Per an application request made by December 28, 2006, the Di -vision of Water Quality is rescinding the
subject recycle system permit. In accordance with NC State Administrative Code 15A NCAC 02T,
effective September 1, 2006, the recycle system at Cottonwood Ready -Mix Plant meets the requirements
of Section .1003(a) for systems to be deemed permitted. The recycle system at Cottonwood Ready -Mix
Plant is not required to apply for future permit renewals or modifications provided that the facility
continues to comply with the requirements of 15A NCAC 02T .1000
In accordance with Reorulatio n 15A NC AC 02T .1003(a)(2), the recycle system at Cottonwood Ready
-
Mix Plant shall operate with sufficient storage capacity to contain the runoff from a 24-hour, 25-year
storm event plus one foot freeboard. As per the rescission request dated December 28, 2006, the recycle
system at Cottonwood Ready -Mix Plant shall operate with a freeboard of no less than 23-inches (I I
inches to accommodate a 25-year store n in addition to the required 12-inclics).
Please be advised that NC State. Administrative Code 15A NCAC 02T .1003(a) requires that a Spill
Control Plan be maintained for the Facility. The Spill Control Plan shall at a minimum addresses the
following iterns-
a, Contact phone numbers for 24-hour response, including weekends and holidays;
b. Contact phone number for the Division of Water Quality Regional Office;
c. Contact information for construction crews, contractors and/or engineers.-
d. Expected response dines;
e. Essential equipment list and spare parts inventory;
f. Location of clean up materials,

The system serves a truck wash pad where trucks are washed after loading cement and
drums are washed out at the end of the day. Recycled water is used in production.
Rainwater is also pumped from an adjacent holding basin for use in production. Municipal
water is available when the basins need to recharge.

I NCAC 02T.1003 PERMITTING BY REGULATION
(a) The following systems are deemed permitted pursuant to Rule .0113 of this Subehapter provided the system
meets the criteria in Rule .0113 of this Subchapter and all criteria required for the specific system in this Rule:
(1) Return of wastewater contained and under roof within air industrial or commercial process where, therei is no
anticipated release of wastewater provided the facility develops and maintains a spill control plan in the
event of release -and no earthen basins are used.
(2) Recycling of rinse water at concrete mixing facilities for concrete mix removal from equipment provided
tire wastewater is contained within concrete ATUCtUres, there is sufficient storage capacity to contain the
runoff from a 24-Bout, 25;-year storm event plus one foot freeboard and the facility develops and maintains
a spill control plan in the event of a wastewater release, The facility must notify the appropriate Division
regional office in writing noting the owner, location, and that the design complies with the above criteria.
(3) Recycling of wash and rinse water at vehicle wash facilities provided the wastewater is contained within
concrete, steel or synthetic structures (i.e. not including earthen basins), all vehicle washing is conducted
under roof and there are no precipitation inputs (direct or indirect), and the facility develops and maintains a
spill control plan in the event of a wastewater release,
(4) The reuse or return of wastewater within the treatment works of a permitted wastewater treatnientsystern,
(b) The Director may determine that a system should not be deemed permitted in accordance with this Rule arid Rule
.tit 1:3 of this Subchapter. This determination small be made in accordance with Rule,01 t3(e) of this Subchapter.

Dear Mr, Colson:
Enclosed is form RRPWRS 10-06 to rescind Permit WC, 0004 t 68. Also enclosed is a
detailed scaled drawing of the existing recycle water basin system along with calculations
used to determine the storage capacity required to contain a,25 year storni event. Water
inputs to the SyStCTII include rainwaterand the volume ol"water required to rinse as truck
during operations (approx. 20 gallons/truck), Outputs include the use of the recycle
water in concrete hatching which equals 190 gallons per 10 cubic yard truck load plus
any water additions after loading to adjust the concrete slump (COBSistency).
CEMEX manually pumps contained rainwater from an adjacent holding basin to
replenish the water used in production. When this water gets consumed the plant
switches over to city water for its demands until the recycle basins recharge frorn rinse
water and/or rainwater.
Given that the recycle water system at this facility is designed to manage a 25 year storin
event with I I inches of free board and all other additions of water to tile system are
manually controlled'. this fiacifity can operate to meet the requirements of Rule 15 A
NCAC 02T, 10003.
CEMEX also maintains a spill response plan at the facility per NC Storniwater and
Federal Spill Prevention Control and Countern-leasure Regulations. This includes phone
contacts of? hour emergency spill response contractors if needed. Additionally, this

continued operation of a 13,500 GPD wastewater recycle system consisting of a 30 ft. by 40 ft, wash pad,
a 63,900 gallon recycle basin with a 200 GPM recycle pump and all associated piping, valves, and
appurtenances, to serve North Charlotte Ready Mix Concrete Plant, with no discharge of wastes to the
surface waters, pursuant to the renewal application received March 8, 1995, and in conformity with the
project plan, specifications, and other supporting data subsequently filed and approved by the Department
of Environment, Health and Natural Resources and considered a part of this permit.
This permit shall be effective, from the date of issuance until April 30, 2000, shall void Permit No.
WQ0004leg issued November 15, 1990, and shall be subject to the following specified conditions and
limitations:

the conditions of this permit, the approved plans and specifications, and other supporting
data.

4. This permit is not transferable. In the event there is a desire, for the facilities to change
ownership, or there is a name change of the PermiLtee, a formal permit request must be
submitted to tile Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered oil its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Pe. rmittee shall take immediate corrective action, including those
actions that may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.

The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215,1 and in a manner approved by the North Carolina Division of
Environmental Management,
The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or gtoundwaters resulting from the operation of this facility,
S. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Ereqtnarq in the recycle basin shall not be less than two feet at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure -
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the, release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Environmental Management or other permitting authority, upon request.
14. Any-duly.authori7ed officer, employee, or representative of the Division of Environmental
flan agement may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the, purpose
of determining compliance with this, permit, may inspect or copy any records that must be
maintained under the terms and conditions of this permit, and may obtain samples of
groundwater, surface water, or leachate,
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H 0205
(c) (4) �
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6(a) to 143-21,5.6(c).
17. The issuance, of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction,

19. Noncompliance Notification:
The Permittee shall report by telephone to the Mooresville Regional Office, telephone
nurnber 704) 663-1699, as soon as possible, but its no case more than 24 hours or on the
next working day following the occurrence or First knowledge of the occurrence of any of
the following;
a. Any occurrence at the wastewater treatment facility which results In the treatment of
significant amounts of wastes, which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank., the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;
b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators compressors, etc,;
c y failure of a pumping station.. sower line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to
such station or facility; or
d ® Any time that .self -monitoring information indicates that the facility is not in compliance
with its permit lirn itations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report roust outline
the actions taken or proposed to be taken to ensure that the problem does not recur;

grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. ion. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title l A, Chapter A, 202:.. The ORC of the facility trust visit each Class I facility at
least weekly and each Class II, III„ and IV facility at least daily, excluding weekends and
holidays, and roust properly manage and document daily operation and maintenance of the
facility and roust comply with all other conditions of Title 1 A, Chapter A, .t1202.
21. The Ise , ittee , at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the hermit for such period of time

permit, since operation of the facility's wastewater system was a regulated activity,; On September 1, 200
the North Carolina Administrative Code 1 A Subchapter 02T became effective and replaced Section 1 A
NCAC 02H .0200
1 A NCAC 02T.1003 PERMITTING BY REGULATION (enclosed) states that:
2T .1 3(a) The following systems are deemed permitted pursuant to Rule 113 of this
Subchapter provided the system meets the criteria in Rule .0113 of this Subchapter and ,all criteria
required for the specific system in this Rule:
2T .1 g 3(a)(2) Recycling of rinse water at concrete mixing facilities for concrete mix removal from
equipment provided the wastewater is contained within concrete structures, there is sufficient
storage capacity to contain the runoff from a 2-hour, 2-year storm event plus one foot freeboard
and the facility develops and maintains a spill control plan in the event of a wastewaterrelease.
The facility must notify the appropriate Division regional office in writing rioting the owner, location,
and that the design complies with the above criteria:,
Rule .0113 (enclosed) states that disposal systems in Permitting By Regulation rules in this Subchapter
including .1003 are deemed to be permitted and it shall not be necessary for the Division to issue
individual permits or coverage under a general permit for construction or operation of the systems
providers the system does not result in any violation of surface water or groundwater standards, there is no
direct discharge to surface waters, and all criteria required for the specific system is met.
You may wish to evaluate your system to see if it conforms to the requirements in the noted sections. if
the Ready -Mix Charlotte plant meets the criteria listed in Rule .13(a)(2) and .113, you may request the
rescission of the subject permit by submitting` a written request on Form RRPWRS 13-3 (enclosed) to the

I This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data,

4. This permit is not transferable, In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.

Permit The facility is a 13,500 GPD wastewater recycle facility with a
wash pad, recycle basin and recycle pump.
Records/Reports The inspection file was reviewed and documented all
repairs to the system. 1t was notes that the recycle pump
required many repairs. Mr. Tysinger indicated that was because
of the solids in the water created a lot of wear on the pumps.
Facility/Operations -'The facility appeared in good condition and with
adequate freeboard in the basin. All drains receiving process
water flow to the basin. The facility is able to use 1 0
reycle water, but usually makes up 70 of the process water. The
system operates on float valves in the tank at the loading area
which turns on & off the pump at the basin. A new wash pact was
installed in 1994 to replace the old location.

PART 1 - EVALUATION AND RECOMMENDATIONS
The applicant, icant, i tromont Materials Corp., has applied for a
non -discharge permit at the North Charlotte Ready Mix Plant for the
washing of concrete trucks.
Most larger solid particles will be screened prior to the
settling aain. These larger solids are mainly sand and. gravel.
Finer solids will be settled out and will have no cementing
properties. The wastewater ( u rnat :nt) in the settling basin will;
have a pH of -11 n.u.. and will be used to 'mix with the new batches
of concrete. Approximately three feet of freeboardwill be provided
in the settling basin for rainfall events. c rdin... to the
applicant, the facilities have been designed,to handle a 100 year
storm event.
This office recommends that the subject permit be issued
pending receipt and approval of Groundwater comments.
