The Division's Mooresville Regional Office concludes that the Water and Sewer Authority of Cabarrus County violated Permit Condition I (2) of Permit No. WQCS00009 by failing to effectively manage, maintain, and operate their collection system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO constituted making an outlet to waters of the State for purposes of G S. 143-215.1(a)(1), for which a permit is required by G.S 143-215.1. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. This office requests that you respond to this Notice, in writing, within 10 business days of its receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other actions taken to prevent the recurrence of similar situations. The response to this correspondence will be considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance. Concord, NC 28027 704.786.1783 • 704.795.1564 Fax www.wsacc.org WSACC is in receipt of the NOV for a Sanitary Sewer Overflow near 2001 Mount Pleasant Road South, Mount Pleasant, NC. Below is a summary of background information and steps taken as a result of the overflow: 2001 Mount Pleasant Road South Force Main Failure and Spill - The wastewater spill occurred due to the failure of an 8" PVC force main downstream of the Mt. Pleasant Pump Station #1. The force main was installed in 1981 and has been in continuous operation over the past 40 years. - The spill was discovered by a WSACC employee during annual mowing of the force main right-of-way at 12:00 pm on 1/7/2021. WSACC deployed a crew to the scene with WSACC's excavator, but was unable to excavate to the line that afternoon due to the depth of the line. WSACC then contacted BRS for assistance. BRS visited the site on the afternoon of 1/7/2021 and reviewed the problem with WSACC personnel. BRS established that their first availability to excavate and repair the line would be on the next morning (1/8/2021). WSACC requested that BRS move forward with mobilizing personnel and equipment to the site for the repair as soon as possible. WSACC personnel also checked with other local contractors, but were unable to locate a contractor with faster availability to make the repair. - BRS mobilized to the site on 1/8/2021, and excavated and identified the failed section of line was a crack in the 8" PVC bell section. BRS subsequently removed and replaced the failed section of line on 1/8/2021. - WSACC restarted the pump station on 1/8/2021 and confirmed no subsequent leakage from the repair area. - WSACC monitors this line on a regular basis and will continue to be proactive in watching for any leaks or needed repairs. WSACC will continue to monitor these areas along with other areas throughout our system. WSACC will also continue to be proactive to protect our facilities and to take all steps possible to prevent future spills. Please let me know if you have any questions.
