Division of Water Resources' Central and Regional staff has reviewed the application package
received August 21, 2020. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on December
16, 2020.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Section A, or failure to provide the additional information on or before the above requested date may
result in your application being returned as incomplete.
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper
copies and one electronic copy submitted to my attention at the address below.

A. Application:
1. Condition I.I. of the previous permit dated August 8, 2017 stated:
"Within 60 days of the effective date of this permit, the Permittee shall submit a properly
notarized and executed Operating Agreement that has been signed by the appropriate
representatives of The Village of Bald Head Island, the Bald Head Island Club, and the Bald
Head Island Villas Association. The completed agreement shall be submitted to the Division
of Water Resources, Water Quality Permitting Section, 1617 Mail Service Center, Raleigh, NC
27699-1617. [15A NCAC 02T .0108(b)(2)]"
An unsigned draft of this Operating Agreement, dated July 20, 2017, was included in the issuance
of the previous permit. Also attached to the previous permit issuance was an executed
Memorandum of Understanding dated April 21, 2017 referencing a future exploration and submittal
of this Operating Agreement to the Division. Please submit a notarized and executed Operating
Agreement that fulfills this Memorandum of Understanding and Condition I. I. of the previous
permit.
