Director Division of Water Quality May 14, 2007 DWQ Project # 07-0756 Cumberland County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Mark Dowdy Marcus Edwards Development, LLC 416 U.S. Highway 1, Suite B Youngsville, NC 27596 Subject Property: Arrowhead Subdivision Ut to Locks Creek [030615, 18-28, C] REQUEST FOR MORE INFORMATION Dear Mr. Dowdy: On May 2, 2007, the Division of Water Quality (DWQ) received your application dated Apri124, 2007, to impact 0.428 acres of 404/wetland, and 115 linear feet of intermittent stream, to construct the proposed residential subdivision. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please show all stream impacts including all fill slopes; dissipaters, and bank stabilization on the site plan at a scale of no smaller than 1"=50'. 2. Please provide cross section details showing the provisions for aquatic life passage. 3. Please submit electronic CAD files showing impact No. 5, via email to ian.mcmillan~a~,ncmail.net and on CD. This road crossing appears to be less than 75°, and DWQ requires stream crossings to be between 75° and 105°. Additionally, please clearly show the contours of the stream at this crossing. 4. Lot No. 15 appears to be impacting wetland. Is Lot No. 15 included in Impact No. 2, or is this an additional impact? Can Impact No. 1 be avoided by redirecting the road to the northeast or making a smaller turnaround area at the end of the culvert? 6. There is no map showing impacts at Site No. 6. Can the sewer line be shifted to the east to further minimize wetland impacts? 7. You indicate that the proposed project imperviousness will be 19 percent. Please provide an inventory of all impervious surfaces (building footprints, roads, driveways, decks, sidewalks, gravel-covered areas, etc.). 8. Please provide documentation that DWQ or Division of Forest Resources has made intermittent/perennial stream determinations on the site or contact DWQ to schedule intermittent/perennial stream determinations on the site. Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter and to provide us with a date that we may expect to receive this requested information. If we do not receive this requested information within one week of the date you indicate it will be forthcoming, your project will be withdrawn and you will need to reapply with a new application and a new fee. Please contact me in writing and Ken Averitte of the DWQ Fayetteville Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
