association with the creation of a 450 acre mitigation bank Lower Cape Fear Umbrella NLhgation Bank c/o Jon Vincent Page Two 9 PROJECT DESCRIPTION The project is located off Royster Road NE (SR #1430) adjacent to the Cape Fear River in Navassa Brunswick County To find the project site travel south on US Highway 74/76 to Village Road NE (the first Leland exit SR #1472) Turn right onto Village Road and travel approximately 0 6 miles to S Navassa Road (SR#1435) Turn right onto S Navassa Road and travel approximately 15 miles to the turn in the road Veer left, following the road as it becomes N Navassa Road (SR# 143 0) Travel approximately 15 miles to Royster Road NE Turn right and the entrance to the site will be located on the left Please note the property has a locked gate and access should be arranged with the agent The entire site consists of approximately 870 acres which is located within the planning jurisdiction of Navassa, in Brunswick County The site is bordered to the north by Indian Creek and the Cape Fear River to the east by the Cape Fear River and Brunswick County Wastewater Treatment Plant, to the south by Royster Road and to the west by Old Bluff Road and two privately owned parcels Manmade features on the tract include several dint access roads the remains of a former meat packing plant and an earthen causeway through existing wetlands crossing over Mill Branch Mill Branch connects to Indian Creek and a culvert connects the upper reaches of Mill Branch under the causeway The existing culvert is obstructed substantially restricting tidal flow Wetland vegetation on site consists primarily of that characteristic of a cypress swamp Bald Cypress (Taxodium distichum) Swamp Tupelo (Nyssa Mora) Red Bay (Persea borbonia) and Dwarf Palmetto (Sabal minor) comprise the tidal swamp forest while Bald Cypress Cattails (Typha spp ) Millet (Pennisetum glaucum) and Foxtad (Setaria sp ) constitute the wetland vegetation upstream of the culvert/causeway The waters of the Cape Fear River adjacent to the project site are classified as SC by the North Carolina Division of Water Quality They ARE designated as a Primary Nursery Area (PNA) by the N C Division of Marine Fisheries and they are closed to the harvest of shellfish The waters of Indian Creek and Mill Branch are classified as C SW by the Division of Water Quality They are NOT designated as PNA by the Division of Marine Fisheries are designated as Inland Fishing Waters by the Division of Marine Fisheries and Wildlife Resources Commission and are also closed to the harvest of shellfish PROPOSED PROJECT The applicant is proposing removal of the existing earthen causeway and culvert to allow for increased tidal exchange between the upper and lower portions of Mill Branch The work is being submitted as part of a mitigation plan for development of the Lower Cape Fear Umbrella Mitigation Bank An application has been submitted to the US Army Corps of Engineers and is under review As proposed the causeway and culvert would be excavated and the project area would be brought to the existing adjacent grade Work would be conducted from the causeway retreating towards high ground as the area is lowered to the final grade A 3 1 slope would be constructed at both ends of the causeway where they meet high ground Silt fence would be installed around the entire area of disturbance and a temporary diversion ditch and check dams would be installed Excavated material would be hauled to a high ground disposal site located approximately 700 south of the causeway The disposal site would measure 316 in length by 175 in width The disturbed causeway area would then be planted with Swamp Tupelo Green Ash (Fraxinus pennsylvanica) and Swamp Cypress Lower Cape Fear Umbrella NLtigation Bank c/o Jon Vincent Page Three 10 ANTICIPATED EMPACTS The overall proposed project would result in the disturbance of approximately 5 32 acres According to the applicant the work associated with the causeway removal would result in the excavation of approximately 1 479 square feet of Public Trust Area (an estimated volume of 55 cubic yards of material) Approximately 19 520 square feet of §404 wetlands would also be temporarily impacted by the grading and causeway removal It would also result in the excavation of approximately 33 750 square feet of high ground in association with the project and 55 300 square feet of disturbed area resulting from the high ground spoil disposal site The applicant states that the remaining 2 66 acres of disturbance is associated with potential road grading It can be anticipated that the project will result in temporary increases in turbidity The removal of the causeway and culvert will restore tidal flow to the upper reach of Mill Branch As Navassa Cape Fear River, Brunswcik County , l Project Narrative D-lilt Irv) Vi ' March 1, 2012 revised April 2012 Purpose This CAMA Major Permit application is submitted on behalf of the Wilmington River Club LLC and requests work in a public trust shoreline AEC for the purpose of wetland and stream restoration The Wilmington River Club LLC (bank co sponsor) has submitted a mitigation plan for development of the Lower Cape Fear Umbrella Mitigation Bank (LCFUMB) to the US Army Corps of Engineers Wilmington Regulatory Office which is currently under review by the Corps and the Interagency Review Team (IRT) The bank will provide compensatory mitigation for authorized stream and wetland impacts occurring within the Lower Cape Fear River Basin Two tracts are included in the plan however only the tract located on the Cape Fear River in Brunswick County near Navassa (referred to as the Sneeden Tract in the mitigation plan) requires a CAMA permit and is the subject of this application The Sneeden property is comprised of two parcels (Brunswick County parcels 0240000102 and 0241A001) which total roughly 870 acres The property is bordered on the north and east by the Cape Fear River and includes the lower section of Mill Branch The southern portion of the site is bounded by Cartwheel Branch Approximately 417 acres of mature tidal freshwater cypress gum swamp exist within the property immediately adjacent to the Cape Fear River and the lower section of Mill Branch Indian Creek (a fourth order tributary of the Cape Fear River) flows through the tidal swamp forest along the northern edge of the property Shoreline along the Cape Fear River /Indian Creek on the northern and eastern sides totals approximately 13 623 linear feet Tidal freshwater swamp along the river wetlands adjacent to Cartwheel Branch and wetlands along Mill Branch will be preserved restored and enhanced under the mitigation plan The LCFUMB will place in preservation a total of approximately 453 acres of wetland and associated upland buffer Water and Land Use Classifications Waters of Mill Branch Cartwheel Creek Indian Creek and the adjacent Cape Fear River are all classified by the NC Environmental Management Commission (EMC) as C Sw denoting a freshwater swamp (Sw) that is protected for secondary recreation Waters in Mill Branch Cartwheel Creek and Indian Creek are also classified as inland waters by the NC Marine Fisheries Commission (MFC) Adjacent waters of the Cape Fear River are classified by the MFC as joint waters and primary nursery areas The property is zoned by the Town of Navassa as an approved planned unit development (PUD RB) The Town of Navassa s future land use map references upland portions of the property as falling within Area 1 and is subject to the associated planning policies for that area Wetlands within the property are mapped as conservation Wetland restoration enhancement and preservation are inherently consistent with the designated land use Adjacent land uses are a mix of residential and industrial Proposed Work Work requested in this application involves the removal of an earthen causeway /dam which has impounded the upper reach of Mill Branch The causeway /dam has blocked tidal exchange between the lower portion of Mill Branch (and the tidal influence of the Cape Fear River) and the upper portion Conversion of the upper portion of Mill Branch to an open water impounded wetland is apparent by a change in hydrology and vegetation Hydrographs from the impounded area demonstrate nearly static water levels ranging from 18 inches to 24 inches above the soil surface While an outlet pipe exists at the northern end of the causeway this outlet has been managed over time to control water levels and has often been completely blocked by Project Narrative CAMA Mayor Permit Application Lower Cape Fear Umbrella Mitigation Bank Brunswick County beaver Currently rip rap and beaver dam debris at the base of the culvert on the impounded side covers approximately half of the pipe s opening During the majority of the year and during normal rainfall conditions water levels in the impounded area are higher than the adjacent tides and flow is largely an outflow to Mill Creek Regular bi lateral flows between upper reaches of the former stream and the tidal source no longer exist The causeway also severs any previously existing navigability by canoe or kayak and blocks the movement of fish into upper reaches of the creek Wetland vegetation above the causeway consists of bald cypress millet foxtail and cattail Natural vegetation in the tidal swamp forest consists of bald cypress swamp tupelo red bay American b ti and dwarf palmetto Along lower portions of Mill Branch lizard s tail pickerel weed and duck potato can also be found The causeway is aligned such that the tidal swamp forest abuts the northem /eastern edge and the impounded portion of Mill Branch abuts the southern /westem edge The mitigation plan proposes to remove the causeway restoring riparian wetlands in their former footprint and enhancing wetlands further up gradient of the structure Removing the causeway and matching adjacent reference wetland grades will allow for re- establishment of characteristic riparian wetland hydroperiods and tidal exchange The normal high water (NHW) contour along the northem /eastern edge has been identified as the 2 MSL contour A portion of the grading associated with removal of the causeway will fall within the 30 Public Trust Shoreline AEC Temporary work in wetlands will also be necessary to match the adjacent reference elevations Work below NHW in Public Trust Waters will be very limited with two areas shown on Sheet 6 totaling 1479 sq ft in size Work below NHW will be limited to that necessary to remove fill and re establish reference wetland elevations Excavation below NHW is expected to total no more than 27 cy to 50 cy Work in the Public Trust Shoreline AEC totals 19 749 sq ft in area Work in 404 wetlands along the lower slopes of the causeway would be temporary work to remove fill and re establish natural reference wetland elevations Temporary work in wetlands has been estimated on Sheet 6 to total 19 520 sq ft in size Approximately 723 cy to 1446 -cy of fill material may be removed from areas still meeting wetland criteria but no longer at reference wetland elevations Excavation of the entire dam (upland wetland and public trust waters combined) has been estimated to total 33 750 sq ft with the removal of approximately 5 000-cy of fill material The only other work proposed is grading for the spoil disposal site and possible grading of the existing dirt access road if needed The upland spoil disposal area is estimated to be 55 300 sq ft in size Total disturbed area shown on the grading plan is 5 32 ac The remaining balance of area to be disturbed is associated with the potential road grading Earthwork will be done with equipment staged on the causeway moving back as work is completed Upland staging areas are also available at the northern and southern ends of the causeway where the dirt road exists on upland At the intersection with upland at the northern and southern ends the area will be graded to 31 side slopes to tie to existing upland grades The existing corrugated metal pipe at the northern end of the causeway will be removed A temporary diversion ditch and temporary rock check dams will be installed along with silt fencing around the entire area of disturbance per a grading and erosion control plan prepared by Florence and Hutchenson consulting engineers Material will be staged and stored in the disposal area which will be located approximately 700 south of the causeway on upland outside the AEC Area within the causeway footprint will be planted on approximate 10 centers with characteristic cypress gum swamp species such as swamp tupelo green ash and bald cypress Associated Permits A wetland delineation of the entire property was conducted in January 2010 The delineation was approved during a site visit with USACE staff on August 17 2010 and a copy of the signed wetland delineation surrey is included in this
