REPORT OF LINCOLN COUNTY SEWER SYSTEM
House Bill 1160, which the General Assembly enacted in July 1999, requires that municipalities, animal
operations, industries and others who operate waste handling systems provide a summarized annual
report to its customers and to the Department of Environment and Natural Resources on the performance
of the wastewater treatment plant and the collections system over the past twelve months.
In accordance with this regulation, the Lincoln County Sewer System is pleased to provide copies of the

Wastewater Collections System Description:
The Lincoln County Sewer Collections System consists of approximately 2,884 linear feet of 36" gravity sanitary sewer
lines; 2,814 linear feet of 30" gravity sanitary sewer lines; 16,819 linear feet of 24" gravity sanitary sewer lines; 4,951
linear feet of 18" gravity sanitary sewer lines; 18,640 linear feet of 15" gravity sewer lines; 12,306 linear feet of 12"
gravity sewer lines; 388,247 linear feet of 8" gravity sanitary sewer lines; 5,145 linear feet of 20" force main; 39,925
linear feet of 12" force main; 12,209 linear feet of 10" force main; 16,361 linear feet of 8" force main; 154,774 linear
feet of 6" force main; 65,927 linear feet of 4" force main; 4,546 linear feet of 3" force main; 1,032 linear feet of 2"
force main; 4,224 linear feet of 6" low pressure sewer lines; 44,244 linear feet of 4" low pressure sewer lines; 75,298
linear feet of 3" low pressure sewer lines; 134,358 linear feet of 2.5" low pressure sewer lines; 50,410 linear feet of
2" low pressure sewer lines; and 47 sewer pump stations serving approximately 7,438 customers.
The low pressure sewer system utilizes individually owned grinder pumps and small diameter pressure lines to
collect and convey sewage to the gravity sewer system. Flows from the low pressure and gravity sewer systems are
collected at the 47 strategically placed sewer pump stations and pumped via the force mains to the outfall gravity
sewer system to be deposited at the Killian Creek Wastewater Treatment Facility (Permit #NC0088722) located at
7085 Old Plank Road, Stanley NC and the City of Lincolnton Wastewater Treatment Facility (Permit #NC0025496)
located at 550 West NC 150 Bypass, Lincolnton NC.

Incident:
An electrical contractor hit a 2" low pressure sewer line
while doing a bore. This caused sewage to flow into a storm
drain and then into Lake Norman. Repairs were made and
normal operations were established at 5:35pm on May 29,
2020. The incident was reported to NCDENR.
Spill Amount:
600 gallons
Impact:
None detected.
Corrective Action:
Ground area excess spillage was vacuumed.

November 4, 2020
Time:
9:10 am
Location:
7787 Water Oaks Dr.
Denver, North Carolina
Incident:
NCDOT hit a 2.5" low pressure sewer line while repairing a
culvert. This caused sewage to flow into an unnamed
tributary of Lake Norman. Repairs were made and normal
operations were established at 9:17am on November 4,
2020. Incident was reported to NCDENR.
Spill Amount:
150 gallons
Impact:
None detected.

If. Performance:
Killian Creek WWTP operated in compliance with our NPDES permit during the
calendar year of 2020. Compliance was reported on monthly Discharge
Monitoring Reports submitted to the North Carolina Division of Water Quality
during the year
Killian Creek WWTP had the following reported Notice of Violations (NOV)
1) March 315t the NH-n3 Ammonia was out of limits causing the WWTP to be out
of compliance for the month of March, 2020. No civil penalty issued.
2) April 4th and 30th the NH-n3 Ammonia was out of limits causing the WWTP to
be out of compliance for the month of April, 2020. Civil penalty was issued.
3). May 16th and 30th the NH-n3 Ammonia was out of limits causing the WWTP to
be out of compliance for the month of May, 2020. No civil penalty issued.

Denver, North Carolina
Incident:
A pump malfunction, electrically shorted several wires and tripped the control breaker, which
resulted in the loss of power on the 110 volt circuit for control power. The auto dialer was
connected to the 110 volt circuit and failed to identify the problem. This caused sewage to flow into
a ditch next to the Lift Station. Repairs were made and normal operations were established at 10:15
am on September 10, 2018. Incident was reported to NCDENR.
Spill Amount:
3,000 gallons
Impact:
None detected.
Corrective Action:
Ground area excess spillage was vacuumed.

Division personnel have reviewed and approved your permit modification request for Permit No.
WQ0029123. This modification is to change ownership from Hecht Properties, LLC to the East Lincoln
County Water and Sewer District, and East Lincoln County Water & Sewer District effective April 6, 2015, is
now responsible for the continued operation and maintenance of the subject wastewater collection
extension. Our database has been revised to reflect the ownership change.
This approval letter shall be considered part of the permit and is therefore incorporated by reference.
Other than ownership transfer, this modification includes no changes to the originally issued permit issued
July 27th, 2005 and is subject to the conditions and limitations specified therein.

Dear Mr. Hecht:
In accordance with your application received on June 27, 2005, we are forwarding herewith
Permit No. W00029123, dated July 27, 2005, to Hecht Properties, LLC for the construction and
operation of the subject wastewater collection system extension. This permit shall be effective from the
date of issuance until rescinded, and shall be subject to the conditions and limitations as specified
therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein
by reference.
Please pay particular attention to Permit Condition 3 which requires that the wastewater
collection facilities be properly operated and maintained in accordance with 15A NCAC 2H .0227 or any
individual system -wide collection system permit issued to the Permittee.
Permitting of this project does not constitute an acceptance of any part of the project that does
not meet 1) 15A NCAC 2H .0200; 2) the Division of Water Quality's (Division) Gravity Sewer Minimum
Design Criteria adopted February 12, 1996, as applicable; 3) and the Division's Minimum Design
Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000, as
applicable, unless specifically mentioned herein. Division approval is based on acceptance of the
certification provided by a North Carolina -licensed Professional Engineer in the application. it shall be
the Permittee's responsibility to ensure that the as -constructed project meets the appropriate design
criteria and rules. Failure to comply may result in penalties in accordance with North Carolina General
Statute §143-215.6A through §143-215.6C, construction of additional or replacement wastewater
collection facilities, and/or referral of the North Carolina -licensed Professional Engineer to the licensing
board.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations, permission is hereby
granted to Hecht Properties, LLC for the construction and operation of approximately 18 linear feet of 8-
inch gravity sewer, a 140 gallon per minute pump station (with duplex pumps, on site audible and visual
high water alarms, and an on -site generator with automatic transfer switch), and approximately 1235
linear feet of 4 inch force main as part of the Fairfield Forrest Pump Station project: and the discharge
of 62,280 gallons per day of collected domestic wastewater into the Lincoln County existing sewerage
system, pursuant to the application received July 13, 2005, and in conformity with 15A NCAC 2H .0200;
the Division's Gravity Sewer Minimum Design Criteria adopted February 12, 1996, as applicable; the
Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains
adopted June 1, 2000, as applicable; and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources and considered a part of this permit.
The sewage and wastewater collected by this system shall be treated in the Lincoln County
WWTP (Forney Creek NPDES No. NC0074012) prior to being discharged into the receiving stream.
The Operational Agreement between the Permittee and the Environmental Management
Commission is incorporated herein by reference and shall be a condition of this permit. Noncompliance
with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by
North Carolina General Statutes 143-215.6A to 143-215.6C for violation of or failure to act in
accordance with the terms and conditions of this permit.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150E of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, NC 27699-6714. Unless such demands are made, this permit shall be final and
binding.

This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
This permit shall become voidable unless the wastewater, collection facilities are constructed in
accordance with the conditions of this permit; 15A NCAC 2H .0200; the Division of Water Quality's
(Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996, as applicable; the
Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force
Mains adopted June 1, 2000, as applicable; and other supporting materials unless specifically
mentioned herein.
2. This permit shall be effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system -wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 2H .0227. If an individual
permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2H
.0227:
a. The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and any contravention of the groundwater standards in
15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200.
b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan shall be developed and implemented.
d. Pump stations that are not connected to a telemetry system shall be inspected every day (i.e.
365 days per year). Pump stations that are connected to a telemetry system shall be
inspected at least once per week.
e. High -priority sewer lines shall be inspected at least once per every six-month period of time.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g. . Inspection and maintenance records shall be maintained for a period of at least three years.
h. Overflows and bypasses shall be reported to the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by
North Carolina General Statute §143-215.1C.

4. This permit shall not be transferable. In the event there is a desire for the wastewater collection
facilities to change ownership, or there is a name change of the Permittee, a formal permit request
shall be submitted to the Division accompanied by documentation from the parties involved, and
other supporting materials as may be appropriate. The approval of this request shall be
considered on its merits and may or may not be approved.
5. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State.
6. Per 15A NCAC 2H .0220, upon completion of construction and prior to operation of these
permitted facilities, the completed Engineering Certification form attached to this permit shall be
submitted with the required supporting documents to the address provided on the form. A complete
certification is one where the form is fully executed and the supporting documents are provided as
applicable.
7. A copy of the construction record drawings shall be maintained on file by the Permittee for the life
of the wastewater collection facilities.
8. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2H .0200; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted
June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an
enforcement action by the Division, in accordance with North Carolina General Statutes §143-
215.6A through §143-215.6C.
9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or replacement
facilities.
10. The issuance of this permit shall not exempt the Permittee from complying with any and all
statutes, rules, regulations, or ordinances that may be imposed by other government agencies
(local, state and federal) which have jurisdiction, including but not limited to applicable river buffer
rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4
and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands
under 15A NCAC 2B .0200 and 15A NCAC 2H .0500.
11. Noncompliance Notification:
The Permittee shall verbally report to a. Division of Water Quality employee at. the Mooresville
Regional Office, telephone number (704)-663-1699, as soon as possible, but in no case more than
24 hours or on the next working day, following the occurrence or first knowledge of the occurrence
of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters
without treatment of all or any portion of the influent to such station or facility.

Voice mail messages or faxed information is permissible, but shall not be considered as the
initial verbal report. Overflows and spills occurring outside normal business hours may also be
reported to the Division of Emergency Management at telephone number [phone] or
[phone]. Persons reporting any of the above occurrences shall file a spill report by
completing Part I of Form CS-SSO (or the most current Division approved form), within five days
following first knowledge of the occurrence. This report shall outline the actions taken or
proposed to ensure that the problem does not recur. Part II of Form CS-SSO (or the most
current Division approved form) can also be completed to show that the SSO was beyond
control.

rescinded in March 2013.

The Lincoln County Sewer Collections System consists of approximately 2,882 linear feet of 36" gravity sanitary sewer lines, 2,811
linear feet of 30" gravity sanitary sewer lines, 16,808 linear feet of 24" gravity sanitary sewer lines; 4,952 linear feet of 18" gravity sanitary sewer
lines; 18,634 linear feet of 15" gravity sewer lines; 7,960 linear feet of 12" gravity sewer lines; 270,577 linear feet of 8" gravity sanitary sewer
lines; 5,145 linear feet of 20" force main, 31,143 linear feet of 12" force main; 12,465 linear feet of 10" force main;17,274 linear feet of 8" force
main; 154,256 linear feet of 6" force main; 66,450 linear feet of 4" force main; 3,436 linear feet of 3" force main; 45,443 linear feet of 4" low
pressure sewer lines; 74,012 linear feet of 3" low pressure sewer lines; 131,363 linear feet of 2.5" low pressure sewer lines; 49,542 linear feet of
2" low pressure sewer lines and 39 sewer pump stations serving approximately 4,077 customers.
The low pressure sewer system utilizes individually owned grinder pumps and small diameter pressure lines to collect and convey sewage
to the gravity sewer system. Flows from the low pressure and gravity sewer systems are collected at the 39 strategically placed sewer pump
stations and pumped via the force mains to the outfall gravity sewer system to be deposited at the Killian Creek Wastewater Treatment Facility
(Permit #NC0088722) located at 7085 Old Plank Road, Stanley NC and the City of Lincolnton Wastewater Treatment Facility (Permit
#NC0025496) located at 550 West NC 150 Bypass, Lincolnton NC.
II. Performance:
The Lincoln County Sewer Collections System had the following reportable sanitary sewer overflows (SSO's):
1. Date: April 04, 2013
Time: 10:12 pm
Location: 8314 Ranger Island Marina Road
Denver, North Carolina
Incident: Contractor struck a 1-1/2" low pressure sewer service breaking the '/e" test valve causing sewage to
spill to the ground and into Lake Norman.
Spill Amount: 20 gallons
Impact: None detected.
Corrective Action: Low pressure sewer service was permanently repaired with new parts. Excess spillage was
vacuumed. Ground site was treated with twenty pounds of lime.

Denver, North Carolina
Incident: During a heavy rain event a road culvert failed and washed out the dirt surrounding a 2" PVC low
pressure sewer main line. The 2" sewer main line separated at a coupling which flowed into a stone
drain system that emptied into Lake Norman.
Spill Amount: 1000 gallons
Impact: None detected.
Corrective Action: The 2" low pressure sewer main line was permanently repaired with new parts. Excess spillage was
vacuumed.

House Bill 1160, which the General Assembly enacted in July 1999, requires that municipalities,

lines; 18,636 linear feet of I S" gravity sewer lines; 7,961 linear feet of 12" gravity sewer lines; 271,298 linear feet of 8" gravity sanitary sewer
lines; 5,146 linear feet of 20" force main, 31,143 linear feet of 12" force main;12,465 linear feet of 10" force main; 17,274 linear feet of 8" force
main; 150,294 linear feet of 6" force main; 65,171 linear feet of 4" force main; 3,436 linear feet of 3" force main; 4,224 linear feet of 6" low
pressure sewer lines; 46,723 linear feet of 4" low pressure sewer lines; 74,012 linear feet of 3" low pressure sewer lines; 132,013 linear feet of
2.5" low pressure sewer lines; 49,882 linear feet of 2" low pressure sewer lines and 39 sewer pump stations serving approximately 4,285
customers.
The low pressure sewer system utilizes individually owned grinder pumps and small diameter pressure lines to collect and convey sewage
to the gravity sewer system. Flows from the low pressure and gravity sewer systems are collected at the 39 strategically placed sewer pump
stations and pumped via the force mains to the outfall gravity sewer system to be deposited at the Killian Creek Wastewater Treatment Facility
(Permit 4NC0088722) located at 7085 Old Plank Road, Stanley NC and the City of Lincolnton Wastewater Treatment Facility (Permit
4NC0025496) located at 550 West NC 150 Bypass, Lincolnton NC.
II. Performance:
The Lincoln County Sewer Collections System had the following reportable sanitary sewer overflows (SSO's):

Incident:
Severe lightning strike to the SCADA and Pump Control Panel causing both pumps to fail and the
SCADA System to fail to report a pump failure. Resulted in the pump station sewer backing -up and
overflow an adjacent sewer manhole into the Forney Creek. Repairs were made and normal
operations were established at 10:30 am on May 27, 2014. Incident was reported to NCDENR.

Ground area excess spillage was vacuumed. Ground site was treated with twenty-five pounds of
lime. Forney Creek was tested twice daily for fecal coliform until June 04, 2014 when fecal coliform
