In accordance with NCGS 143-215.6A(f), the Division has found no cause to remit the original civil penalty assessment of$6,135.71. In making this request,I assert that I understand all of the following statements: • This request will be reviewed by the Chairman of the Environmental Management Commission and may be either granted or denied. • Making a presentation will require the presence of myself and/or my representative during a Committee meeting held in Raleigh,North Carolina. • My presentation will be limited to discussion of issues and information submitted in my original remission request,and because no factual issues are in dispute, my presentation will be limited to five (5)minutes in length. The repair project estimate completion date of August 2020.The City also continues to maintain their TV Inspection program and replace sewer mains lines as needed. DWR Response: The facility upgrade project listed above was for repairs to the aeration basin at the WWTP. No repair work was scheduled for the collection system. SSO Totals 2,130,000 gallons in 71 hours 720,000 gallons in 24 hours • (c) Whether the violation was inadvertent or a result of an accident: Permittee States: During the month of February, the City of Dunn experienced severe localized flooding. This caused the collection system to become inundated with flow which led to the 720,000-gallon sewer overflow at East Side Pump Station and a 2,130, 000-gallon spill at manhole BR- 8 on the Black River Outfall Line. DWR Response: The city has a severe I/I problem with a history of SSO's. During periods of wet weather, the I/I problems worsen. Average flow at the WWTP for the month Feb 2020 was 4.5. WWTP is permitted for 3.75. Daily flows at WWTP are: Feb 4 3.5 mgd Feb 5 3.8 mgd Feb 6 4.1 mgd Feb 7 6.457 mgd Feb 8 6.48 mgd Feb 9 6.3 mgd Feb 10 6.5 mgd The City had a least 4 other SSO's during the 2020 calendar year. The City doesn't have any major I/I scheduled other than routine TV work and cleaning. They do not qualify for a SOC due to lack of funding and a plan moving forward.
