the wastewater collection system, selected at the discretion of the ORC, shall be cleaned each year. Preventative cleaning is not required for sewer lines less than five years old unless inspection otherwise reveals the need for cleaning or cleaning is required by a sewer line extension permit. 9. Adequate measures shall be taken to contain and properly dispose of materials associated with SSOs. Any monitoring (including, but not necessarily limited to, wastewater flow, groundwater, surface water, soil or plant tissue analyses) deemed necessary by the Division to ensure surface water and groundwater protection will be established, and an acceptable sampling and reporting schedule shall be followed. 2. The Permittee shall verbally report to a Division of Water Quality staff member at the «Admin_Region» Regional Office, at telephone number «Regional_Phone» as soon as possible, but in no case more than 24 hours following the occurrence or first knowledge of the occurrence of either of the following: 5 DRAFT PERMIT NUMBER«Permit_Number» 11/06 a. Based on the A/E's certification in the Permit Application that all 15A NCAC 2H .0200 requirements regarding gravity sewers and force mains, and the Division of Water Quality's Gravity Sewer Minimum Design Criteria adopted February 12, 1996 have been met, a review of these items has not been performed. It shall be the permittee's responsibility to ensure the plans and specifications meet the appropriate design criteria and rules. Final approval of these documents will not imply approval of any variance from these criteria unless specifically requested and granted. Failure to comply may result in penalties in accordance with North Carolina General Statute 143-215.6A— 143-215.6C, construction of additional facilities, and/or. referral of the N.C. Professional Engineer to the licensing board. 2. Provide the pump station design info as requested in the Application, Part V.5. 3. Provide the lengths of vacuum sewers by size to be permitted. (Application Part V.6) 4. Provide buoyancy calculations for the pump station, vacuum valve tanks, and buffer tanks. The E-One ballast calculations are not acceptable as they do not follow DWQ requirements (see Min. Design Criteria for PS & FM). 5. A copy of the reliability policy for single-family pump stations is attached. The E-One wetwell holds only 70 gallons or about 4 hrs and 40 min of storage. The largest power outage is given as 5.5 hrs. The response time to replace a failed pump is not addressed. It is strongly recommended that an after market wetwell along with the E-One after market pump be utilized. This pump has the same operating characteristics as the standard E-One pump. 6. Provide a schematic of the pressure sewer layout showing the zones, elevations, etc used in the model. 7. The computer model appears to show 2 interconnecting zones. The plans appear to show 2 separate non -related zones. Please clarify. 8. Provide calculations showing how the flow per residence was determined for the vacuum system calculations. The peak flow of .75 gpm per residence given on Page 1 does not agree with the .63 gpm shown on Page 6. 9. Provide revised pressure sewer and vacuum sewer calculations using a 'C' of 130. 10. The forcemain lengths shown in the model do not agree with those shown in the Application, Part V.6 (Zone 2 = 325 ft in the model & 250 ft in the Application). Also the plans show 525 feet in zone 1 and 240 feet in zone 2. Please clarify. 11. Clearly distinguish between new lines and existing lines in the vacuum sewer model. 12. Page 6 of the calculations appears to show only 49 total homes on the system. The application is for 50 homes. Please clarify. 13. Provide a schematic of the vacuum system clearly delineating the longest run used in the design. Specifications 1. The specifications appear to include many items not used on this project. It is recommended that any non -applicable sections be deleted to minimize confusion and possible higher that necessary bids. 2. Section 7, Part 7.04 (b) - The 30 day waiting period for the deflection test can be waived if the backfill is compacted to 95% maximum density (testing records required.). 3. Section 8, Part 8.02.1 (a) (15) - All water removed by dewatering operations shall be disposed of in accordance with the NC Sedimentation Pollution Control Act. 4. Project Specifications Grinder PS, Part 5.01 - Provide 1 spare per 10 installed units rather than 1 per 25 5. The specifications do not address the separation requirements between the sewer lines and other utilities. 6. Specifications are not included for the pressure sewer force main. If the water main specifications are to be used for the pressure sewers, they should be clearly noted as such. 7. The specifications do not appear to address the installation of pipe in the deep cuts required for this project. Standard lay back of the trench will cause considerable disruption to traffic or the adjacent project. Provide directions to the contractor for installation in these areas. It is recommended that the transition point between pressure sewer and vacuum sewer be reevaluated to minimize these deep cuts. Plans 1. Sheet 2, General Note 1 - Provide the phone number for North Carolina One Call. 2. Provide match lines between plan sheets. 3. Sheet 3 - Provide end of line cleanouts on the vacuum lines. Policy for Meeting the Reliability Requirements of 15A NCAC 2H .0219(h)(2) and (3) for Pressure Sewers Utilizing Simplex Pump Stations These rules require that multiple pumps be provided with the capacity to pump peak flow with the largest pump out of service and to provide power reliability respectively. Simplex pump stations will only be approved for single family residences, all other pump stations shall be required to meet these rules. To help ensure protection from overflows for simplex pump stations, the following policy will be implemented in lieu of requiring dual pumps and power reliability. The first option for meeting reliability requirements is to provide 24 hours storage in the wet well above the pump -on elevation as requested in the permit application. However, since this may add to the cost and make installation difficult in certain areas, another option may be pursued. Alternatively, the applicant may provide documentation regarding both power reliability and response times for pump replacement. In the case of power reliability, 3 years of power history data in the area from the power company must be provided. The amount of storage required shall be equal to the duration of the longest power outage (minus catastrophic events such hurricanes). Storage shall be provided above the pump -on elevation. Note: For class C waters, this is not a variance to the rules. For response times, the applicant shall provide an estimate of the response time to replace a failed pump. The estimate shall include time for answering after hours calls, travel time to maintenance shop, preparing equipment to respond, travel time to site, and time to replace the pump. For existing systems, the Permittee should indicate if they currently maintains a supply of pumps on hand at this time (a permit condition). Also, personnel must be on -call 24 hours a day, 7 days a week as well as a phone number with 24-hour answering service clearly posted on the pump station. Storage shall be provided above the high water alarm. These storage requirement are not cumulative, rather, the storage which provides the largest wet well shall be specified. The modification to this permit is to include the construction and operation of an additional 435 linear feet of 8-inch gravity sewer to serve retail businesses. This permit shall be effective from the date of issuance until rescinded, shall void Permit No. WQ0016070 issued March 28, 2000, and shall be subject to the conditions and limitations as specified therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein by reference. Please pay particular attention to Permit Condition 3 which requires that the wastewater collection facilities be properly operated and maintained in accordance with 15A NCAC 2H .0227 or any individual system- wide collection system permit issued to the Permittee. Permitting of this project does not constitute an acceptance of any part of the project that does not meet 15A NCAC 2H .0200; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; and the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable, unless specifically mentioned herein. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This permit shall become voidable unless the wastewater collection facilities are constructed in accordance with the conditions of this permit; 15A NCAC 2H .0200; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting materials unless specifically mentioned herein. 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system -wide collection system permit for the operation and maintenance of these facilities as required by 15A NCAC 2H .0227. If an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2H .0227: a. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed prior to January 1, 2004 and shall be actively maintained. c. An operation and maintenance plan shall be developed and implemented. d. Pump stations that are not connected to a telemetry system shall be inspected at least three times per week until July 1, 2000; thereafter, pump stations shall be inspected at least daily, as defined in 15A NCAC 2B .0503(5), until July 1, 2001; and thereafter, pump stations shall be inspected every day. Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High -priority sewer lines shall be inspected at least once per every six-month period of time. f. A general observation of the entire sewer system shall be conducted at least once per year. g. Inspection and maintenance records shall be maintained for a period of at least three years. h. Overflows and bypasses shall be reported to the appropriate Division regionaloffice in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided asrequired by North Carolina General Statute § 143-215.1C. 4. This permit shall not be transferable. In the event there is a desire for the wastewater collection facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 1 5. Construction of the gravity sewers, pump station(s), and force main shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 6. Upon completion of construction and prior to operation of these permitted facilities, a certification, a copy of the construction record drawings, as well as supporting design calculations for any pump stations permitted as part of this project shall be received from a North Carolina -licensed Professional Engineer certifying that the facilities have been installed in accordance with this permit; 15A NCAC 2H .0200; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Main adopted June 1, 2000 as applicable; and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. A copy of the construction record drawings, indicating the facilities constructed in the phase being certified, shall be submitted with each partial certification. Mail the Engineer's Certification, one copy of the "Construction Record Drawings", and one copy of the supporting design calculations to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. 7. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of the wastewater collection facilities. 8. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2H .0200; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statutes §143-215.6A through §143-215.6C. 9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement facilities. 10. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (local, state and federal) which have jurisdiction. including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 11. The Penniittee shall provide for the previously permitted pump station and force main the following items: a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in the pump station, b. An air relief valve located at all high points along the force main, c. A screened vent for the wet well, d. Fillets located in the wet well at the intersection of the flooring and sidewalls, e. Three feet of cover (minimum) over the force main or the use of ferrous material where three feet cannot be maintained, f. Sufficient devices which will protect the pump station from vandals, and g. Flood protection if the pump station is located below the 100-year flood elevation. 12. The facilities shall be constructed in accordance with the requirements of the North Carolina Sedimentation Pollution Control Act. 13. Any abandoning of the existing facilities must be done in accordance with the requirements of the Division of Water Quality's Mooresville Regional Office. 2 14. Noncompliance Notification: The Permittee shall report by telephone to the Mooresville Regional Office telephone number (704) 663- 1699 as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater collection facilities. 13. NONCOMPLIANCE NOTIFICATION: The Permittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-1699, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. 2 Persons reporting such occurrences by telephone shall also file a written report in letterform within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 14. This permit shall become voidable unless the agreement between the Town of Stanfield and the Town of Oakboro for the collection and final treatment of wastewater is in full force and effect. These are designated by permit numbers starting with WQ. The Town has not yet been asked to submit for the system -wide collection system permit which focuses on operation and maintenance on the entire system. This permit number will start with WQCS. In discussion with Ms. Campbell, we are still unclear as to whether the information you received indicating your system was a Class I system was an informational item from someone or a formal letter from our Technical Assistance and Certification Unit (TACU). If this was a formal classification letter from TACU, you would complete the Operator Designation Form for the main and back-up ORCs and submit it to the address on the form. The TACU will then associate the operators with the Town of Stanfield Collection System. If the information was not a letter from TACU, then your collection system has not yet been classified and you are not yet required to designate operators to us at this time. To accurately track this, I've gone ahead and registered the collection system for Stanfield to create a tracking number. Your planned collection system ID and future permit number is WQCS0032'.
