This is the analytical report for the above referenced
project. n March 23,. 1992 we received two soil samples for
analysis. The analytical and quality control results are presented
in separate tables for, your convenience. Brief summaries of
analytical methods employed are as follows.

Samples are analyzed by following the California U.S.T.
manual. This methodology incorporates EPA purge and trap (meth.,
3 techniques for analysis of volatile fuels such as gasoline.
Less volatile fuels such as diesel fuel and kerosene must he
extracted using solvents prior to analysis (snails are scnicat:ed,
meth. 3550). A standard al i at ion curve is created from the pure
fuel of interest. The standards serve two functions; they create;
a "fingerprint" pattern for comparis ns and they allow the cher i�st
to calculate the. concentration f that fuel analyzed for.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
HATCHER REALTY

FOR THE
construction and operation of a petroleum contaminated soils disposal system consisting of
disposing of approximately 492 cubic yards of petroleum contaminated soil from Hatcher Realty's
former Sunoco Station in Mecklenburg County to a 53,136 square foot disposal area located along
Highway 74 outside of Indian Trail in Union County with no discharge of wastes to the surface
waters, pursuant to the application received September 25, 1990 and in conformity with the
project plan, specifications, and other supporting data subsequently filed and approved by the
Department of Environment, Health and Natural Resources and considered a part of this permit,

1. PERFORMANCE STANDARDS
E The Mooresville Regional Office, phone no. (919) 663-1699, shall be notified at
least twenty-four (24) hours after land application of the contaminated soil so that
an inspection can be made. Such notification to the regional supervisor shall be
made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday
through Friday, excluding State Holidays,
2. This permit shall become voidable if the soils fail to adequately assimilate the
wastes and may be rescinded unless the facilities are installed, maintained, and
operated in a manner which will protect the assigned water quality standards of the
surface waters and ground waters.
3. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.
4, The issuance of this permit shall not relieve the Permittee of the responsibility for
damages to surface or groundwaters resulting from the operation of this facility.

OPERATION AND MAINTENANCE REQUIREMENTS

The facilities shall be properly maintained and operated at all ties,

The Permittee shall employ a certified wastewater treatment plant operator to be in
responsible charge of the wastewater treatment facilities. The operator must hold a
certificate of the grade at least equivalent to the. classification assigned to the
wastewater treatment facilities by the Certification o ission.

The 492 cubic yards of contaminated sail shall be spread to a thickness not to
exceed 3 inches on at least 1.2 acres of land at the disposal site.
The facilities shall be effectively maintained and operated as a non -discharge system
to prevent the discharge of any wastewater resulting from the operation of this
facility„

The site shall be adequately limed to a soil pH of at least 6.5 prior to disposal of the
contaminated soil. The contaminated wail and lime shall be thoroughly incorporated
into the top six to eight inches of the native snails by tilling or dishing:.

Rate of fertilizer application should be the lesser of the following:
For nitrogen, the tolerance level of the vegetative crop, as determined by fa
knowledgeable party, or -100 pounds per acre plant available nitrogen
(PAN).
For phosphorus, the tolerance level of the vegetative crop, as determined by a
knowledgeable party, or 50-75 pounds per acre orequivalent).

to insure surface and ground water protection will be established and an acceptable
sampling reporting schedule shall be followed,
2. Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office
telephone no (91 66 -1699, as soon as possible, but to no case more than 24
lours or on the next working day following the occurrence or first knowledge of
the occurrence of any of the following:
a, Any occurrence with the land application program which results in the land
application of significant amounts of wastes which are abnormal in quantity or
characteristic.
b. Any failure of the land application program resulting in a discharge of wastes to
receiving- waters,

Persians reporting such occurrences by telephone shall also file a written report it
later form within 15 nays following first knowledge of the occurrence. This report
must outline the actions taken or proposed to be taken to ensure that the problem
does not recur.

Any groundwater quality monitoring as deemed necessary by the Division o
Environmental Mana ement shall be provided.

Adequate inspection, maintenance, and cleaning shall be provided by the Permittee
to insure proper operation of the subject facilities.:

The Permittee or designee shall inspect the contaminated soil area to prevent any
discharges which may cause or lead to the release of wastes to the environment, a
threat to human health, or a nuisance. The Permittee shall p an inspec4on log o
sunurtary including at least the dato and ti= of inspection, observations made, and
y maintenance, repairs, or corrective actions taken by the Permittee. This log of
inspections shall be maintained by the Permittee for a period of three years from the
date of the in ` tion and shall be made available upon request to the Division of
Environmental Management or other permitting authority.

Any duly authorized officer, employee, or representative of the Division of
Environmental Management may, upon presentation of credentials, enter and
inspect any property, premises or place on or related to the disposal site and facility
at any reasonable time for the purpose of determining compliance with this it

change ownership, or there is a name change of the Permittee, a formal permit
request must be submitted to the Division of Environmental Management
accompanied by an application fee, documentation from the parties involved, and

accordingly may cause the Division to initiate action to revoke this permit as

Our records show that Permit No. WQ0004172 was issued on
December 26, 1990 for the land disposal of contaminated soils.
The purpose of this letter is to advise you. of the importance of
the Permit and the liabilities in the agent of failure to comply
with the terms and conditions of the Permit. if you have not
already done so, it is requested that you and other appropriate
employees thoroughly read the Permit
The Permit` sots forth specific performance standards,
operation and maintenance requirements, monitoring requirements,
including annual reporting and groundwater monitoring'activities
to be perforated by the Permittee, plus general conditions
applicable to non -discharge aermi to , Failure to comply with the
terms and conditions of the Permit subjects the Permittee to
enforcement action pursuant to Section 143-215.6 of the North
C'arolina General Statutes. A civil penalty f up to $10,000 per
violation may be assessed for such violations.
Please note that the subject Permit. `;expires n November 30,
1995. Fart VI No. 9 of the Permit requires that d renewal
request be submitted at least six ( months prior to expiration.
Also the Permit is non -transferable until such time that the
eaitee has requested a name change to the new Permittee.
As mentioned previously, the purpose of this letter is to
advise you of the importance of your Permit. Please read the

disposing of approximately,492 cubic yards of petroleum contaminated soil from Hatcher Realty's
former Sunoco Station in Mecklenburg County to a 53,136 square, foot disposal area, located, along
Ilighway 74 outside of Indian Trail in Union, Countywith no discharge of wastes to tile surface
waters, pursuant to the application received September 25, 1990 and in conformity with the
prqject plan, specifications, and other supporting data subsequently filed and approved by the,
Department of Environment, Health and Natural Resources and considered a part of this permit.
This pemiit shall be effective from the date of issuance until November 30, 1995, and shall be,
subject to the ,following specified conditions and. liolitations:
1. PERFORNIANCESTANDARDS
1, The; Mooresville Regional Office, phone no. (919) 663-1699, shall lee notified at
least twenty-four t24) hours after land application of the contaminated soil so that
an inspection can be made. Stich notification to the regional supervisor shall be
made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday
through Friday, excluding State Holidays.
1 This permit shall become voidable if the soils fail to adequately assimilate the
wastes and may, be rescinded unless the facilities are installed, maintained, and
operated in a nianner which will protect the assigned water quality standards of the,
surface waters and ground waters,
3. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take it corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.
zl: The issuance of this permit shall notrelieve the Permittee of the responsibility for
damages to surface or groundwaters resulting froin the operation of this facility.
5 The following buffers shall be maintained:
a) 100 feet between disposal area,end any public or private water supply including
wells

b) 100 feet between disposal area and "SA and SB" classified surface waters
c) 50 feet between disposal area and any stream, lake, river or natural drainageway
d) 50 feet between disposal, area and property lines
e) 10 feet between disposal area and surface water interceptor drains or diversions
(upslope)
,f) 25 feet between disposal area and surface water interceptor drains or diversions
(downslope) and groundwater drainage systems.

OPERATION AND MAINTENANCE REQUIREMENTS
I The facilities shall be, properly maintained and operated at all titries.
2e The Permittee shall employ a certified wastewater treatment plant operator to be in
responsible charge of the wastewater treatment facilities. The operator must hold as
certificate of the grade at least equivalent to the, classification assigned to the
wastewater treatment facilities by the Certification Commission.
3, Adequate measures shall be taken to prevent surface runoff from carrying any
disposed material into any surface waters,
4 The 492 cubic yards of contaminated soil shall be spread to a thickness not to
exceed 3 inches on at least 1.2 acres of land at the disposal site,
5. The facilities shall be effectively maintained and operated as a non -discharge system
to prevent the discharge of any wastewater resulting from the operation of this
facility,
6The site shall be adequately limed to a soil pH of at least 6.5 prior to disposal of the
contaminated soil. 'I"he contaminated soil and lime shall be thoroughly incorporated
into the top six to eight inches of the native soils by tilling or disking,
7 To ensure that sufficient oxygen is provided for waste brodegyrailation, the site shall
be retilled at periods of one month, two months, and every six months thereafter
following disposal.
8 No food -chain crops shall be grown oil the landfarming sites for at least two years
following the completion of contaminated soil application and retriediation.
9 Nutrients, in the form of nitrogen and phosphorus fertilizers, inust be applied over
the disposal area and fully incorporated into the mixed contaminated and native soil
layer. To provide maxim urn benefits, fertilization should occur no sooner titan 5
days nor later than 30 days subsequent to disposal.
Rate of fertilizer application shoUld be the lesser of the following:
a) For nitrogen, the tolerance level of the vegetative crop, as determined by a
knowledgeable party, or 75-100 pounds per acre plant available nitrogen
(PAN).
b) For phosphorus, the tolerance level of the vegetative crop, as determined by a
knowledgeable party, or 50-75 pounds per acre P205 (or equivalent).

hours or on the next working daffy following the occurrence or first knowledge of
the occurrence of any of the following;
a. Any occurrence with the land application program which results in the land
application of significant arnounts of wastes Which are, abnormal ir7: quantity or
characteristic.
fa. Any failure of the land application program resulting in a discharge of wastes to
receiving waters.
c, Any time that self -monitoring information indicates that the facility is not in
compliance with the conditions and limitations of this permit or the parameters
on which the system was designed;
d. Any process unit failure„ due to known or unknown -reasons, that render the
facility incapable of adequate sludge treatment.
.. Any spillage or discharge frtarn a vehicle or piping system transporting
contaminated snail to the application site.
Persons reporting such occurrences by telephone shall also file «a written report i
letter forma within 15 days following first knowledge of the occurrence, This report
must outline'the actions taken or proposed to be taken to ensnare that the problem
does not recur:
W. GROUNDWATER RE UIREMENTS
Soil samples will be collected, from a minimum of two (2) areas at the disposal site,
at intervals of six months and twelve months following dispersal.
.Each sample will be composed of the vertical column of soil, extending from land
surfaces to the rna: imurn depth of waste incorporation, and collected by using a stall
auger, Shelby tube or split -spoon sampler.
Samples at each location will be thoroughly mixed and a representative portion
analyzed by methods "specified in Guidelines For Remediation of Soil
Contaminated By Petroleum available from the Division of Environmental
Management) to determine the concentration of tl Petroleums Fuel Hydrocarbons
(Method 3 0) and (2) any Volatile Organic Aromatic (VOA) compounds present;

In regards to the subject project, the staff report dated June

1) The volume of contaminated soil is 492 yds 3 , not 25 yds 3
2) There will not be a leachat e collection tank used to
collect leachate from the contaminated soil during
storage.
3) The treatment process has been revised from the original
submittal and will now be done by land farming. The
application rate is proposed to be 31' in depth on an area
4921 in length by 108' in width. it samples are
proposed to be taken at intervals of 6 months and 12
months and tested for TPH and BTEX.
4) It is also recommended that the soil be applied to the
fields on the south side of the< entrance road.

1990 states that Allen Hardy visited the site and indicated
that the soils are being stored properly. Mr. Hardy visited
the site but did not inspect the integrity of the stored
soil, but investigated the disposal area. Approval as to
whether the soils are properly stored should come from the
Groundwater Section.

PART IV - EVALUATION AND RECOMMENDATIONS
The applicant, John. Hatcher, has applied for a permit to
treat gasoline contaminated soils rc-moved from a former Sunoco
Station� The soils have been removed and placed on 10 ml plastic
surrounded by a soil dike. The applicant has contracted
Petroleum Environmental Consultants (PEC) to handle the treatment
and disposal. of the contaminated soil.
The treatment process will be done in layers, each layer
consisting of approximately 10 inches of soil which will be
turned (tilled) so that volatilization can occur. Each treated
layer will then be removed and tested to see if adequate
treatment has occurred. If treatment is not sufficient then the
process will be repeated. A mixture of "Biosolve" and water will
be added to each 10-inch layer to help breakdown the
hydrocarbons.
Upon completion of treating the contaminated soil to a level
below 10 ppm, it will then be incorporated into the native soil
at the site.
It is recommended that the non -discharge permit be issued
pending comments from the Groundwater Section and approval by 'the
SERG.

Below, please find the necessary information needed to begin
remediation of the contaminated soils.
1. Site information:
a. Depth to the seasonal high water table is greater than 3
feet below land surface.
b. The slope of the remediation site is less than 5% as
determined by a general survey of the plot.
c . Soil texture of the area is sandy loam.
d . The pH of the native soil is 6.9.
2. The amount of contaminated soils to be disposed of is 492-611.11111'
yds.
3: The application rate was determined on the Volumie/Area Basis.
The area required for remediation is 1.2 acres or 53,136 sq.
ft. Calculations are enclosed.
4Enclosed, please find the design calculations for the area to
be utilized in the remediation.
5. Enclosed, please find topographical and general survey maps of
the remediation site.
6. The contaminated soils will be thoroughly incorporated into
the top six to eight inches of the native soil by disking.

Dear Mr. Hawes:
Please note the change in reference to the contaminated soil_
remediation plan from "Appendix B: Criteria for Land Disposal of
to "appendix Guidelines for Bio emediation;.x„ The soils
were to initially be incorporated into the virgin soils where they
are being stored. Those plans have since been changed and it is
our intention to follow all Appendix B guidelines as Listed in the
November 1989 publication from. the NCDNR, Div. of Env. Management.
Please note that the soils are :not being; stored at 1318
Central avenue as was first` intended. The soils are being stored
on a piece of property owned by Mr. John Hatcher on Independence
Blvd., on 16 mil. plastic and covered with same. Mr. W. Allen
Hardy of the Water Quality Section, DEM , Mooresville Regional
Office has visited the site and has indicated that the soils are
being stored properly. The location of the property is opposite
the Bar 3 Golf Course on Independence Blvd., BookNo./Tax No.,
being —066 016.

Below Please find the necessary information needed to begin
remediation of the contaminated soils.
I The road to site will be secured by chain -link fence, with a
lock to prevent unauthorized access.
2. The soils are now being stored on 10 mil plastic and are
termed with a continuous soil dike. This area will, be
doubled to allow for the 6 to 12 inch thickness of
contaminated soil. The final_ area of the 10 mil plastic
soil remediation area will be 100 ft. X 100 ft
3. A leachate collection system will be installed, please see
attached specifications.
4. All lea hate will be pumped periodically (depending on
amount of precipitation) from holding tank by N.,C and will
be disposed of at James Waste Oil Co. of Charlotte. The
holding tank will be a 1000 gallon steel, tank that has been
air tested for holes and it's integrity.
5. The remediation area is 330 ft. from lndependence Blvd.,
greater than 1000 ft. from the nearest dwelling, and greater
than 1000 ft. from any potable wells, please see attached,
diagram.
6. The slope of the remediation area is less than 5% as
determined by as general survey of the plot.
7. The contaminated soils will be spread to a thickness of 12
inches and will be tilled at 1, 2, anc( 4 month intervals.
,8. Enclosed please find the TPH levels from the contaminated
soils. The sells were tested using EPA method 5030.
9. Find all product information and the MSDS regarding the
product "Biosolve" enclosed. The "Biosolve" will be spread
using as plastic hand held sprayer. The tractor will be
decontaminated after a final pass in t4e decontamination
area. (See Enclosed Decors Zone),
H). Enclosed please see the permission letter from Mr. Hatcher
giving approval for the soils to be remediated on his
property.
11. Enclosed please find the tank removal report and the initial
test results which prompted the need for soils remediated.
12. A farm tractor w/disc harrow will be used to till the soils
at the recommended intervals. Additional filling may occur
based on lab analysis, to increase the volitalization
process.

This area of the market is increasing everyday. In the U.S.A.
alone there are hundreds of thousands of leaking underground tanks
that have to be removed
Steps to be taken for P.D.A. application
1. Ascertain what type of fuel is in the tangy., haw long it has
been there and general condition of tank: if passible,
2. Pump out all remaining fuel and vent in a proper manner.
. Apply P.D.A. at a 6 eduction through poker washer or butter-
fly washer technique,
. Wash down with course strews of water and take explosion
meter reading before working any further on the tank. More
than one application may be neccessary.
It is important to note that it the tank was filled with gasoline
and has leaked into surrounding soil, P.D.A. can be used effec-
tively on the soil to neutralize explosion and flammability.
.
In cosparon to ways currently being used in neutralizing fuel
tanks, P.D.A. is far less time consuming, there -by making it much
more cost effective and more importantly, it is the safest proce-
dure due to the ever present threat of explosions.

This will refer to your request for a general assessment of the
condition of the soil around the underground storage tank and the
observation or the tank removal procedure at the following
location

Removal of tour 4) 3000, one 1) 8000, and one (1) 270 gallon
underground storage tanks was performed by petroleum Equipment and
Service, Inc. Charlotte, N.C., on December 6, 199 (See photos
1 and ) Removal.:.: appeared to be handled following proper
procedure and was completed satisfactorily without incident.
Inspection or the soils revealed product staining and odor around
the top of the tank and around the bottom of the tank basin after
removal. The tanks had visible holes and cracks and appeared t
be in pour condition. (See photos 3 and 4)w The Hanby Extraction
olormetrlc Field'Test was used to perform a field soil analysis,
and results indicated greater than tOO ppm 'APR. (See Attached)
Seven soil samples were removed at a depth of 18 feet, 6 feet
below the bottom of the tanks. (See attached site plan.) Samples
were placed in air -tight, containers and cooler for transportation
to Bold Laboratories for analysis of total petroleum hydrocarbons,..
EPA methods 40 030 and 8250/3550 were used.. Attached is the
report from Bold Laboratories indicating there were greater than
ten (S) ppm total.: petroleum hydrocarbons, which is above the
levels generally accepted by the regulatory agencies,.

Based on inspection of the tank, tank basin area, field test
results, and certified lab tests results, it is our opinion that
the tank area would currently require a cleanup under existing
statutes, ordinances or regulations applicable, and may pose an
imminent threat to public health, welfare, or the environment.
Mr. Jessie Wells of the North Carolina Department of Natural
Resources and Community Development was notified on December 7,
1989 of the contamination problem. At that point, Phase,1I was
put into action and is now taking place.

1 Provide a soil scientist report which dives an adequate description of the soils to
be utilized for the treatment of the contaminated soils. This report should include
a description of the soils to a depth of seven feet including field descriptions of
the texture, color„ structure, thickness of soil horizon, any restrictive zones
encountered, soil pH, and the presence or absence of the seasonal high water
table,
If the nail pH is below 6.0, provide the supporting calculations to determine the
amount of line deeded to bring the soil to a Ph of at lust 6.0.
