The Water and Sewer Authority of Cabarrus County (WSACC) is in receipt of the subject NOV for sanitary
sewer overflows, with one being near 3600 NC Hwy 49 in Concord and the other near 2915 Stallings Road in
Harrisburg. Attached you will find a summary of background information and steps taken as a result of these
overflows.
WSACC will continue to monitor these area along with other areas throughout its system. WSACC will also
continue to be proactive in protecting its facilities and to take all steps possible to prevent future spills. If you

OVERFLOWS - EVIDENCE AND JUSTIFICATION (SUMMARY)
Incident #201800560 - 3600 NC Hwy 49, Concord
1) The wastewater spill occurred due to the failure of an 8" ductile iron force main within a casing pipe under
a road crossing. This pipeline was installed in 1981 and has been in continuous operation for the past
37 years.
2) The spill was discovered by a member of the public and notification was received by the City of Concord.
Upon immediate investigation, the City of Concord turned off the City's pump station that feeds the line,
thus stopping the spill, and reported the issue to WSACC.
3) The pump station was turned off within 30 minutes of the spill being reported, thus greatly minimizing the
volume of wastewater spilled.
4) WSACC deployed several crews to the scene and excavated/located the pipe failure area. Once it was
determined that the pipe had failed within the road casing pipe, WSACC informed the City of Concord
that the force main could not be repaired that night; not until a contractor could be brought to the scene.
5) The City of Concord pumped and hauled from their pump station for two days before WSACC could
complete the repair.
6) WSACC brought in an outside contractor to complete the repair; once completed, WSACC notified the
City of Concord to turn on their pump station.
Incident #201800621 - 2915 Stallings Road, Harrisburg
1) The spill was the result of a survey rod that had somehow entered the sewer causing a clog in a manhole
that makes a 90 degree bend. The survey rod had allowed debris to build up to the point it stopped flow
through the 12" gravity PVC sewer.
2) The spill was discovered by the Town of Harrisburg's staff. Harrisburg and WSACC staff were able to
move quickly to jet out the blockage and remove the survey rod.
3) It is WSACC's belief that someone had either dropped or purposely placed the survey rod within the
wastewater collections system.

Water and Sewer Authority of Cabarrus County. The Division's Mooresville Regional Office concludes that the
Water and Sewer Authority of Cabarrus County violated Permit Condition I (2) of Permit No. WQCS00009 by
failing to effectively manage, maintain, and operate their collection system so that there is no SSO (Sanitary
Sewer Overflow) to the land or surface waters and the SSO constituted making an outlet to waters of the State
for purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143-215.1.
The Mooresville Regional Office is providing the Water and Sewer Authority of Cabarrus County an opportunity to
provide evidence and justification as to why the Water and Sewer Authority of Cabarrus County should not be
assessed a civil penalty for the violation(s) that are summarized below:

This Notice of Violation / Notice of Intent to Enforce (NOV/NOI) is being issued for the noted violation. Pursuant '
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
This office requests that you respond to this Notice, in writing, within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered in determining the amount of the. civil penalty are the violator's history of non-compliance, the cost of
ntional and whether money was saved by non-compliance.

WSACC is in receipt of the NOV for a Sanitary Sewer Overflow at the Muddy Creek WWTP (4,11
manhole upstream of the plant). WSACC has taken the following action.
1. We monitor the level of wastewater in the outfall line at the pump station. We will continue to
monitor and react quicker during future rain events.
2. We will increase flow into the Muddy Creek WWTP as needed in future rainfall events. For
this event, three treatment trains were on line instead of all four treatment trains. Three were
on line due to the dry fall and low flows experienced at the Muddy Creek WWTP. In the future,
all four treatment trains will be utilized if wet weather is forecast.
3. WSACC has completed extensive I&I investigations in this interceptor sewerline and the results
show it is a tight system. WSACC has worked with its member jurisdictions in conducting
additional I&I reconnaissance in this area. Several construction projects upstream have been
underway and may have contributed to this flow surge. We will investigate and monitor this
further.
