It is with great anxiety that I write this letter What was to be our dream house and
security for our family has developed into a mghtmare
When I first went to my County and City planners my only concern was the high fees
they were going to charge to oversee my home construction Never in my wildest dreams
did I realize their inability to give me guidance in the state environmental laws would
lead me and my wife to the horrible situation we find ourselves in today
I greatly appreciate the assistance that has been given me by your office I especially
appreciate Lauren Witherspoon walking me through the pitfalls of government
bureaucracy and regulations Her phone calls and information have been very helpful in
understanding the pitfalls and miscues that led to my dilemma Her personal visit to my
property yesterday shows me she is trying to help
I would like to request a Modification of Variance Buffer Authorization ( DWQ Project
#11 1125)
Zone 1 Impact
(1) After meeting with Ms Witherspoon it was determined that a total of twenty
two (22) trees and/or shrubs in Zone 1 would resolve the violation
(3)Buffer Mitigation The planting of two hundred sixty seven (267) trees is
unrealistic due to the limited open space left on my lot I am impacted by a golf path
easement on the East side the golf course on the North side the creek and sewer
easement on the West side and the street Fernwood Way on the South side
(6)Diffuse Flow This resolution your office is requesting would create a real
problem for me The soil that my house was built on is mostly clay During the
construction phase of my home the moisture content of the clay soil was so high mold
grew under my house requiring me to bring in a professional company to treat the mold
I was told then it would be necessary to do everything possible to keep moisture from
under my house I added a moisture barrier French drains and downspout piping to
prevent a future mold problem

I have contacted my State Representative James W Crawford Jr and he advised me of
up- coming changes to the Buffer standards for individual homeowners He and I both
hope this will bring about a resolution to this problem I am requesting this modification
to allow me enough time to have the NC Legislature meet and vote on these changes
Thank you for your interest in my problems and if for some reason the Legislature does
not resolve my problems my hope is you will still honor my requested modifications
