Reference is made to your request for rescission of the subject Wastewater Recycling Permit:_
Staff from the Mooresville Regional Office has confirtned that this Permit is no longer required.
Therefore, in accordance with your request, Wastewater Recycling Permit No. WQ0002972is
rescinded, effective immediately.
If in the future, you wish again to operate a non -discharge system, you must first apply for and
receive a neww° Wastewater Recycling Permit. Operating a non -discharge system without a valid
Wastewater Recycling Permit will subject the responsible party to a civil penalty of lip to

Request to Rescind Permit
Dear Mr. Hardee,
Cemex Construction Materials, LT. on February 10, 2006 requested a modification to the
Stallings Wastewater Recycling Permit for a change of owner/operator, from RMC Mid -
Atlantic to Cemex Construction Materials, L.P. At this time, Cemex has ceased all ready -
mix operations at the Stallings plant location and all associated equipment has been
moved out of the site. The plant has not been in operation since 2004.
The only operation left at the site is a retail office for concrete products, i.e. block,
building materials, etc, This matter was discussed via phone with Ms. Chonticha
McDaniel of your staff. There are no future plans to, open a ready mix operation at
Stallings and all related equipment and residues associated with the wastewater recycling
system are not longer on -site,
Based on the above, it is hereby requested that Pen -nit 72 be rescinded

This permit shall be effective from the date of issuance until January 21, 2007, shall void Permit No. WQ0002972
issued July 29, 1994, and shall be subject to the conditions and limitations as specified therein, Please pay particular
attention to the monitoring requirements in this permit. Failure to establish an adequate system for collecting and
maintaining the required operational information will result in future compliance problems.
If any harts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (0) days following receipt of this permit. This request must be in the
form of a written petition, conforming to Chapter 150B of North Carolina General Statutes, and filed with the Office of

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended,
and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

I This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data,

1 The facilities shall be properly maintained and operated at all times.
4This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the Division of Water
Quality (Division) accompanied by an application fee, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of the request will be considered on its merits
and may or may not be approved.
5, In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee, shall take immediate corrective action, including those actions that may be required by this
Division, such as the construction of additional or replacement treatment or disposal facilities.
6e residuals generated from these treatment facilities must be disposed in accordance with General Statute
143- 215 . I and in a manner approved by the Division.

T The issuance of this pen -nit shall not relieve the Permittee of the responsibility for damages to surface or
groundwaters resulting from the operation of this facility,
& The facilities shall be effectively maintained and operated as a non -discharge system to prevent the
discharge of any wastewater resulting from the operation of this facility.
9Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the settling basin shall not be less than two feet at nay time.
11. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be
established and an acceptable sampling reporting schedule shall be followed,
11 Adequate inspection, maintenance, and cleaning shall be provided by the Pennittee to insure proper
operation of the subject facilities,
11 The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and
deterioration, operator errors and discharges which may cause or lead to the release of wastes to the
environment, a threat to human health, or a nuisance. The Pennittee shall maintain an inspection log or
summary including at least the date and time of inspection, observations made, and any maintenance,
repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the
Permittee for a period of three years from the date of the inspection and shall be made available to the
Division or other permitting authority, upon request.
14. Any duly authorized officer, employee, or representative of the Division may, upon presentation of
credentials, enter and inspect any property, premises or place on or related to the recycle system at any
reasonable time for the purpose of determining compliance with this permit, may inspect or copy any
records that must be maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate.
15. The annual administerin0 g and compliance fee must be paid by the Permittee within thirty (30) days after
being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to
revoke this permit as specified by 15A NCAC 2H .0205 (c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee. to an
enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
17. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the Pennittee for the
life of this project.
19. Noncompliance Notffication:
The Pentrittee shall report by telephone to the Mooresville Regional Office, telephone number (704) 663-
1699, as soon as possible, but in, no case'more than 24 hours or on the next working day following the
occurrence or first knowledge of the occurrence of any of the following:
a. any,occurrence at the wastewater treatment facility which results in the treatment of significant
amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents
of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other
unusual circumstances;

b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of
adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators,
compressors, etc,;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to
receiving waters without treatment of all or any portion of tire influent to such station or facility; or
d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit
limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5)
days following first knowledge of the occurrence. This report must outline the actions taken or proposed to
be taken to ensure, that the problem does not recur.
20. Upon classification of the facility by the Water Pollution Control Systems Operators Certification
Commission (WPCSOCC), the Pennittee shall employ a certified wastewater treatment plant operator to be
in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of
the type and grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the WPC.SOCC. The Permittee must also employ a certified back-up operator of the
appropriate type and grade to comply with the conditions of 15A NCAC 8G .0202. The ORC of the facility
must visit each Class I facility at least weekly and each Class 11, 1,11, and TV facility at least daily, excluding
weekends and holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of 15A NCAC 8G.0202.
2L The Pert-nittee, at least six (6) months prior to the expiration of this permit, shall request its extension.
Upon receipt of the request, the Commission will review the adequacy of the facilities described therein,
and if wan -anted, will extend the permit for such period of time and under such conditions and limitations,
as it may deem appropriate,

6. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions„ the Permittee shall take ininiediate corrective faction, including those as

wastewater treatment: or disposal facilities.
7. The Mooresville regional Office, phone no. 7 416> shall be notified at least
forty-eight ) loans in advance of operation of the insualled facilities so that tin in -place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from :00 a.m. until 5;00 p.m. on Monday through Iiriday,
excluding State Holidays.

General Statute 143- 15.1 and in a manner approved by the North Carolina 'Division of
Environmental Management.
9, ' 'he issuance of this pe lit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaaers resulting from the operation of this facility,
10, The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resultingfrom the operation of this facility.
11. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
1 . Freeboard in the settling basin shall not be less than tvvo feet at any urne.
13. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and all acceptable sampling
reporting schedule shall be followed.
14. Adequate inspection, maintenance, and cleaning shall be provided by the Pernaittee to
insure proper operation of the sul sect facilities.
15The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Perrraittee shall keep an inspection lop or surninary including at least the, date and time of
inspection, observations made, and any maintenance, repairs, or corrective factions taken
by the Perzrrittee. This log of inspections shall; be maintained by tile perrnittee;;for as period
of``three years; from the date: of the inspection and shall be made available upon request to
the Division ion of Environmental Management or other permitting a utFrt rl�
16any duly authorized officer, employee, or representative ofthe Division of Environtr'tental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site and facility at any reasonable tinge for the
purpose of determining compliance with thispermit; may inspect or copy any records that
must bo kept tinder the terms and conditions of this permit; or nnay° obtain saarnples of
groundwater, surface water, or leachate:.
17, The annual administerin�ty and corilpliatnce fee must be ptald by the PerTnittee within thirty
(3ll) days after lacing billed by the Division, l°z.rilure, to pay the fee a cordiragly Treaty, Cause
the Division to initiate action to revoke this, pennit as specifies by 15 l CAC_ 211 020
(C)(4).
I& Failure to abide by the conditions, and limitations contained in this permit may subject the
Permittee to an enforcerticrit action by the, Division of Environmental Management in
accordwice with North Carolina General Statute 143-215.6.
19. The issuance of this perrnit does not preclude the Perinittee from complying with any and,
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
20. A set of approved plans and specifications for the subject project must be retained by the
Pernrittee. for the life of this prQject,
21. Noncompliance Notification:

telephone no. (704) 663-1699, as soon as possible, but in no case rnore than 24 hours or

a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant arnounts of wastes which are abnormal in quantity or characteristic, such
as the durnping of the contents of at basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances,

discharge of wastes to the surface waters, pursuant to the application received January 18, 1,990
and in conformity with the project plan, specifications, and other supporting data subsequently
filed and approved by the Department of Environment, Health and Natural Resources and
considered a part of this pennit.
This pertint shall be effective from the date of issuance until January 31, 1995 and shall be
subject to the following specified conditions and limitations:
Ia "his permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting
data.
1 This pertnit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be, Properly maintained and operated at all times.
4. This permit is not transferable, In the event there is a, desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation frorn the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5 Upon completion of construction and prior to operation of this permitted facility, a
certification must be, received from a professional engineer certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, Mail the Certification to the Permits and Engineering Unit, P.O. Box
27687, Raleigh, NC 27611.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective actions including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.

14. Adequate inspection, maintenance, and cleaning shall be provided by the Pernaittee to
insure proper operation of the subject facilities:
1.,5, The Pennittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may= cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Pe nittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
16Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the disposal site and facility at any reasonable time for the
purpose of determining compliance with this pen -nit; may inspect or copy any records that
must be Dept under the terms and conditions of this permit; or may obtain samples of
groundwater, surface water, or leachate:,
17. The annual administering and compliance fee rarest be paid by the Permittee within thirty

16. Fadure. to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 1 - 1 . 1a to 1 - 15. tc, ,
17. The issuance oft this permit does not preclude the Permittee from complying with any and
all statutes, roles, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.
1 Noncompliance Notification:
The Pennittee shall report by telephone to the Mooresville Regional Office, telephone
number tt 00-1, as soon as possible, but in no case more than hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the following:
as Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the thrown passage of a slug ;of
hazardous substance through the facility, or any tither unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
humps, aerators, compressors, etc.
c . Any failure of a pumping station, surer line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to
such station or facility; or
d. Any time that self -monitoring information indicates that the facility is not in compliance
with its permit limitations. ;
Persons reporting such occurrences by telephone shall also file a mitten report in letter'
form within 15 days following first knowledge ofthe occurrence. This report must outline
e actions taken or proposed to be taken to ensure that the problem does not recur.
0The Pertnittee, at least six l months prior` to the expiration of this permit, shall request its
extension,, Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
d tinder such conditions and 'limitations as it may eerie appropriate.
